Esse controle ocorre pelo princ\u00edpio da autotutela. Nas licita\u00e7\u00f5es p\u00fablicas n\u00e3o seria diferente. Ocorrendo fato relevante que possa gerar inconveni\u00eancia na continuidade do certame licitat\u00f3rio ou preju\u00edzo na manuten\u00e7\u00e3o da contrata\u00e7\u00e3o, a Administra\u00e7\u00e3o P\u00fablica poder\u00e1 rever seus atos.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5141f83 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"5141f83\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d341290 elementor-widget elementor-widget-heading\" data-id=\"d341290\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Autotutela<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4702508 elementor-widget elementor-widget-text-editor\" data-id=\"4702508\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\"><strong>S\u00famula 473 (STF):<\/strong> A administra\u00e7\u00e3o pode anular seus pr\u00f3prios atos, quando eivados de v\u00edcios que os tornam ilegais, porque deles n\u00e3o se originam direitos; ou revog\u00e1-los, por motivo de conveni\u00eancia ou oportunidade, respeitados os direitos adquiridos, e ressalvada, em todos os casos, a aprecia\u00e7\u00e3o judicia.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bea948f elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"bea948f\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-160779c elementor-widget elementor-widget-heading\" data-id=\"160779c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Atos da Autoridade Superior<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b5f257d elementor-widget elementor-widget-text-editor\" data-id=\"b5f257d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Determinar o retorno<\/strong> =&gt; Saneamento<\/span><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Revogar<\/strong><\/li><\/ul><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Conveni\u00eancia\/oportunidade<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fato superveniente<\/span><\/li><\/ol><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Anular<\/strong><\/li><\/ul><ol><li><span style=\"font-weight: 400;\">Ilegalidade insan\u00e1vel<\/span><\/li><li><span style=\"font-weight: 400;\">Fato superveniente<\/span><\/li><\/ol><p><b>Segue o previsto no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48778-2023-rio-de-janeiro-regulamenta-as-licitacoes-pelos-criterios-de-julgamento-por-menor-preco-ou-por-maior-desconto-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48.778&amp;origin=instituicao#\">Decreto n\u00ba 48.778 de 30 de outubro de 2023<\/a>, quanto \u00e0 revoga\u00e7\u00e3o e \u00e0 anula\u00e7\u00e3o.<\/b><\/p><p><em><span style=\"font-weight: 400;\">Art. 48 &#8211; A autoridade superior poder\u00e1 revogar o procedimento licitat\u00f3rio de que trata este Decreto por motivo de conveni\u00eancia e oportunidade, e dever\u00e1 anular por ilegalidade insan\u00e1vel, de of\u00edcio ou por provoca\u00e7\u00e3o de terceiros, assegurada a pr\u00e9via manifesta\u00e7\u00e3o dos interessados.<\/span><\/em><\/p><ul><li><em><span style=\"font-weight: 400;\"> 1\u00ba &#8211; O motivo determinante para a revoga\u00e7\u00e3o do processo licitat\u00f3rio dever\u00e1 ser resultante de fato superveniente devidamente comprovado.<\/span><\/em><\/li><li><em><span style=\"font-weight: 400;\"> 2\u00ba &#8211; No caso de anula\u00e7\u00e3o, ao pronunciar a nulidade, a autoridade indicar\u00e1 expressamente os atos com v\u00edcios insan\u00e1veis, tornando sem efeito todos os antecedentes e subsequentes que deles dependam, e dar\u00e1 ensejo \u00e0 apura\u00e7\u00e3o de responsabilidade de quem lhes tenha dado causa.<\/span><\/em><\/li><li><span style=\"font-weight: 400;\"><em> 3\u00ba &#8211;
