seja ela na forma eletr\u00f4nica ou presencial.<\/span><\/p><ul><li>Possui poder de julgamento\u00a0<\/li><li><span style=\"font-weight: 400;\"> Possui delibera\u00e7\u00e3o nos preg\u00f5es<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">O <\/span><a contrata\u00e7\u00e3o e estabelece regras para a designa\u00e7\u00e3o dos agentes p\u00fablicos do ciclo de contrata\u00e7\u00f5es p\u00fablicas no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em><span style=\"font-weight: 400;\">Art. 34 O agente de contrata\u00e7\u00e3o e seu respectivo substituto, designados pela autoridade competente do \u00f3rg\u00e3o ou entidade, em car\u00e1ter permanente ou especial, \u00e9 o respons\u00e1vel para o desempenho das atribui\u00e7\u00f5es legais na condu\u00e7\u00e3o da licita\u00e7\u00e3o, podendo:<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">I &#8211; ser auxiliado na fase externa, sempre que necess\u00e1rio, por equipe de apoio, respondendo individualmente pelos atos que praticar, salvo quando induzido a erro.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">II &#8211; ser assessorado pelos \u00f3rg\u00e3os de assessoramento jur\u00eddico e de controle interno sobre modelos de minutas de editais, de termos de refer\u00eancia, de contratos padronizados e de outros documentos.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">III &#8211; ser substitu\u00eddo, no caso de licita\u00e7\u00e3o de bens ou servi\u00e7os especiais, por comiss\u00e3o de contrata\u00e7\u00e3o que responder\u00e1 solidariamente por todos os atos praticados, ressalvado o membro que expressar posi\u00e7\u00e3o individual divergente fundamentada e registrada em ata.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">\ud83d\udea8<\/span><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico.<\/span><b> Em licita\u00e7\u00e3o na modalidade preg\u00e3o, o agente de contrata\u00e7\u00e3o ser\u00e1 designado pregoeiro.<\/b><\/em><\/p><p><br \/><br \/><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0830f86 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"0830f86\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4817020 elementor-widget elementor-widget-heading\" data-id=\"4817020\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Cargo em Comiss\u00e3o<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ca0c66 elementor-widget elementor-widget-text-editor\" data-id=\"3ca0c66\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em><span style=\"font-weight: 400;\">Art. 35 O agente de contrata\u00e7\u00e3o deve ser, preferencialmente, servidor efetivo ou empregado p\u00fablico dos quadros permanentes da Administra\u00e7\u00e3o P\u00fablica.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. Os agentes p\u00fablicos designados para o desempenho das fun\u00e7\u00f5es da \u00e1rea de contrata\u00e7\u00f5es, dever\u00e3o preencher os seguintes requisitos:<\/span><\/em><\/p><p><em><span style=\"font-weight: 400;\">II &#8211; tenham atribui\u00e7\u00f5es relacionadas a licita\u00e7\u00f5es e contratos ou possuam forma\u00e7\u00e3o compat\u00edvel ou qualifica\u00e7\u00e3o atestada por certifica\u00e7\u00e3o profissional emitida por escola de governo criada e mantida pelo poder p\u00fablico; tomar decis\u00f5es em prol da boa condu\u00e7\u00e3o da licita\u00e7\u00e3o, dar impulso ao procedimento, inclusive por meio de demandas \u00e0s \u00e1reas das unidades de contrata\u00e7\u00f5es, descentralizadas ou n\u00e3o, para fins de saneamento da fase preparat\u00f3ria, caso necess\u00e1rio;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">II &#8211; acompanhar os tr\u00e2mites da licita\u00e7\u00e3o e promover dilig\u00eancias;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">III &#8211; coordenar e instruir o processo licitat\u00f3rio, conduzindo os trabalhos da equipe de apoio;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">IV &#8211; conduzir a sess\u00e3o p\u00fablica e os procedimentos relativos \u00e0 etapa competitiva de lances, classifica\u00e7\u00e3o, julgamento e escolha da proposta ou do lance de menor valor, e sua aceitabilidade;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">V &#8211; examinar as propostas iniciais ofertadas, desclassificando as que n\u00e3o sejam compat\u00edveis com o edital;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">VI &#8211; receber e analisar a documenta\u00e7\u00e3o de habilita\u00e7\u00e3o do licitante que apresentou o melhor pre\u00e7o durante a sess\u00e3o p\u00fablica virtual, verificando a sua regularidade, e sendo este inabilitado, dos demais licitantes sucessivamente, observada rigorosamente a ordem de classifica\u00e7\u00e3o;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">VII &#8211; sanar erros ou falhas que n\u00e3o alterem a subst\u00e2ncia dos documentos e sua validade jur\u00eddica;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">VIII &#8211; declarar em sess\u00e3o p\u00fablica virtual o licitante vencedor;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">IX &#8211; encaminhar o processo instru\u00eddo, ap\u00f3s encerradas as fases de julgamento e de habilita\u00e7\u00e3o e exauridos os recursos administrativos, \u00e0 autoridade superior para adjudica\u00e7\u00e3o e para homologa\u00e7\u00e3o.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">X &#8211; elaborar, com a equipe de apoio, e emitir as atas das sess\u00f5es do preg\u00e3o;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">XI &#8211; a pr\u00e1tica dos demais atos pertinentes ao procedimento.<\/span><\/em><span style=\"font-weight: 400;\"><br \/><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51490ad elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"51490ad\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93d5ffb elementor-widget elementor-widget-heading\" data-id=\"93d5ffb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Equipe de Apoio<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f86261 elementor-widget elementor-widget-text-editor\" data-id=\"8f86261\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li><span style=\"font-weight: 400;\"> Colabora com o Pregoeiro\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> N\u00e3o possui poder de julgamento ou delibera\u00e7\u00e3o nos preg\u00f5es<\/span><\/li><\/ul><p><em><span style=\"font-weight: 400;\">Art. 39 A Equipe de Apoio ter\u00e1, no m\u00ednimo, 2 (dois) integrantes que ser\u00e3o designados pela autoridade competente do \u00f3rg\u00e3o ou da entidade, ou a quem as normas de organiza\u00e7\u00e3o administrativa indicarem, entre agentes p\u00fablicos que tenham preferencialmente conhecimentos sobre aspectos t\u00e9cnicos de licita\u00e7\u00f5es e contratos.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. Os servidores designados para compor a Equipe de Apoio que n\u00e3o tenham conhecimentos t\u00e9cnicos de licita\u00e7\u00f5es e contratos poder\u00e3o solicitar \u00e0 Autoridade Competente que providencie sua capacita\u00e7\u00e3o em tempo h\u00e1bil.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Art. 40 A crit\u00e9rio da autoridade competente, os membros da equipe de apoio poder\u00e3o ser designados para uma licita\u00e7\u00e3o espec\u00edfica, para um per\u00edodo determinado, admitidas recondu\u00e7\u00f5es, ou por per\u00edodo indeterminado, permitida a revoga\u00e7\u00e3o da designa\u00e7\u00e3o a qualquer tempo.<\/span><\/em><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><strong>Atribui\u00e7\u00f5es<\/strong><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><em><span style=\"font-weight: 400;\">Art. 41 Cabe \u00e0 equipe de apoio auxiliar o agente de contrata\u00e7\u00e3o ou a comiss\u00e3o de contrata\u00e7\u00e3o nas etapas do processo licitat\u00f3rio.<\/span><\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2b4f4f elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"d2b4f4f\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e6cd320 elementor-widget elementor-widget-heading\" data-id=\"e6cd320\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Autoridade Superior<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e4360ca elementor-widget elementor-widget-text-editor\" data-id=\"e4360ca\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adjudicar e homologar o objeto da licita\u00e7\u00e3o<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Decis\u00e3o final\u00a0 sobre recurso<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Revogar o procedimento licitat\u00f3rio<\/span><\/li><\/ul><p>\u00a0<\/p><p><em><span aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0Designa o Agente de Contrata\u00e7\u00e3o e seu respectivo substituto, Equipe de apoio, membros da Comiss\u00e3o de Contrata\u00e7\u00e3o e presidente da comiss\u00e3o, gestores e fiscais de contrato.<\/span><\/li><\/ul><p>\u00a0<\/p><p><em><span style=\"font-weight: 400;\">X \u2013 Autoridade competente: agente p\u00fablico com poder
