DE JANEIRO<\/strong>, no uso de suas atribui\u00e7\u00f5es constitucionais e legais, de acordo com o contido nos arts. 15, 40, 43, 44, 48 e 115 da Lei Federal n\u00ba 8.666, de 21 de junho de 1993, nos arts. 3\u00ba e 9\u00ba da Lei Federal n\u00ba 10.520, de 17 de julho de 2002, nos arts. 4\u00ba, 5\u00ba, 10, 13 e 14 do Decreto Estadual n\u00ba 41.135, de 21 de janeiro de 2008, nos arts. 1\u00ba, 2\u00ba, 8\u00ba, 24, 25 e 32 do Decreto Estadual n\u00ba 42.301, de 12 de fevereiro de 2010, tendo em vista o que consta do Processo n\u00ba E-01\/036\/719\/2013,<\/p><p><strong>CONSIDERANDO<\/strong>:<\/p><p>&#8211; a import\u00e2ncia da pesquisa de pre\u00e7os como referencial nos processos de compras p\u00fablicas; e<\/p><p>&#8211; a necessidade de constante aprimoramento dos suportes informatizados no apoio \u00e0s compras p\u00fablicas.<\/p><p><strong>DECRETA<\/strong>:<\/p><p><strong>Art. 1\u00ba<\/strong> &#8211; O uso do pre\u00e7o de refer\u00eancia disponibilizado por meio de consulta ao m\u00f3dulo \u201cbanco de pre\u00e7os\u201d do Sistema Integrado de Gest\u00e3o de Aquisi\u00e7\u00f5es (SIGA) pelos \u00f3rg\u00e3os e entidades usu\u00e1rios do sistema dever\u00e1 obedecer \u00e0s disposi\u00e7\u00f5es deste Decreto.<\/p><p><strong>Art. 2\u00ba<\/strong> &#8211; O SIGA dever\u00e1 disponibilizar para cada consulta de pre\u00e7o de refer\u00eancia, no m\u00ednimo, as seguintes informa\u00e7\u00f5es do item de material consultado:<\/p><p>I &#8211; item de material: descri\u00e7\u00e3o do produto a ser adquirido pela Administra\u00e7\u00e3o, constante do Cat\u00e1logo de Materiais e Servi\u00e7os.<\/p><p>II &#8211; c\u00f3digo do item de material: c\u00f3digo individual que identifica o item no Cat\u00e1logo de Itens de Materiais e Servi\u00e7os.<\/p><p>III &#8211; pre\u00e7o de refer\u00eancia: valor s\u00edntese, representativo do conjunto de pre\u00e7os praticados pelos diversos \u00f3rg\u00e3os e entidades do Estado, ao longo do tempo, armazenados no SIGA para um item de material associado a uma unidade de aquisi\u00e7\u00e3o e a uma modalidade de compra, calculado, a partir dos pre\u00e7os praticados, atualizados a valores presentes, por meio de f\u00f3rmula estat\u00edstica pr\u00f3pria;<\/p><p>IV &#8211; data do pre\u00e7o de refer\u00eancia: data da \u00faltima atualiza\u00e7\u00e3o do c\u00e1lculo do pre\u00e7o de refer\u00eancia;<\/p><p>VI &#8211; valor m\u00ednimo de compra: menor valor comprado por unidade de compra, atualizados a valores presentes, registrado no SIGA para o item de material pesquisado;<\/p><p>VII &#8211; valor m\u00e9dio de compra: valor m\u00e9dio representativo do conjunto de pre\u00e7os existentes no SIGA, por unidade de compra, atualizados a valores presentes, registrado no SIGA para o item de material pesquisado.<\/p><p><strong>Art. 3\u00ba<\/strong> &#8211; O pre\u00e7o de refer\u00eancia gerado pelo SIGA poder\u00e1 ser utilizado para fins de instru\u00e7\u00e3o processual nas requisi\u00e7\u00f5es e processos de compras dos \u00f3rg\u00e3os e entidades do Estado, podendo ser dispensada a coleta de pre\u00e7os junto a fornecedores para aferi\u00e7\u00e3o do pre\u00e7o de refer\u00eancia.<\/p><p>\u00a7 1\u00ba &#8211; Para a utiliza\u00e7\u00e3o do pre\u00e7o de refer\u00eancia dever\u00e3o ser observados os seguintes fatores intervenientes no pre\u00e7o, dentre outros:<\/p><p>I &#8211; o quantitativo total do item a ser adquirido;<\/p><p>II &#8211; a localiza\u00e7\u00e3o geogr\u00e1fica da unidade de compra;<\/p><p>III &#8211; a influ\u00eancia da sazonalidade no pre\u00e7o do item de material a ser adquirido;<\/p><p>IV &#8211; as condi\u00e7\u00f5es comerciais praticadas na aquisi\u00e7\u00e3o, incluindo prazos e locais de entrega, formas de pagamento e garantias exigidas.<\/p><p>\u00a7 2\u00ba &#8211; Se, ap\u00f3s a an\u00e1lise do pre\u00e7o de refer\u00eancia apresentado pelo SIGA, o respons\u00e1vel pelo processo de compras concluir pela inexist\u00eancia de conformidade deste com os pre\u00e7os usualmente praticados por sua unidade de compra, dever\u00e1 realizar pesquisa de pre\u00e7os no mercado para obter o pre\u00e7o de refer\u00eancia.<\/p><p>\u00a7 3\u00ba &#8211; Caso o SIGA n\u00e3o possa gerar o pre\u00e7o de refer\u00eancia por insufici\u00eancia de dados armazenados, dever\u00e1 ser realizada pesquisa de pre\u00e7os no mercado para obter o pre\u00e7o de refer\u00eancia para o respectivo processo de compras.<\/p><p><strong>Art. 4\u00ba<\/strong> &#8211; O Ordenador de Despesa, no momento da homologa\u00e7\u00e3o do processo de compras instru\u00eddo com pre\u00e7o de refer\u00eancia obtido por meio de pesquisa de pre\u00e7os no mercado, dever\u00e1 consultar as informa\u00e7\u00f5es dispon\u00edveis no SIGA para aferir a compatibilidade do pre\u00e7o a ser contratado com os pre\u00e7os praticados no \u00e2mbito dos \u00f3rg\u00e3os e entidades do Estado, observado o disposto no \u00a7 1\u00ba do Art. 3\u00ba deste Decreto.<\/p><p>Par\u00e1grafo \u00danico &#8211; Como complemento da an\u00e1lise, o Ordenador de Despesa dever\u00e1, ainda, consultar no SIGA os \u00faltimos pre\u00e7os ofertados para o item de material, observando marca, modelo e datas das compras.<\/p><p><strong>Art. 5\u00ba<\/strong> &#8211; Fica delegada \u00e0 SEPLAG a compet\u00eancia para regulamentar o presente Decreto.<\/p><p><strong>Art. 6\u00ba<\/strong> &#8211; Este Decreto
