O edital, ou documento similar, \u00e9 um documento p\u00fablico que cont\u00e9m todas as informa\u00e7\u00f5es e regras necess\u00e1rias de como a disputa ser\u00e1 processada a todos os interessados em participar. Nele, s\u00e3o detalhados o objeto da licita\u00e7\u00e3o, as condi\u00e7\u00f5es para participa\u00e7\u00e3o, os crit\u00e9rios de julgamento, as datas e hor\u00e1rios importantes, entre outras informa\u00e7\u00f5es relevantes. A publica\u00e7\u00e3o do edital \u00e9 o ato formal que d\u00e1 in\u00edcio \u00e0 fase externa da Projeto B\u00e1sico, Minuta de Contrato, Plantas Baixas, Fotos, Tabelas, Declara\u00e7\u00f5es dentre outros que ter\u00e3o por finalidade n\u00e3o especificar a disputa em si, mas o objeto e as condi\u00e7\u00f5es da contra\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">A publica\u00e7\u00e3o do Edital e seus anexos \u00e9 condi\u00e7\u00e3o fundamental para qualquer disputa pois permitir\u00e1 que todos os interessados e a sociedade possam tomar conhecimento do que se pretende contratar e como ser\u00e1 a escolha do futuro fornecedor, permitindo ao longo desse processo tamb\u00e9m os questionamentos por qualquer cidad\u00e3o, sejam como pedidos de esclarecimentos ou impugna\u00e7\u00f5es.<\/span><\/p><p><span style=\"font-weight: 400;\">Tamb\u00e9m nesta etapa deve atrav\u00e9s da divulga\u00e7\u00e3o do Edital e todo seu conte\u00fado no <strong><a href=\"https:\/\/www.gov.br\/pncp\/pt-br\">Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas (PNCP)<\/a><\/strong> e no Di\u00e1rio Oficial do ente respons\u00e1vel pelo certamente, ficando facultada a divulga\u00e7\u00e3o em jornal de grande circula\u00e7\u00e3o.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">No ERJ, as divulga\u00e7\u00f5es no PNCP e no Portal do Estado s\u00e3o realizadas de forma autom\u00e1tica pelo <strong><a href=\"https:\/\/www.compras.rj.gov.br\/\">Sistema Integrado de Gest\u00e3o de Aquisi\u00e7\u00f5es \u2013 href=\"https:\/\/www.jusbrasil.com.br\/doutrina\/secao\/artigos-164-a-168-capitulo-ii-das-impugnacoes-dos-pedidos-de-esclarecimento-e-dos-recursos-lei-de-licitacoes-e-contratos-administrativos-comentada-lei-14133-21\/1440739720#:~:text=Art.,data%20de%20abertura%20do%20certame.\"> art. 164 da NLLC<\/a><\/strong>, os licitantes ou qualquer cidad\u00e3o podem apresentar pedidos de esclarecimentos sobre qualquer ponto que considerem obscuro ou que necessite de maior detalhamento. Esses pedidos devem ser encaminhados ao Agente de Contrata\u00e7\u00e3o ou \u00e0 Comiss\u00e3o de Contrata\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">O objetivo dessa tarefa \u00e9 garantir que o Edital ou seus anexos (Termo de Refer\u00eancia, Minuta Contratual, etc) n\u00e3o contenham erros e que todos os licitantes tenham pleno conhecimento das condi\u00e7\u00f5es de disputa e de execu\u00e7\u00e3o, atrav\u00e9s da solicita\u00e7\u00e3o de esclarecimentos para melhor detalhamento das condi\u00e7\u00f5es de participa\u00e7\u00e3o do certame licitat\u00f3rio.<\/span><\/p><p><span style=\"font-weight: 400;\">Um detalhe interessante sobre os esclarecimentos, \u00e9 que eles n\u00e3o interrompem os prazos do certamente licitat\u00f3rio, em regra.\u00a0<\/span><\/p><p><a href=\"https:\/\/biblioteca.pge.rj.gov.br\/scripts\/bnweb\/bnmapi.exe?router=upload\/107298\"><span style=\"font-weight: 400;\"><strong>Decreto Estadual RJ n\u00ba 48.778\/23<\/strong>:<\/span><\/a><\/p><p><i><span style=\"font-weight: 400;\">Art. 17. Administra\u00e7\u00e3o P\u00fablica poder\u00e1 determinar a republica\u00e7\u00e3o do edital.<\/span><\/p><p><span style=\"font-weight: 400;\">Por determina\u00e7\u00e3o legal, <strong><a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/l14133.htm\">Lei Federal 14.133\/21, Art. 55, \u00a71<\/a><\/strong>, ocorrendo qualquer altera\u00e7\u00e3o ou modifica\u00e7\u00e3o substancial no edital que possa afetar a formula\u00e7\u00e3o das propostas dever\u00e1 ser realizada divulga\u00e7\u00e3o de igual forma \u00e0 adotada quando da publica\u00e7\u00e3o do texto original.<\/span><\/p><p><span style=\"font-weight: 400;\">Ressalte-se que a altera\u00e7\u00e3o ou modifica\u00e7\u00e3o substancial \u00e9 aquela que modifica as especifica\u00e7\u00f5es do objeto, as condi\u00e7\u00f5es de habilita\u00e7\u00e3o, as condi\u00e7\u00f5es das propostas, ou qualquer altera\u00e7\u00e3o que possa interferir no interesse das empresas em participar do certame.<\/span><\/p><p><span style=\"font-weight: 400;\">A republica\u00e7\u00e3o e a reabertura dos prazos s\u00e3o a garantia que a Administra\u00e7\u00e3o P\u00fablica proporciona para os interessados o conhecimento acerca das altera\u00e7\u00f5es promovidas no edital de licita\u00e7\u00e3o, disponibilizando tempo h\u00e1bil para a adequa\u00e7\u00e3o das propostas diante das altera\u00e7\u00f5es.<\/span><\/p><p><span style=\"font-weight: 400;\">O legislador procurou resguardar ambas as partes do procedimento licitat\u00f3rio garantindo o cumprimento dos Princ\u00edpios da Vincula\u00e7\u00e3o ao Instrumento Convocat\u00f3rio, do Julgamento Objetivo e da Publicidade e Transpar\u00eancia.<\/span><\/p><p><span style=\"font-weight: 400;\">Vejamos o disposto nas legisla\u00e7\u00f5es:<\/span><\/p><p><a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/l14133.htm\"><b>Lei n\u00ba 14.133\/21 \u2013 Art. 55<\/b><\/a><\/p><ul><li><i><span style=\"font-weight: 400;\"> 1<\/span><\/i><i><span style=\"font-weight: 400;\">o<\/span><\/i><i><span style=\"font-weight: 400;\"> Eventuais modifica\u00e7\u00f5es no edital implicar\u00e3o nova divulga\u00e7\u00e3o na mesma forma de sua divulga\u00e7\u00e3o inicial, al\u00e9m do cumprimento dos mesmos prazos dos atos e <\/span><\/i> <i><span style=\"font-weight: 400;\">procedimentos originais, exceto quando a altera\u00e7\u00e3o n\u00e3o comprometer a formula\u00e7\u00e3o das propostas.<\/span><\/i><\/li><\/ul><p><a href=\"https:\/\/biblioteca.pge.rj.gov.br\/scripts\/bnweb\/bnmapi.exe?router=upload\/107298\"><b>Decreto Estadual RJ n\u00ba 48.778\/23<\/b><\/a><\/p><p><i><span style=\"font-weight: 400;\">Art. 15. A fase externa da licita\u00e7\u00e3o ser\u00e1 iniciada com a convoca\u00e7\u00e3o dos interessados por meio da publica\u00e7\u00e3o do edital de licita\u00e7\u00e3o, mediante divulga\u00e7\u00e3o e manuten\u00e7\u00e3o do inteiro teor do ato convocat\u00f3rio e de seus anexos no Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas &#8211; PNCP e do seu extrato no Di\u00e1rio Oficial do Estado do Rio de Janeiro e em jornal di\u00e1rio de grande circula\u00e7\u00e3o.<\/span><\/i><\/p><ul><li><i><span style=\"font-weight: 400;\"> 3\u00ba Modifica\u00e7\u00f5es no edital ser\u00e3o divulgadas pelo mesmo instrumento de publica\u00e7\u00e3o utilizado para divulga\u00e7\u00e3o do texto original e o prazo inicialmente estabelecido ser\u00e1 reaberto, exceto se, inquestionavelmente, a altera\u00e7\u00e3o n\u00e3o afetar a formula\u00e7\u00e3o das propostas, resguardado o tratamento ison\u00f4mico aos licitantes.<\/span><\/i><\/li><\/ul><h4><b>A import\u00e2ncia da divulga\u00e7\u00e3o:<\/b><\/h4><p><span style=\"font-weight: 400;\">A ampla divulga\u00e7\u00e3o do edital \u00e9 fundamental para garantir a competitividade da licita\u00e7\u00e3o, atraindo o maior n\u00famero poss\u00edvel de interessados. Al\u00e9m disso, a divulga\u00e7\u00e3o transparente e completa das informa\u00e7\u00f5es evita d\u00favidas e possibilita que todos os participantes tenham as mesmas condi\u00e7\u00f5es de participa\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Por outro lado, \u00e9 poss\u00edvel que mesmo com todos os cuidados da <strong><a href=\"https:\/\/redelog.rj.gov.br\/redelog\/fase-preparatoria\/\">Fase Preparat\u00f3ria <\/a><\/strong><\/span><span style=\"font-weight: 400;\">mesmo assim ainda falhas nessa comunica\u00e7\u00e3o possam acontecer, e nessas horas que a possibilidade de pedidos de esclarecimentos e impugna\u00e7\u00f5es, completam a\u00a0 garantia da transpar\u00eancia, a igualdade e a competitividade do processo.<\/span><\/p><p><span style=\"font-weight: 400;\">Assim se voc\u00ea \u00e9 licitante tenha aten\u00e7\u00e3o nas datas de divulga\u00e7\u00e3o e nos canais obrigat\u00f3rios pois elas podem determinar a legalidade ou n\u00e3o do precedimento em quest\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Se voc\u00ea \u00e9 servidor tenha especial aten\u00e7\u00e3o na divulga\u00e7\u00e3o em seu di\u00e1rio oficial visto que os portais eletr\u00f4nicos, assim como o PNCP, ja realizam de forma autom\u00e1tica essas
