H\u00e1 possibilidade de um \u00f3rg\u00e3o ser participante e \u201ccarona\u201d na mesma ARP?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9622\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"region\" aria-labelledby=\"elementor-tab-title-9622\"><p><span style=\"font-weight: 400;\">Sim. Desde que a licita\u00e7\u00e3o ocorra por item e a demanda apresentada pelo referido \u00f3rg\u00e3o participante ao \u00f3rg\u00e3o gerenciador n\u00e3o contemple todos os itens da licita\u00e7\u00e3o. Ou seja, em que pese a ata registrar pre\u00e7os para diversos itens, o \u00f3rg\u00e3o participante integra apenas aqueles para os quais indicou interesse em participar do registro de pre\u00e7os, e encaminhou ao \u00f3rg\u00e3o gerenciador a sua estimativa de consumo e, posteriormente, manifestando concord\u00e2ncia com o objeto a ser licitado, antes da realiza\u00e7\u00e3o do procedimento licitat\u00f3rio. Considerando que a Administra\u00e7\u00e3o realizou licita\u00e7\u00e3o para registro de pre\u00e7o visando aquisi\u00e7\u00e3o futura, a qual foi procedida de planejamento pr\u00e9vio, com levantamento das necessidades t\u00e9cnicas e quantitativas, a \u00fanica hip\u00f3tese para se aderir \u00e0 outra ARP cujo objeto seja id\u00eantico ao registrado em ata pr\u00f3pria seria a vantagem econ\u00f4mica, ou seja, o pre\u00e7o registrado em ata pr\u00f3pria deve ser superior ao contida em outra ata.<\/span><\/p><p><span style=\"font-weight: 400;\">No entanto, acontecendo essa hip\u00f3tese, cabe, primeiramente, ao \u00f3rg\u00e3o gerenciador da ata, seguir ao descrito no art. 27 do Decreto n\u00ba 48.843\/2023 e convocar o fornecedor visando \u00e0 negocia\u00e7\u00e3o para redu\u00e7\u00e3o de pre\u00e7os e sua adequa\u00e7\u00e3o ao praticado pelo mercado, a qual, sendo frustrada, dever\u00e1 liberar o fornecedor do compromisso assumido, e, somente vencida esta etapa, poder\u00e1 solicitar ades\u00e3o a outra ARP, cujo pre\u00e7o encontra-se mais vantajoso \u00e0 Administra\u00e7\u00e3o P\u00fablica, e proceder ao cancelamento do registro de sua ARP.<\/span><\/p><p><span style=\"font-weight: 400;\">O art. 83 da Lei n\u00ba 14.133\/2021, ratifica esse posicionamento, haja vista que o detentor do registro tem o direito de prefer\u00eancia em ser contratado pela Administra\u00e7\u00e3o P\u00fablica no fornecimento do bem registrado, em igualdade de condi\u00e7\u00f5es.<\/span><\/p><p><b><i>Art. 83<\/i><\/b><i><span style=\"font-weight: 400;\">. A exist\u00eancia de pre\u00e7os registrados implicar\u00e1 compromisso de fornecimento nas condi\u00e7\u00f5es estabelecidas, mas n\u00e3o obrigar\u00e1 a Administra\u00e7\u00e3o a contratar, facultada a realiza\u00e7\u00e3o de licita\u00e7\u00e3o espec\u00edfica para a aquisi\u00e7\u00e3o pretendida, desde que devidamente motivada.<\/span><\/i><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-9624\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-9624\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">4. \u00c9 poss\u00edvel a formaliza\u00e7\u00e3o da ARP e a celebra\u00e7\u00e3o de contrato em um mesmo instrumento?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9624\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-9624\"><p><span style=\"font-weight: 400;\">N\u00e3o, pois se tratam de dois documentos distintos. Possuem naturezas e finalidades distintas.<\/span><\/p><p><span style=\"font-weight: 400;\">O contrato fixa condi\u00e7\u00f5es, direitos e obriga\u00e7\u00f5es para ambas as partes. \u00c9 uma rela\u00e7\u00e3o de bilateralidade e comutatividade t\u00edpica do instituto. Considera-se contrato todo e qualquer ajuste entre \u00f3rg\u00e3os ou entidades da Administra\u00e7\u00e3o P\u00fablica e particulares, em que haja um acordo de vontades para a forma\u00e7\u00e3o de v\u00ednculo e a estipula\u00e7\u00e3o de obriga\u00e7\u00f5es rec\u00edprocas, seja qual for \u00e0 denomina\u00e7\u00e3o utilizada.<\/span><\/p><p><span style=\"font-weight: 400;\">A ARP \u00e9 um documento que, por sua pr\u00f3pria defini\u00e7\u00e3o no inciso III, art. 2\u00ba, do <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.843\/2023<\/strong><\/a>, deve ser formalizada previamente ao contrato, pois apresenta caracter\u00edstica de compromisso para futura contrata\u00e7\u00e3o, ou seja, caso venha a ser concretizado o contrato, h\u00e1 que se obedecer \u00e0s condi\u00e7\u00f5es previstas na ata. Assim, ARP apresenta \u201cnatureza pr\u00e9-contratual\u201d, pois a Administra\u00e7\u00e3o P\u00fablica n\u00e3o est\u00e1 obrigada a contratar o objeto registrado, parcial ou totalmente.<\/span><\/p><p><span style=\"font-weight: 400;\">Al\u00e9m de que a ARP imp\u00f5e compromissos, basicamente, ao fornecedor e n\u00e3o \u00e0 Administra\u00e7\u00e3o P\u00fablica, sobretudo em rela\u00e7\u00e3o aos pre\u00e7os e as condi\u00e7\u00f5es de entrega. Assim, conclui-se que a ARP apresenta natureza diversa do contrato e por isso deve ser celebrada em documento distinto ao do contrato.<\/span><\/p><p><span style=\"font-weight: 400;\">Nas licita\u00e7\u00f5es e nas contrata\u00e7\u00f5es diretas (por inexigibilidade ou por dispensa de licita\u00e7\u00e3o) para registro de pre\u00e7os, os proponentes vencedores s\u00e3o chamados para assinar a ARP, e n\u00e3o para assinar o contrato de fornecimento ou de presta\u00e7\u00e3o de servi\u00e7os, o que ocorrer\u00e1 em uma etapa subsequente. Assim, a ARP n\u00e3o substitui o contrato.<\/span><\/p><p><span style=\"font-weight: 400;\">Os arts. 21 a 23 <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.843\/2023<\/strong><\/a> remetem \u00e0 assinatura da ARP e do instrumento contratual.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Art. 21. Homologado o resultado do processo licitat\u00f3rio ou autorizada a contrata\u00e7\u00e3o direta, o proponente melhor classificado ou o fornecedor, no caso de contrata\u00e7\u00e3o direta, observado o disposto no art. 19 deste Decreto, dever\u00e1 ser convocado para assinar a ARP, no prazo de 5 (cinco) dias \u00fateis, ou outro previsto no edital da licita\u00e7\u00e3o ou no aviso ou instrumento de contrata\u00e7\u00e3o direta, sob pena de decair o direito, sem preju\u00edzo das san\u00e7\u00f5es previstas na Lei n\u00ba <\/span><\/i><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm?origin=instituicao\"><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">, de 2021, e neste Decreto.<\/span><\/i><\/p><ul><li><i><span style=\"font-weight: 400;\"> 1\u00ba O prazo para assinatura da ata poder\u00e1 ser prorrogado uma vez, por igual per\u00edodo, mediante solicita\u00e7\u00e3o justificada da parte interessada e desde que aceito pela Administra\u00e7\u00e3o.<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\"> 2\u00ba \u00c9 facultado \u00e0 Administra\u00e7\u00e3o, quando o convocado n\u00e3o assinar a ARP no prazo e condi\u00e7\u00f5es estabelecidas, convocar os proponentes do cadastro de reserva, na ordem de classifica\u00e7\u00e3o, para faz\u00ea-lo em igual prazo e nas mesmas condi\u00e7\u00f5es propostas pelo primeiro classificado.<\/span><\/i><\/li><\/ul><p><i><span style=\"font-weight: 400;\">Art. 22. O registro de pre\u00e7os e as atas dele decorrentes dever\u00e3o ser divulgados no Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas &#8211; PNCP e no Portal de Compras do Estado do Rio de Janeiro.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Art. 23. A contrata\u00e7\u00e3o com os fornecedores registrados na ata ser\u00e1 formalizada pelo \u00f3rg\u00e3o ou entidade interessado por interm\u00e9dio de instrumento contratual, emiss\u00e3o de nota de empenho de despesa, autoriza\u00e7\u00e3o de compra ou outro instrumento h\u00e1bil, conforme o art. 95 da Lei n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2021.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. Em uma licita\u00e7\u00e3o para registro de pre\u00e7os, o prazo de vig\u00eancia do contrato deve ater-se ao estabelecido para a validade da ARP?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9625\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"5\" role=\"region\" aria-labelledby=\"elementor-tab-title-9625\"><p><span style=\"font-weight: 400;\">N\u00e3o, pois s\u00e3o instrumentos que apresentam caracter\u00edsticas diferentes. Na ARP, o prazo de validade tem como objetivo permitir aos \u00f3rg\u00e3os participantes e gerenciador, bem como aos que n\u00e3o participaram da licita\u00e7\u00e3o para registro de pre\u00e7o, os aderentes, a contrata\u00e7\u00e3o de fornecedores ou de prestadores de servi\u00e7o registrados. O contrato celebrado em decorr\u00eancia da utiliza\u00e7\u00e3o da ARP tem prazo de vig\u00eancia pr\u00f3prio, o qual deve ser previsto nos instrumentos convocat\u00f3rios, observado o disposto no art. 95 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2021<\/strong><\/a>.<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-9626\" class=\"elementor-tab-title\" data-tab=\"6\" role=\"button\" aria-controls=\"elementor-tab-content-9626\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">6. A celebra\u00e7\u00e3o de contrato decorrente da realiza\u00e7\u00e3o de licita\u00e7\u00e3o para SRP deve ocorrer at\u00e9 que data?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9626\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"6\" role=\"region\" aria-labelledby=\"elementor-tab-title-9626\"><p style=\"text-align: justify;\">Todos os atos praticados pelos \u00f3rg\u00e3os gerenciador, participante e carona devem ocorrer dentro da data estabelecida como vig\u00eancia para a referida ata. De acordo com o estabelecido no \u00a7 4\u00ba, art. 16, do Decreto n\u00ba 46.751\/2019, o contrato decorrente do Sistema de Registro de Pre\u00e7os dever\u00e1 ser assinado no prazo de validade da ata de registro de pre\u00e7os.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-9627\" class=\"elementor-tab-title\" data-tab=\"7\" role=\"button\" aria-controls=\"elementor-tab-content-9627\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">7. Os contratos decorrentes do SRP poder\u00e3o ser alterados?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9627\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"7\" role=\"region\" aria-labelledby=\"elementor-tab-title-9627\"><p style=\"text-align: justify;\">Sim. A previs\u00e3o est\u00e1 no \u00a7 3\u00ba, art. 16, do Decreto n\u00ba 46.751\/2019, em que estabelece que os contratos decorrentes do Sistema de Registro de Pre\u00e7os poder\u00e3o ser alterados, desde que justificados, observado o que disp\u00f5e o art. 65 da Lei n\u00ba 8.666\/1993.<\/p><p style=\"text-align: justify;\">Cabe ressaltar que deve ser justificado o acr\u00e9scimo da demanda administrativa. O percentual a ser utilizado de acr\u00e9scimo deve recair sobre o contrato desde que esteja vigente, independentemente de a ARP ter expirado o seu prazo de validade, haja vista que a vig\u00eancia dos contratos celebrados em decorr\u00eancia da utiliza\u00e7\u00e3o da ARP \u00e9 desvinculada desta.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-9628\" class=\"elementor-tab-title\" data-tab=\"8\" role=\"button\" aria-controls=\"elementor-tab-content-9628\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">8. A quem compete penalizar o particular diante de cometimento de infra\u00e7\u00f5es durante a vig\u00eancia da ARP?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9628\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"8\" role=\"region\" aria-labelledby=\"elementor-tab-title-9628\"><p style=\"text-align: justify;\">Ao inadimplemento contratual por parte do contratado, cabe ao contratante, n\u00e3o havendo distin\u00e7\u00e3o de ser \u00f3rg\u00e3o gerenciador, participante ou \u201ccarona\u201d de uma ARP, aplicar a san\u00e7\u00e3o administrativa cab\u00edvel, ap\u00f3s a instaura\u00e7\u00e3o de processo administrativo pr\u00f3prio.<\/p><p style=\"text-align: justify;\">Entretanto, deve ser concedida ao contratado a oportunidade para o exerc\u00edcio ao contradit\u00f3rio e \u00e0 ampla defesa pr\u00e9vios \u00e0 aplica\u00e7\u00e3o da penalidade. No entanto, faz-se necess\u00e1rio que a aplica\u00e7\u00e3o da penalidade se d\u00ea em coordena\u00e7\u00e3o com o \u00f3rg\u00e3o gerenciador, de modo que este seja informado para ado\u00e7\u00e3o de procedimentos necess\u00e1rios em rela\u00e7\u00e3o \u00e0s consequ\u00eancias dessa penalidade em face da ARP.<\/p><p style=\"text-align: justify;\">Por outro lado, se a infra\u00e7\u00e3o estiver relacionada com o descumprimento do pactuado na ata de registro de pre\u00e7os, a compet\u00eancia para aplica\u00e7\u00e3o de penalidade \u00e9 do \u00f3rg\u00e3o gerenciador e do \u00f3rg\u00e3o participante, devendo esse informar as ocorr\u00eancias ao \u00f3rg\u00e3o gerenciador.<\/p><p style=\"text-align: justify;\">Cabe ressaltar que toda e qualquer penalidade aplicada \u00e0s empresas deve ser registrada no SIGA, conforme estabelece o art. 12 do Decreto 46.910\/2020. Al\u00e9m desse registro, os \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o P\u00fablica de todos os entes da federa\u00e7\u00e3o podem efetuar registro no <strong>Cadastro Nacional de Empresas Inid\u00f4neas e Suspensas \u2013 CEIS<\/strong> quando a aplica\u00e7\u00e3o da penalidade reportar-se \u00e0 suspens\u00e3o ou impedimento de licitar e contratar e \u00e0 declara\u00e7\u00e3o de inidoneidade.<\/p><p style=\"text-align: justify;\">O CEIS \u00e9 um banco de informa\u00e7\u00f5es mantido pela Controladoria-Geral da Uni\u00e3o que tem como objetivo consolidar a rela\u00e7\u00e3o das empresas e pessoas f\u00edsicas que sofreram san\u00e7\u00f5es pelos \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o P\u00fablica das diversas esferas federativas.<\/p><p style=\"text-align: justify;\">O CEIS agrega as empresas consideradas inid\u00f4neas, que s\u00e3o aquelas que foram condenadas pelo Poder Judici\u00e1rio por ato de improbidade administrativa, cujos dados s\u00e3o fornecidos pelo Conselho Nacional de Justi\u00e7a a partir do Cadastro Nacional de Condenados por Improbidade Administrativa, bem como a lista de inid\u00f4neos do Tribunal de Contas da Uni\u00e3o.<\/p><p style=\"text-align: justify;\">O CEIS pretende reunir em \u00fanico local uma rela\u00e7\u00e3o de apenados proveniente das diversas fontes dispon\u00edveis, o que possibilita a visualiza\u00e7\u00e3o das empresas e pessoas f\u00edsicas suspensas, impedidas ou inid\u00f4neas. Assim, o CEIS objetiva servir de fonte de refer\u00eancia para os \u00f3rg\u00e3os da Administra\u00e7\u00e3o P\u00fablica no tocante aos seus processos de compras. Os editais de licita\u00e7\u00e3o em que for conferido o tratamento diferenciado previsto no inciso I do art. 48 da Lei Complementar n\u00ba 123\/2006 e no art. 6\u00ba do Decreto Estadual n\u00ba 42.063\/2009 podem restringir o universo de licitantes \u00e0s microempresas e empresas de pequeno porte sediadas no estado em que se proceder\u00e1 ao certame?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-96210\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"10\" role=\"region\" aria-labelledby=\"elementor-tab-title-96210\"><p style=\"text-align: justify;\">N\u00e3o. A ocorr\u00eancia de tal fato violaria o Princ\u00edpio da Economicidade, o que poderia acarretar ao \u00f3rg\u00e3o ou entidade realizador do certame o n\u00e3o alcance da proposta mais vantajosa \u00e0 Administra\u00e7\u00e3o P\u00fablica, conforme preconizado no art. 3\u00ba da Lei n\u00ba 8.666\/1993.<\/p><p style=\"text-align: justify;\">Cabe ressaltar que n\u00e3o h\u00e1, na Lei Complementar n\u00ba 123\/2006 ou no Decreto n\u00ba 42.063\/2009, normatiza\u00e7\u00e3o no sentido de restringir a licita\u00e7\u00e3o destinada exclusivamente a microempresas e empresas de pequeno porte na regi\u00e3o do \u00f3rg\u00e3o ou entidade licitante.<\/p><p style=\"text-align: justify;\">Assim, a inser\u00e7\u00e3o de cl\u00e1usulas edital\u00edcias prevendo tal restri\u00e7\u00e3o violaria, tamb\u00e9m, o Princ\u00edpio da Legalidade.<\/p><p style=\"text-align: justify;\">Tal entendimento encontra-se consubstanciado no Ac\u00f3rd\u00e3o TCU n\u00b0 2.957\/2001 &#8211; Plen\u00e1rio:<\/p><p style=\"text-align: justify;\"><em>(&#8230;) nos editais de licita\u00e7\u00e3o em que for conferido o tratamento diferenciado previsto no inciso I do artigo 48 da Lei Complementar n\u00ba 123, de 14 de dezembro de 2006, e no art. 6\u00ba do Decreto n\u00ba 6.204, de 5 de setembro de 2007, n\u00e3o se deve restringir o universo de participantes \u00e0s empresas sediadas no estado em que estiver localizado o \u00f3rg\u00e3o ou a entidade licitante.<\/em><\/p><p style=\"text-align: justify;\">Al\u00e9m da viola\u00e7\u00e3o a esses dois princ\u00edpios, ocorreria tamb\u00e9m a viola\u00e7\u00e3o do Princ\u00edpio da Competitividade, haja vista que o universo das empresas que poderiam participar da licita\u00e7\u00e3o estaria restrito ao \u00e2mbito local da realiza\u00e7\u00e3o do certame.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-96211\" class=\"elementor-tab-title\" data-tab=\"11\" role=\"button\" aria-controls=\"elementor-tab-content-96211\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><svg class=\"e-font-icon-svg e-fas-caret-right\" viewBox=\"0 0 192 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M0 384.662V127.338c0-17.818 21.543-26.741 34.142-14.142l128.662 128.662c7.81 7.81 7.81 20.474 0 28.284L34.142 398.804C21.543 411.404 0 402.48 0 384.662z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><svg class=\"elementor-toggle-icon-opened e-font-icon-svg e-fas-caret-up\" viewBox=\"0 0 320 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M288.662 352H31.338c-17.818 0-26.741-21.543-14.142-34.142l128.662-128.662c7.81-7.81 20.474-7.81 28.284 0l128.662 128.662c12.6 12.599 3.676 34.142-14.142 34.142z\"><\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">11. Em licita\u00e7\u00e3o para registro de pre\u00e7os, por item, destinada exclusivamente \u00e0 participa\u00e7\u00e3o de microempresas e empresas de pequeno porte, conforme previsto no inciso I do art. 48 da Lei Complementar n\u00ba 123\/2006 e no art. 6\u00ba do Decreto Estadual n\u00ba 42.063\/2009, o valor a ser observado como limite de R$ 80.000,00 seria o de cada item ou ao valor global da contrata\u00e7\u00e3o?<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-96211\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"11\" role=\"region\" aria-labelledby=\"elementor-tab-title-96211\"><p style=\"text-align: justify;\">Deve ser observado o valor de cada item da licita\u00e7\u00e3o, haja vista que cada item da licita\u00e7\u00e3o remete a licita\u00e7\u00f5es distintas e independentes entre si, podendo cada licitante cotar todos, alguns ou somente um dos itens definidos no instrumento convocat\u00f3rio.<\/p><p style=\"text-align: justify;\">Ressalta-se que o Ac\u00f3rd\u00e3o TCU n\u00b0 3.771\/2011-1\u00aa C\u00e2mara, assentou o seguinte entendimento:<\/p><p style=\"text-align: justify;\"><em>(&#8230;) apesar de o valor global exceder o limite de R$ 80.000,00, previsto no art. 48, inciso I, da LC n\u00ba 123\/2006 e no art. 6\u00ba do Decreto n\u00ba 6.204\/2007 para a realiza\u00e7\u00e3o de processo licitat\u00f3rio destinado exclusivamente \u00e0 participa\u00e7\u00e3o de microempresas e empresas de pequeno porte, o certame estava dividido em 52 itens de concorr\u00eancia aut\u00f4nomos entre si, sendo, assim, cada item disputado de maneira independente dos demais.<\/em><\/p><p style=\"text-align: justify;\">Cabe ressaltar que n\u00e3o h\u00e1 obrigatoriedade de todos os itens da licita\u00e7\u00e3o serem destinados a atender ao comando legal previsto nos referidos normativos, podendo, por exemplo, em uma licita\u00e7\u00e3o para 10 (dez) itens, apenas 01 (um) ser reservado exclusivamente \u00e0 participa\u00e7\u00e3o de microempresas e empresas de pequeno porte.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-75cfec1 elementor-widget elementor-widget-text-editor\" data-id=\"75cfec1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><em><span style=\"font-weight: 400;\">[1]<\/span><span style=\"font-weight: 400;\"> FERNANDES, Jorge Ulisses Jacoby.
