constantes dos arts. 42 a 49 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Leis\/LCP\/Lcp123.htm\"><strong>LC n\u00ba 123\/2006<\/strong><\/a> dever\u00e3o ser aplicadas \u00e0s licita\u00e7\u00f5es e contratos.<\/span><\/p><p><span style=\"font-weight: 400;\">A <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Leis\/LCP\/Lcp123.htm\"><strong>LC n\u00ba 123\/2006<\/strong><\/a> estabelece normas gerais quanto ao tratamento diferenciado e favorecido para as microempresas e empresas de pequeno porte \u2013 ME\/EPP.<\/span><\/p><p><span style=\"font-weight: 400;\">As compras p\u00fablicas promovem fomento ao mercado, guardando destaque as pol\u00edticas de aquisi\u00e7\u00f5es e contrata\u00e7\u00f5es em grande escala e de incentivo \u00e0s ME\/EPP.<\/span><\/p><ul><li><span style=\"font-weight: 400;\">As licita\u00e7\u00f5es ser\u00e3o exclusivas para a participa\u00e7\u00e3o de ME\/EPP nos itens de contrata\u00e7\u00e3o cujo valor seja de at\u00e9 R$ 80.000,00.<\/span><\/li><li><span style=\"font-weight: 400;\">As licita\u00e7\u00f5es destinadas \u00e0 contrata\u00e7\u00e3o de obras e servi\u00e7os poder\u00e3o permitir a subcontrata\u00e7\u00e3o de ME\/EPP.<\/span><\/li><li><span style=\"font-weight: 400;\">As licita\u00e7\u00f5es para aquisi\u00e7\u00e3o de bens de natureza divis\u00edvel poder\u00e3o estabelecer cota de at\u00e9 25% do objeto para a contrata\u00e7\u00e3o de ME\/EPP.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Para garantir a aplica\u00e7\u00e3o do benef\u00edcio da cota reservada no SRP:<\/span><\/p><ol><li><span style=\"font-weight: 400;\">Estabelecer uma cota reservada de at\u00e9 25% da demanda para cada item de natureza divis\u00edvel e com valor estimado superior a R$ 80.000,00.<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">As cotas de ampla concorr\u00eancia e reservada geram Atas de Registro de Pre\u00e7os distintas para o mesmo item, sendo concedida a prioridade na aquisi\u00e7\u00e3o do item da cota reservada.<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Os itens e quantitativos contemplados na ampla concorr\u00eancia somente ser\u00e3o consumidos uma vez esgotados os
