400;\">A ades\u00e3o ou \u201ccarona\u201d \u00e0 ARP representa um dos temas mais pol\u00eamicos em licita\u00e7\u00f5es e contratos administrativos.<\/span><\/p><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Apesar das in\u00fameras vantagens decorrentes da boa utiliza\u00e7\u00e3o do instituto, o tema \u00e9 comumente criticado por parte da doutrina e por alguns \u00f3rg\u00e3os de controle que reprovam seu uso sem o devido planejamento.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Se por um lado, a figura do \u201ccarona\u201d traz agilidade e redu\u00e7\u00e3o da quantidade de procedimentos licitat\u00f3rios, por outro lado, a sua utiliza\u00e7\u00e3o de forma indiscriminada afronta os princ\u00edpios da obrigatoriedade da licita\u00e7\u00e3o, da isonomia, da legalidade, da vincula\u00e7\u00e3o ao instrumento convocat\u00f3rio e da competitividade.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A limita\u00e7\u00e3o na ades\u00e3o \u00e9 requisito necess\u00e1rio como forma de evitar que a ARP se torne uma fonte inesgot\u00e1vel de contrata\u00e7\u00f5es para o licitante vencedor, sendo incompat\u00edvel com os princ\u00edpios da competitividade e da isonomia.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A Administra\u00e7\u00e3o perde em economia de escala comprometendo a vantajosidade da contrata\u00e7\u00e3o, uma vez que licita montante inferior ao que efetivamente \u00e9 contratado, perdendo os descontos que poderiam ser ofertados pelos licitantes em raz\u00e3o do quantitativo superior.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A ARP poder\u00e1 ser aderida pelos \u00f3rg\u00e3os e entidades que n\u00e3o tenham participado do procedimento inicial para registro de pre\u00e7os, desde que observados as seguintes condi\u00e7\u00f5es:<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ol><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Apresenta\u00e7\u00e3o de justificativa da vantagem da ades\u00e3o, inclusive em situa\u00e7\u00f5es de prov\u00e1vel desabastecimento ou descontinuidade de servi\u00e7o p\u00fablico;<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Apresenta\u00e7\u00e3o de estudo que demonstre efici\u00eancia, viabilidade e economicidade para a Administra\u00e7\u00e3o contratante;<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Demonstra\u00e7\u00e3o de que os valores registrados est\u00e3o compat\u00edveis com os valores praticados pelo mercado, na forma do art. 23 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba <\/strong><\/a><\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>14.133<\/strong><\/a><span style=\"font-weight: 400;\"><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>\/2021<\/strong><\/a>; e<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Pr\u00e9via consulta e aceita\u00e7\u00e3o do \u00f3rg\u00e3o gerenciador e do fornecedor.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O fornecedor benefici\u00e1rio da ARP poder\u00e1 aceitar ou n\u00e3o do fornecimento decorrente de ades\u00e3o, desde que n\u00e3o prejudique as obriga\u00e7\u00f5es presentes e futuras assumidas com o \u00f3rg\u00e3o gerenciador e com os \u00f3rg\u00e3os participantes.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O limite por \u00f3rg\u00e3o aderente \u00e9 50% do quantitativo do item com pre\u00e7o registrado na ARP.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O limite global de ades\u00f5es \u00e9 o dobro do quantitativo de cada item registrado na ARP.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Ap\u00f3s a autoriza\u00e7\u00e3o do \u00f3rg\u00e3o gerenciador, o \u00f3rg\u00e3o aderente dever\u00e1 efetivar a contrata\u00e7\u00e3o em at\u00e9 90 dias, observando o prazo de vig\u00eancia da ata e devendo cumprir as mesmas obriga\u00e7\u00f5es dos \u00f3rg\u00e3os participantes e orienta\u00e7\u00f5es do \u00f3rg\u00e3o gerenciador.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O \u00f3rg\u00e3o aderente \u00e9 respons\u00e1vel pela cobran\u00e7a do cumprimento pelo fornecedor das obriga\u00e7\u00f5es contratualmente assumidas e pela aplica\u00e7\u00e3o, observada a ampla defesa e o contradit\u00f3rio, das penalidades decorrentes do descumprimento de cl\u00e1usulas contratuais, em rela\u00e7\u00e3o \u00e0s suas pr\u00f3prias contrata\u00e7\u00f5es.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Os \u00f3rg\u00e3os e entidades da administra\u00e7\u00e3o p\u00fablica estadual direta, aut\u00e1rquica e fundacional do Poder Executivo do ERJ podem aderir \u00e0 ARP gerenciada por \u00f3rg\u00e3os e entidades aut\u00e1rquicas ou fundacionais da Uni\u00e3o ou de outros entes federativos estaduais ou distritais.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u2022<\/span><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">As sociedades de economia mista e das empresas p\u00fablicas do Estado podem aderir \u00e0 ARP de \u00f3rg\u00e3os e entidades da administra\u00e7\u00e3o p\u00fablica estadual direta, aut\u00e1rquica e <\/span><\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53192a6 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"53192a6\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section
