itens registrados em ARP<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O remanejamento \u00e9 a transfer\u00eancia dos quantitativos entre os \u00f3rg\u00e3os participantes.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">As quantidades previstas para os itens com pre\u00e7os registrados poder\u00e3o ser remanejadas, pelo \u00f3rg\u00e3o gerenciador, entre os \u00f3rg\u00e3os participantes do SRP, mediante justificativa da necessidade.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O \u00f3rg\u00e3o gerenciador somente realizar\u00e1 o remanejamento ap\u00f3s a autoriza\u00e7\u00e3o do \u00f3rg\u00e3o participante que tiver redu\u00e7\u00e3o dos quantitativos.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><h3><b>Contrata\u00e7\u00e3o atrav\u00e9s da Ata de Registro de Pre\u00e7os<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A contrata\u00e7\u00e3o com os fornecedores registrados na ARP ser\u00e1 formalizada pelo \u00f3rg\u00e3o participante atrav\u00e9s de instrumento contratual, emiss\u00e3o de nota de empenho de despesa, autoriza\u00e7\u00e3o de compra ou outro instrumento h\u00e1bil, conforme o art. 95 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2021<\/strong><\/a>.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A exist\u00eancia de pre\u00e7os registrados n\u00e3o obriga o \u00f3rg\u00e3o participante a contratar.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O \u00f3rg\u00e3o participante que realize licita\u00e7\u00e3o ou contrata\u00e7\u00e3o direta espec\u00edfica de item com pre\u00e7o registrado dever\u00e1 ser motivada e justificar na instru\u00e7\u00e3o processual com a ratifica\u00e7\u00e3o da autoridade competente.<\/span><\/li><\/ul><h3><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3><h3><b>Revis\u00e3o e Altera\u00e7\u00e3o dos Pre\u00e7os Registrados<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Os pre\u00e7os registrados poder\u00e3o ser revistos e alterados no caso de redu\u00e7\u00e3o dos pre\u00e7os praticados no mercado ou de fato que eleve o custo dos servi\u00e7os ou bens registrados,.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Cabe ao \u00f3rg\u00e3o gerenciador promover as negocia\u00e7\u00f5es junto aos fornecedores visando a manuten\u00e7\u00e3o do equil\u00edbrio econ\u00f4mico-financeiro inicial do contrato e nas seguintes condi\u00e7\u00f5es:<\/span><\/li><\/ul><ol><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Em caso de for\u00e7a maior, caso fortuito ou fato do pr\u00edncipe ou em decorr\u00eancia de fatos imprevis\u00edveis ou previs\u00edveis de consequ\u00eancias incalcul\u00e1veis, que inviabilizem a execu\u00e7\u00e3o da ata tal como pactuado, nos termos da al\u00ednea &#8220;d&#8221; do inciso II do caput do art. 124, da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba <\/strong><\/a><\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>14.133<\/strong><\/a><span style=\"font-weight: 400;\"><strong>, <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\">de 2021<\/a><\/strong>; ou<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Resultante de previs\u00e3o no edital da licita\u00e7\u00e3o ou no aviso ou instrumento da contrata\u00e7\u00e3o direta de cl\u00e1usula de reajustamento ou repactua\u00e7\u00e3o sobre os pre\u00e7os registrados, nos termos da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba <\/strong><\/a><\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>14.133, de 2021.<\/strong><\/a><\/li><\/ol><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><h3><b>Negocia\u00e7\u00e3o dos Pre\u00e7os Registrados<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Quando o pre\u00e7o registrado se tornar superior ao pre\u00e7o praticado no mercado, o \u00f3rg\u00e3o gerenciador convocar\u00e1 os fornecedores para negociarem a redu\u00e7\u00e3o dos pre\u00e7os aos valores praticados pelo mercado.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Os fornecedores que n\u00e3o aceitarem reduzir seus pre\u00e7os aos valores praticados pelo mercado ser\u00e3o liberados do compromisso assumido, sem aplica\u00e7\u00e3o de penalidade.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Quando o pre\u00e7o de mercado se tornar superior aos pre\u00e7os registrados e o fornecedor n\u00e3o puder cumprir o compromisso, mediante justificativa fundamentada, o compromisso, o \u00f3rg\u00e3o gerenciador poder\u00e1:<\/span><\/li><\/ul><ol><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Liberar o fornecedor sem aplica\u00e7\u00e3o da penalidade se confirmada a veracidade dos motivos e comprovantes apresentados.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Convocar os demais fornecedores para assegurar igual oportunidade de negocia\u00e7\u00e3o.<\/span><\/li><li>N\u00e3o havendo \u00eaxito nas negocia\u00e7\u00f5es, o \u00f3rg\u00e3o gerenciador promover\u00e1 o cancelamento, parcial ou integral da ARP.<\/li><\/ol><p><b>\u00a0<\/b><\/p><h3><strong>Cancelamento do Registro do Fornecedor e dos Pre\u00e7os Registrados<\/strong><\/h3><ol><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O registro do fornecedor ser\u00e1 cancelado quando:<\/span><\/li><li><span style=\"font-weight: 400;\">Descumprir as condi\u00e7\u00f5es da ARP, assegurado o contradit\u00f3rio e a ampla defesa.<\/span><\/li><li><span style=\"font-weight: 400;\">N\u00e3o assinar o contrato ou n\u00e3o retirar a nota de empenho ou instrumento equivalente no prazo estabelecido pelo contratante, sem justificativa aceit\u00e1vel, assegurado o contradit\u00f3rio e a ampla defesa.<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">N\u00e3o aceitar reduzir o seu pre\u00e7o registrado, na hip\u00f3tese deste se tornar superior \u00e0queles praticados no mercado.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0<\/span><span style=\"font-weight: 400;\">Sofrer san\u00e7\u00e3o prevista nos incisos III ou IV do caput do art. 156 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2021<\/strong><\/a>, assegurado o contradit\u00f3rio e a ampla defesa.<\/span><\/li><li><span style=\"font-weight: 400;\">O cancelamento da ARP poder\u00e1 ocorrer, total ou parcialmente, desde que comprovado e justificado:<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Por raz\u00e3o de interesse p\u00fablico;<\/span><\/p><ol><li><span style=\"font-weight: 400;\">Pelo cancelamento de todos os pre\u00e7os registrados; ou<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">A pedido do fornecedor, decorrente de fato superveniente, de caso fortuito ou for\u00e7a maior, que prejudique o cumprimento da ARP.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8041550 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"8041550\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span
