de Registro de Pre\u00e7os (ARP) \u00e9 o documento <\/span><b>vinculativo<\/b><span style=\"font-weight: 400;\">, <\/span><b>obrigacional<\/b><span style=\"font-weight: 400;\">, com caracter\u00edstica de compromisso para futura contrata\u00e7\u00e3o, no qual s\u00e3o registrados o objeto, os pre\u00e7os, os fornecedores, os \u00f3rg\u00e3os participantes e as condi\u00e7\u00f5es a serem praticadas, conforme as disposi\u00e7\u00f5es contidas no edital da licita\u00e7\u00e3o, no aviso ou instrumento de contrata\u00e7\u00e3o direta e nas propostas apresentadas.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Ap\u00f3s a homologa\u00e7\u00e3o da licita\u00e7\u00e3o ou da contrata\u00e7\u00e3o direta, dever\u00e3o ser registrados na Ata de Registro de Pre\u00e7os &#8211; ARP:<\/span><\/p><ul><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Os quantitativos, os pre\u00e7os registrados e os respectivos fornecedores.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Os licitantes que aceitarem cotar os bens ou servi\u00e7os com pre\u00e7os iguais ao do licitante vencedor para constituir o cadastro de reserva.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Se houver mais de um licitante para o cadastro de reserva, dever\u00e1 ser observada a sequ\u00eancia da classifica\u00e7\u00e3o de acordo com a ordem da \u00faltima proposta apresentada durante a fase competitiva.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Os pre\u00e7os e os quantitativos do proponente mais bem classificado durante a fase competitiva ou de contrata\u00e7\u00e3o direta.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Os proponentes que aceitarem cotar os bens ou servi\u00e7os com pre\u00e7os iguais aos do proponente vencedor na sequ\u00eancia da classifica\u00e7\u00e3o da fase competitiva ou de contrata\u00e7\u00e3o direta.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O registro dos proponentes que aceitarem cotar pelos pre\u00e7os registrados t\u00eam por objetivo a <\/span><b>forma\u00e7\u00e3o de Cadastro de Reserva <\/b><span style=\"font-weight: 400;\">no caso de cancelamento ou impossibilidade de atendimento pelo primeiro colocado da ARP.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A habilita\u00e7\u00e3o dos proponentes que compor\u00e3o o Cadastro de Reserva somente ser\u00e1 efetuada quando houver necessidade de contrata\u00e7\u00e3o dos proponentes remanescentes, nas seguintes situa\u00e7\u00f5es:\u00a0<\/span><\/li><\/ul><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Quando o proponente vencedor n\u00e3o assinar a ARP, no prazo e nas condi\u00e7\u00f5es estabelecidas no Edital ou no aviso de contrata\u00e7\u00e3o direta; e\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Quando houver o cancelamento do registro do fornecedor compromitente da ARP ou cancelamento de pre\u00e7o(s) registrado(s).<\/span><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Poder\u00e1 o \u00f3rg\u00e3o ou entidade gerenciador, excepcionalmente, registrar outros pre\u00e7os, desde que os objetos sejam de qualidade ou desempenho superior; os pre\u00e7os sejam inferiores ao m\u00e1ximo admitido; e haja justificativa e comprova\u00e7\u00e3o da vantagem.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><h3><b>Prazo de Validade da ARP<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O prazo de vig\u00eancia da ARP ser\u00e1 de 1 (um) ano, contado a partir do 1\u00ba (primeiro) dia \u00fatil subsequente \u00e0 data de divulga\u00e7\u00e3o no PNCP, e poder\u00e1 ser prorrogado, por igual per\u00edodo, desde que haja previs\u00e3o expressa na ata e as condi\u00e7\u00f5es e os pre\u00e7os permane\u00e7am vantajosos.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O art. 20 do <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.843\/2023<\/strong><\/a> assim disp\u00f5e:<\/span><\/li><\/ul><p><i>1\u00ba \u00c9 <\/i><b><i>vedado efetuar acr\u00e9scimos nos quantitativos fixados na ARP<\/i><\/b><i>, inclusive o acr\u00e9scimo de que trata o art. 125 da Lei n\u00ba <\/i><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm?origin=instituicao\"><i>14.133<\/i><\/a><i>, de 2021.<\/i><\/p><p><i><span style=\"font-weight: 400;\"> \u00a7 2\u00ba A prorroga\u00e7\u00e3o da vig\u00eancia da ata observar\u00e1 o seguinte:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I &#8211; <\/span><\/i><b><i>somente o saldo remanescente ser\u00e1 mantido<\/i><\/b><i><span style=\"font-weight: 400;\">;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; dever\u00e1 ser indicado expressamente o prazo de prorroga\u00e7\u00e3o;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III &#8211; dever\u00e1 <\/span><\/i><b><i>ser confirmado se os pre\u00e7os registrados permanecem atualizados, por meio de pesquisa de pre\u00e7os<\/i><\/b><i><span style=\"font-weight: 400;\"> realizada na forma do Decreto n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">48.816<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2023; e<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IV &#8211; ser\u00e1 formalizada mediante <\/span><\/i><b><i>termo aditivo<\/i><\/b><i><span style=\"font-weight: 400;\">.<\/span><\/i><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><\/p><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A vig\u00eancia dos contratos decorrentes de SRP dever\u00e1 ser definida no edital da licita\u00e7\u00e3o ou no aviso ou instrumento de contrata\u00e7\u00e3o direta, observado o Cap\u00edtulo V do T\u00edtulo III da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba <\/strong><\/a><\/span><strong>14.133<\/strong><span style=\"font-weight: 400;\"><strong>\/2021<\/strong>.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Os contratos decorrentes do SRP poder\u00e3o ser alterados, conforme disposto no art. 124 65 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba<\/strong><\/a><\/span><strong> 14.133<\/strong><span style=\"font-weight: 400;\"><strong>\/2021<\/strong>.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O contrato decorrente do SRP <\/span><b>dever\u00e1 ser assinado no prazo de validade da ARP<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><h3><b>\u00a0<\/b><b>Da Assinatura da ARP<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Ap\u00f3s homologada a licita\u00e7\u00e3o ou autorizada a contrata\u00e7\u00e3o direta, os fornecedores classificados ser\u00e3o convocados para assinar a ARP, no prazo de 5 (cinco dias) \u00fateis ou previsto no edital de licita\u00e7\u00e3o ou aviso de contrata\u00e7\u00e3o direta.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Para assinar da ARP, basta o fornecedor se cadastrar como Usu\u00e1rio Externo do Servi\u00e7o Eletr\u00f4nico de Informa\u00e7\u00f5es \u2013 SEI-RJ.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O prazo para a assinatura da ARP poder\u00e1 ser prorrogado uma vez, por igual
