style=\"font-weight: 400;\">O Sistema de Registro de Pre\u00e7os &#8211; SRP consiste em um conjunto de procedimentos para realiza\u00e7\u00e3o, mediante <\/span><b>contrata\u00e7\u00e3o direta ou licita\u00e7\u00e3o nas modalidades preg\u00e3o ou concorr\u00eancia<\/b><span style=\"font-weight: 400;\">, de registro formal de pre\u00e7os relativos a presta\u00e7\u00e3o de servi\u00e7os, a obras e a aquisi\u00e7\u00e3o e loca\u00e7\u00e3o de bens para contrata\u00e7\u00f5es futuras, segundo o art. 6\u00ba da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/21<\/strong><\/a>.<\/span><\/p><p><a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><b>Decreto n\u00ba 48.843\/2023<\/b><\/a><span style=\"font-weight: 400;\">: O Decreto que regulamenta o SRP estabelece diretrizes quanto \u00e0 realiza\u00e7\u00e3o dos procedimentos:<\/span><\/p><p><i><span style=\"font-weight: 400;\">\u00a0Art. 13 &#8211; O SRP poder\u00e1 ser realizado:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I &#8211; por meio de processo licitat\u00f3rio, na modalidade concorr\u00eancia ou preg\u00e3o, do tipo menor pre\u00e7o ou maior desconto; ou<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; por meio de contrata\u00e7\u00e3o direta.<\/span><\/i><\/p><ul><li><i><span style=\"font-weight: 400;\"> 1\u00ba No caso de obras e servi\u00e7os especiais de engenharia dever\u00e1 ser adotada a modalidade concorr\u00eancia.<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\"> 2\u00ba A realiza\u00e7\u00e3o do procedimento para registro de pre\u00e7os na forma dos incisos I e II do caput deste artigo dever\u00e1 observar o previsto no Decreto n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">48.778<\/span><\/i><i><span style=\"font-weight: 400;\">, de 30 de outubro de 2023, em se tratando de licita\u00e7\u00e3o, ou no Decreto n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">48.820<\/span><\/i><i><span style=\"font-weight: 400;\">, de 27 de novembro de 2023, em se tratando de contrata\u00e7\u00e3o direta.<\/span><\/i><\/li><\/ul><h3><span style=\"font-weight: 400;\">\u00a0<\/span><b>Procedimentos do processo de contrata\u00e7\u00e3o direta para registro de pre\u00e7os<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O sistema de registro de pre\u00e7os poder\u00e1, <\/span><b>na forma de regulamento<\/b><span style=\"font-weight: 400;\">, ser utilizado nas <\/span><b>hip\u00f3teses de inexigibilidade e de dispensa de licita\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\"> para a aquisi\u00e7\u00e3o de bens ou para a contrata\u00e7\u00e3o de servi\u00e7os <\/span><b>por mais de um \u00f3rg\u00e3o ou entidade<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Dever\u00e3o ser observados os requisitos da instru\u00e7\u00e3o processual previstos no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.816\/2023<\/strong><\/a>.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Dever\u00e3o ser observados os pressupostos para enquadramento de inexigibilidade ou dispensa de licita\u00e7\u00e3o, conforme previsto nos arts. 74 e 75 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2023<\/strong><\/a>, respectivamente.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.843\/2023<\/strong><\/a> complementa o uso do SRP para contrata\u00e7\u00e3o direta com os seguintes dispositivos:<\/span><\/li><\/ul><p><i><span style=\"font-weight: 400;\">Art. 17 &#8211; O registro de pre\u00e7os poder\u00e1 ser utilizado nas hip\u00f3teses de contrata\u00e7\u00e3o direta para a aquisi\u00e7\u00e3o de bens ou para a contrata\u00e7\u00e3o de servi\u00e7os, inclusive de engenharia, para mais de um \u00f3rg\u00e3o ou entidade.<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"> \u00a7 1\u00ba Caso a IRP n\u00e3o receba nenhuma manifesta\u00e7\u00e3o de interesse, o \u00f3rg\u00e3o ou entidade gerenciador(a) poder\u00e1 seguir com o procedimento de registro de pre\u00e7os por contrata\u00e7\u00e3o direta apenas com a sua quantidade demandada.<\/span><\/i><\/p><ul><li><i><span style=\"font-weight: 400;\"> 2\u00ba Para fins do disposto no caput deste artigo, al\u00e9m das disposi\u00e7\u00f5es deste Decreto, dever\u00e3o ser observadas as hip\u00f3teses de inexigibilidade ou dispensa de licita\u00e7\u00e3o, conforme disposto nos arts. 74 e 75 da Lei n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2021, respectivamente, bem como os requisitos da instru\u00e7\u00e3o processual dispostos no art. 72 tamb\u00e9m da Lei n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2021.<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"> \u00a7 3\u00ba O registro de pre\u00e7os poder\u00e1 ser utilizado, na hip\u00f3tese de inexigibilidade de licita\u00e7\u00e3o, para a aquisi\u00e7\u00e3o, por for\u00e7a de decis\u00e3o judicial, de medicamentos ou insumos para tratamentos m\u00e9dicos.<\/span><\/i><\/li><\/ul><p><b>\u00a0<\/b><\/p><h3><b>Procedimentos do processo licitat\u00f3rio para registro de pre\u00e7os<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Dever\u00e3o ser observados os requisitos da instru\u00e7\u00e3o processual previstos no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.816\/2023<\/strong><\/a>.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">A licita\u00e7\u00e3o para registro de pre\u00e7os ser\u00e1 realizada na modalidade de <\/span><b>concorr\u00eancia<\/b><span style=\"font-weight: 400;\">, do <\/span><b>tipo menor pre\u00e7o<\/b><span style=\"font-weight: 400;\">, ou na modalidade de <\/span><b>preg\u00e3o<\/b><span style=\"font-weight: 400;\"> devendo ser precedida de ampla pesquisa de mercado.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Na modalidade concorr\u00eancia, o crit\u00e9rio de julgamento <\/span><b>por t\u00e9cnica e pre\u00e7o <\/b><span style=\"font-weight: 400;\">\u00e9 adotado exclusivamente para servi\u00e7os de natureza predominantemente intelectual.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">Na licita\u00e7\u00e3o para registro de pre\u00e7os <\/span><b>n\u00e3o \u00e9 necess\u00e1rio indicar a dota\u00e7\u00e3o or\u00e7ament\u00e1ria<\/b><span style=\"font-weight: 400;\">, sendo esta somente exigida para a formaliza\u00e7\u00e3o do contrato ou outro instrumento h\u00e1bil.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <span style=\"font-weight: 400;\">O edital de licita\u00e7\u00e3o para registro de pre\u00e7os deve observar o disposto no art. 16 do <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48843-2023-rio-de-janeiro-regulamenta-o-sistema-de-registro-de-precos-srp-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48843&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.843\/2023<\/strong><\/a>:<\/span><\/li><\/ul><ol><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">As <\/span><b>especificidades da licita\u00e7\u00e3o e de seu objeto<\/b><span style=\"font-weight: 400;\">, inclusive a quantidade m\u00e1xima de cada item que poder\u00e1 ser adquirida.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A estimativa das quantidades a serem adquiridas pelo \u00f3rg\u00e3o gerenciador e pelos \u00f3rg\u00e3os participantes, <\/span><b>caso admitida participa\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A estimativa de quantidades a serem adquiridas pelos \u00f3rg\u00e3os n\u00e3o participantes, <\/span><b>caso admitida ades\u00f5es<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A quantidade m\u00ednima a ser cotada de unidades de bens ou, no caso de servi\u00e7os, de unidades de medida.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A possibilidade de <\/span><b>prever pre\u00e7os diferentes<\/b><span style=\"font-weight: 400;\">: quando o objeto for realizado ou entregue em locais diferentes; em raz\u00e3o da forma e do local de acondicionamento; quando admitida cota\u00e7\u00e3o vari\u00e1vel em raz\u00e3o do tamanho do lote; por outros motivos justificados no processo.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O prazo de vantajosos.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A minuta da ARP constar\u00e1 como anexo obrigat\u00f3rio do edital ou aviso de contrata\u00e7\u00e3o direta.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">A possibilidade de o licitante oferecer ou n\u00e3o proposta em quantitativo inferior ao m\u00e1ximo previsto no edital, obrigando-se nos limites dela.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O crit\u00e9rio de julgamento da licita\u00e7\u00e3o, que ser\u00e1 o <\/span><b>de menor pre\u00e7o ou o de maior desconto<\/b><span style=\"font-weight: 400;\"> sobre tabela de pre\u00e7os praticada
