ESTADO QUE TRATA A LEI N\u00ba 12.846, DE 1\u00ba DE AGOSTO DE 2013 E REVOGA A RESOLU\u00c7\u00c3O CGE N\u00ba 118, DE 12 DE JANEIRO DE 2022.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<div class=\"elementor-element elementor-element-90fc55d elementor-widget elementor-widget-text-editor\" data-id=\"90fc55d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>O <strong>CONTROLADOR-GERAL DO ESTADO<\/strong>, no uso da atribui\u00e7\u00e3o que lhe confere a al\u00ednea \u201ca\u201d inciso I do art. 8\u00ba da Lei n\u00ba 7.989, de 14 de junho de 2018, e no art. 69 do Decreto n\u00ba 46.366, de 19 de julho de 2018 e considerando o que consta do processo n\u00ba SEI320001\/000578\/2022,<\/p><p><strong>CONSIDERANDO:<\/strong><\/p><p>&#8211; a necessidade de se estabelecer procedimentos no \u00e2mbito da Controladoria Geral do Estado &#8211; CGE para o registro das san\u00e7\u00f5es no Cadastro Nacional de Empresas Punidas &#8211; CNEP e Cadastro Nacional de Empresas Inid\u00f4neas e Suspensas &#8211; CNEIS aplicadas pelos \u00f3rg\u00e3os e entidades do Poder Executivo do Estado que trata os artigos. 22 e 23 da Lei n\u00ba 12.846, de 1\u00ba de agosto de 2013; e<\/p><p>&#8211; ainda a import\u00e2ncia de se orientar quanto ao preenchimento das Guias de Recolhimento &#8211; GRE aplicadas em fun\u00e7\u00e3o das multas civis com base na Lei Federal n\u00b0 8.429, de 02 de junho de 1992 e das multas administrativas aplicadas pelos \u00f3rg\u00e3os ou entidades do Estado do Rio de Janeiro, com base nas Leis Federais n\u00b0 8.666, de 21 de junho de 1993 e n\u00ba 12.846 de 1\u00b0 de agosto de 2013.<\/p><p><strong>RESOLVE:<\/strong><\/p><p>Art. 1\u00ba &#8211; Os \u00f3rg\u00e3os e entidades do Poder Executivo do Estado do Rio de Janeiro, ap\u00f3s a publica\u00e7\u00e3o da aplica\u00e7\u00e3o das san\u00e7\u00f5es estabelecidas nos artigos 22 e 23 da Lei n\u00ba 12.846, de 1\u00ba de agosto de 2013 no Di\u00e1rio Oficial do Estado, dever\u00e3o encaminhar para a Controladoria Geral do Estado &#8211; CGE, no prazo de 05 (cinco) dias \u00fateis, expediente contendo breve exposi\u00e7\u00e3o dos fatos que resultaram na san\u00e7\u00e3o, juntamente com a c\u00f3pia da publica\u00e7\u00e3o.<\/p><p>Par\u00e1grafo \u00danico &#8211; O expediente de que trata o caput dever\u00e1 ser encaminhado por meio eletr\u00f4nico SEI, diretamente para as unidades do SEI CGE\/SUPREC e SEI CGE\/DGAF simultaneamente.<\/p><p>Art. 2\u00ba &#8211; As publica\u00e7\u00f5es dos atos oficiais na Imprensa Oficial do Estado do Rio de Janeiro referente \u00e0s san\u00e7\u00f5es aplicadas pelos \u00f3rg\u00e3os e entidades do Poder Executivo do Estado que trata os artigos 22 e 23 da Lei n\u00ba 12.846, de 1\u00ba de agosto de 2013, dever\u00e3o conter:<\/p><p>1 &#8211; n\u00famero do Processo;<\/p><p>2 &#8211; raz\u00e3o Social da empresa ou nome da pessoa f\u00edsica; CNPJ ou CPF;<\/p><p>3 &#8211; tipo de San\u00e7\u00e3o: Enquadramento legal da san\u00e7\u00e3o (Leis Federais n\u00fameros 8.666\/93, 10.520\/2002 ou 12.846\/2013);<\/p><p>4 &#8211; valor da Multa (R$);<\/p><p>5 &#8211; prazo da san\u00e7\u00e3o;<\/p><p>5 &#8211; data do inicio da san\u00e7\u00e3o;<\/p><p>6 &#8211; data do tr\u00e2nsito em julgado;<\/p><p>7 &#8211; indicar a abrang\u00eancia da san\u00e7\u00e3o, se:<\/p><ol><li>a) em todos os poderes da esfera do \u00f3rg\u00e3o sancionador; ou<\/li><li>b) na esfera e no poder do \u00f3rg\u00e3o sancionador; ou<\/li><li>c) no \u00f3rg\u00e3o sancionador; ou<\/li><li>d) todas as esferas em todos os poderes.<\/li><\/ol><p>Art. 3\u00ba &#8211; O recolhimento das multas civis aplicadas, com base na Lei Federal n\u00b0 8.429, de 02 de junho de 1992 e das multas administrativas aplicadas pelos \u00f3rg\u00e3os ou entidades do Estado do Rio de Janeiro, com base nas Leis Federais n\u00b0 8.666, de 21 de junho de 1993, e n\u00ba 12.846 de 1\u00b0 de agosto de 2013 e o preenchimento das Guias de Recolhimento &#8211; GRE, dar-se-\u00e3o atrav\u00e9s da emiss\u00e3o da Guia de Recolhimento GRE emitida pelo \u00f3rg\u00e3o sancionador, no link, (<a href=\"http:\/\/www4.fazenda.rj.gov.br\/sisgre-web\/paginas\/gerarGRE\/guiaGREPub.jsf\">http:\/\/www4.fazenda.rj.gov.br\/sisgre-web\/paginas\/gerarGRE\/guiaGREPub.jsf<\/a>).<\/p><p>Par\u00e1grafo \u00danico &#8211; Na emiss\u00e3o da GRE ser\u00e3o observados os seguintes dados:<\/p><p>I- no campo 2 da GRE, VENCIMENTO, dever\u00e1 constar a data de 30 (trinta) dias corridos, ap\u00f3s a data do in\u00edcio da san\u00e7\u00e3o.<\/p><p>II &#8211; no campo 6 da GRE, C\u00d3DIGO DA UGA, dever\u00e1 constar o c\u00f3digo 506100.<\/p><p>III &#8211; no campo 7 da GRE, C\u00d3DIGO DO RECOLHIMENTO, dever\u00e1 constar o c\u00f3digo 27540-4 para pessoa jur\u00eddica e c\u00f3digo 27541-2 para pessoa f\u00edsica.<\/p><p>IV &#8211; no campo 9 da GRE, COMPET\u00caNCIA, dever\u00e1 constar a data do in\u00edcio da san\u00e7\u00e3o.<\/p><p>Art. 4\u00ba &#8211; Esta Resolu\u00e7\u00e3o entrar\u00e1 em vigor na data de sua publica\u00e7\u00e3o, ficando revogada a
