href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\">Lei n\u00ba 14.133\/2021<\/a> d\u00e1 \u00eanfase ao planejamento tornando-o um de seus princ\u00edpios:<\/b><\/p><p><i><span style=\"font-weight: 400;\">Art. 5\u00ba &#8211; Na aplica\u00e7\u00e3o desta Lei, ser\u00e3o observados os princ\u00edpios da legalidade, da impessoalidade, da moralidade, da publicidade, da efici\u00eancia, do interesse p\u00fablico, da probidade administrativa, da igualdade, <\/span><\/i><i>do planejamento<\/i><i><span style=\"font-weight: 400;\">, da transpar\u00eancia, da efic\u00e1cia, da segrega\u00e7\u00e3o de fun\u00e7\u00f5es, da motiva\u00e7\u00e3o, da vincula\u00e7\u00e3o ao edital, do julgamento objetivo, da seguran\u00e7a jur\u00eddica, da razoabilidade, da competitividade, da proporcionalidade, da celeridade, da economicidade e do desenvolvimento nacional sustent\u00e1vel, assim como as disposi\u00e7\u00f5es do Decreto-Lei n\u00ba 4.657, de 4 de setembro de 1942 (Lei de Introdu\u00e7\u00e3o \u00e0s Normas do Direito Brasileiro).<\/span><\/i><\/p><p><b>\u00a0<\/b><b>A <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\">Lei n\u00ba 14.133\/2021<\/a> d\u00e1 \u00eanfase ao planejamento atrav\u00e9s de dispositivos para al\u00e9m da expectativa de consumo anual:<\/b><\/p><p><i><span style=\"font-weight: 400;\">Art. 40 &#8211; O planejamento de compras dever\u00e1 considerar a expectativa de consumo anual e observar o seguinte:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I &#8211; condi\u00e7\u00f5es de aquisi\u00e7\u00e3o e pagamento semelhantes \u00e0s do setor privado;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; processamento <\/span><\/i><b><i>por meio de sistema de registro de pre\u00e7os<\/i><\/b><i><span style=\"font-weight: 400;\">, quando pertinente;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III &#8211; determina\u00e7\u00e3o de unidades e quantidades a serem adquiridas em fun\u00e7\u00e3o de consumo e utiliza\u00e7\u00e3o prov\u00e1veis, cuja estimativa ser\u00e1 obtida, sempre que poss\u00edvel, mediante adequadas t\u00e9cnicas quantitativas, admitido o fornecimento cont\u00ednuo;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IV &#8211; condi\u00e7\u00f5es de guarda e armazenamento que n\u00e3o permitam a deteriora\u00e7\u00e3o do material;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">V &#8211; atendimento aos princ\u00edpios:<\/span><\/i><\/p><ol><li><i><span style=\"font-weight: 400;\">a) da <\/span><\/i><b><i>padroniza\u00e7\u00e3o<\/i><\/b><i><span style=\"font-weight: 400;\">, considerada a compatibilidade de especifica\u00e7\u00f5es est\u00e9ticas, t\u00e9cnicas ou de desempenho;<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\">b)<\/span><\/i> <i><span style=\"font-weight: 400;\">do <\/span><\/i><b><i>parcelamento<\/i><\/b><i><span style=\"font-weight: 400;\">, quando for tecnicamente vi\u00e1vel e economicamente vantajoso;<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\">c) da <\/span><\/i><b><i>responsabilidade fiscal<\/i><\/b><i><span style=\"font-weight: 400;\">, mediante a compara\u00e7\u00e3o da despesa estimada com a prevista no or\u00e7amento.<\/span><\/i><\/li><\/ol><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>O planejamento no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\">Decreto Estadual n\u00ba 48.816\/2023<\/a><\/b><\/p><p><i><span style=\"font-weight: 400;\">Art. 4\u00ba &#8211; A fase preparat\u00f3ria das contrata\u00e7\u00f5es \u00e9 caracterizada pelo planejamento, cuja responsabilidade recai sobre m\u00faltiplos agentes, e se inicia por meio de processo administrativo, autuado por meio eletr\u00f4nico, a partir da oficializa\u00e7\u00e3o da demanda pelo setor demandante, que evidencie a necessidade administrativa a ser atendida, e se encerra no momento do encaminhamento pela autoridade competente do instrumento convocat\u00f3rio para publica\u00e7\u00e3o ou, tratando-se de contrata\u00e7\u00e3o direta, do ato de autoriza\u00e7\u00e3o.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><i><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. A elabora\u00e7\u00e3o do Plano de Contrata\u00e7\u00f5es Anual &#8211; PCA, instrumento de governan\u00e7a e planejamento, implementado pelo Decreto n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">48.760<\/span><\/i><i><span style=\"font-weight: 400;\">, de 23 de outubro de 2023, antecede a fase preparat\u00f3ria.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">A <\/span><b>nova vis\u00e3o de processo <\/b><span style=\"font-weight: 400;\">centraliza a ideia de que o planejamento consiste na etapa mais importante, porquanto todas as demais estar\u00e3o condicionadas \u00e0 descri\u00e7\u00e3o correta e adequada do que se pretende contratar.<\/span><\/p><p><span style=\"font-weight: 400;\">Portanto, \u00e9 necess\u00e1rio reconhecer a <\/span><b>import\u00e2ncia do planejamento no processo <\/b><span style=\"font-weight: 400;\">de contrata\u00e7\u00e3o p\u00fablica, porque viabiliza a boa gest\u00e3o dos recursos p\u00fablicos, mediante a preven\u00e7\u00e3o de falhas e supress\u00e3o de incertezas.<\/span><\/p><h3>\u00a0<\/h3><h3><span style=\"font-weight: 400;\">\u00a0<\/span><b>Inten\u00e7\u00e3o de Registro de Pre\u00e7os &#8211; IRP<\/b><\/h3><ul><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O procedimento de Registro de Pre\u00e7os inicia-se com a Inten\u00e7\u00e3o de Registro de Pre\u00e7os &#8211; IRP, <\/span><b>instrumento de planejamento <\/b><span style=\"font-weight: 400;\">que d\u00e1 publicidade para que os \u00f3rg\u00e3os e entidades participem da futura ata de registro de pre\u00e7os e registrando suas estimativas de quantidades para a contrata\u00e7\u00e3o.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O objetivo principal da IRP \u00e9 que os \u00f3rg\u00e3os e entidades informem, previamente, as quantidades individuais a serem contratadas, estimulando-os a participar da fase de planejamento da compra compartilhada, potencializando maior economia face ao aumento da escala.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O \u00f3rg\u00e3o gerenciador dever\u00e1 estabelecer prazo m\u00ednimo de 08 dias \u00fateis para que os \u00f3rg\u00e3os participantes informem suas estimativas individuais de quantidade.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">Os \u00f3rg\u00e3os participantes ser\u00e3o respons\u00e1veis pela manifesta\u00e7\u00e3o de interesse atrav\u00e9s da IRP, informando suas demandas, sua estimativa de consumo e local de entrega.<\/span><\/li><li><span style=\"font-weight: 400;\"> \u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\">O \u00f3rg\u00e3o gerenciador dever\u00e1 consolidar todas as informa\u00e7\u00f5es relativas \u00e0 estimativa individual e total de consumo, ap\u00f3s confirmar junto aos \u00f3rg\u00e3os participantes a sua concord\u00e2ncia com o objeto a ser licitado, quantitativos e Termo de Refer\u00eancia, de forma a atender aos requisitos de padroniza\u00e7\u00e3o e racionaliza\u00e7\u00e3o.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Sendo a Inten\u00e7\u00e3o de Registro de Pre\u00e7os o procedimento que oportuniza os \u00f3rg\u00e3os e entidades a integrarem a ARP na condi\u00e7\u00e3o de participantes, \u00e9 necess\u00e1rio um prazo m\u00ednimo compat\u00edvel para que os \u00f3rg\u00e3os interessados realizem um <\/span><b>melhor planejamento <\/b><span style=\"font-weight: 400;\">de suas demandas.<\/span><\/p><p><span style=\"font-weight: 400;\">Dessa forma, \u00e9 poss\u00edvel tornar os potenciais futuros \u201c\u00f3rg\u00e3os caronas\u201d em participantes do processo licitat\u00f3rio para SRP, reduzindo-se, portanto, o n\u00famero de ades\u00f5es \u00e0s ARP por \u00f3rg\u00e3os que n\u00e3o participaram da licita\u00e7\u00e3o.<\/span><\/p><h3><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3><h3><b>Defini\u00e7\u00e3o do Objeto<\/b><\/h3><p><a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\"><b>Decreto n\u00ba 48.816\/2023<\/b><\/a><span style=\"font-weight: 400;\">: O Decreto que regulamenta a Fase Preparat\u00f3ria das Contrata\u00e7\u00f5es<\/span> <span style=\"font-weight: 400;\">tamb\u00e9m estabelece diretrizes quanto \u00e0 defini\u00e7\u00e3o e padroniza\u00e7\u00e3o do objeto:<\/span><\/p><p><i><span style=\"font-weight: 400;\">Art. 16 &#8211; O Termo de Refer\u00eancia &#8211; TR \u00e9 documento obrigat\u00f3rio para todos os processos licitat\u00f3rios e contrata\u00e7\u00f5es diretas destinados \u00e0s aquisi\u00e7\u00f5es de bens e contrata\u00e7\u00e3o de servi\u00e7os, que deve conter os elementos necess\u00e1rios e suficientes, com n\u00edvel de precis\u00e3o adequado, para caracterizar o objeto da licita\u00e7\u00e3o, especialmente no que concerne aos requisitos de contrata\u00e7\u00e3o e modelo de execu\u00e7\u00e3o do objeto a ser contratado.<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"> Par\u00e1grafo \u00fanico. O TR dever\u00e1 ser elaborado a partir do Estudo T\u00e9cnico Preliminar &#8211; ETP, quando desenvolvido, e estar alinhado com o Plano de Contrata\u00e7\u00f5es Anual, al\u00e9m de outros instrumentos de planejamento da Administra\u00e7\u00e3o.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><i><span style=\"font-weight: 400;\">Art. 17 &#8211; Dever\u00e3o constar do TR os seguintes par\u00e2metros e elementos descritivos, dentre outros que se fizerem necess\u00e1rios:<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"> I &#8211; justificativa: fundamenta\u00e7\u00e3o da necessidade e, se for o caso, do tipo de solu\u00e7\u00e3o escolhida, que poder\u00e1 consistir na refer\u00eancia ao ETP correspondente, quando este for realizado;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; na hip\u00f3tese de contrata\u00e7\u00e3o direta, a indica\u00e7\u00e3o do dispositivo legal no qual o caso espec\u00edfico se enquadra;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III &#8211; defini\u00e7\u00e3o do objeto:<\/span><\/i><\/p><ol start=\"14\"><li><i><span style=\"font-weight: 400;\">a) especifica\u00e7\u00e3o do bem ou do servi\u00e7o, conforme cat\u00e1logo eletr\u00f4nico de padroniza\u00e7\u00e3o de compras (inciso LI do Art. 6\u00ba da Lei n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">133<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2021) ou, apresenta\u00e7\u00e3o da competente justificativa (\u00a7 2\u00ba do Art. 19 da Lei n\u00ba <\/span><\/i><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><i><span style=\"font-weight: 400;\">, de 2021), observados os requisitos de qualidade, rendimento, compatibilidade, durabilidade e seguran\u00e7a;<\/span><\/i><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><i><span style=\"font-weight: 400;\"> b) descri\u00e7\u00e3o pormenorizada, considerando todo o ciclo de vida do objeto a ser contratado, de forma precisa, suficiente e clara, por meio de especifica\u00e7\u00f5es t\u00e9cnicas ou de desempenho do objeto usuais de mercado, vedando-se aquelas que, por excessivas, irrelevantes ou desnecess\u00e1rias, limitem a competi\u00e7\u00e3o;<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\">c) determina\u00e7\u00e3o de unidades e quantidades a serem adquiridas em fun\u00e7\u00e3o de consumo e utiliza\u00e7\u00e3o prov\u00e1veis, cuja estimativa ser\u00e1 obtida, sempre que poss\u00edvel, mediante adequadas t\u00e9cnicas quantitativas, acompanhadas das mem\u00f3rias de c\u00e1lculo e dos documentos que lhes d\u00e3o suporte;<\/span><\/i><\/li><\/ol><p><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><span style=\"font-weight: 400;\">Neste sentido, assim se manifestam os Tribunais de Contas:<\/span><\/p><ul><li><span style=\"font-weight: 400;\"> \u00a0 <\/span> <a href=\"https:\/\/pesquisa.apps.tcu.gov.br\/documento\/sumula\/*\/NUMERO%253A177\/DTRELEVANCIA%2520desc%252C%2520NUMEROINT%2520desc\/0\/sinonimos%253Dtrue\"><strong>S\u00famula TCU n\u00ba 177<\/strong><\/a><\/li><\/ul><p><i><span style=\"font-weight: 400;\">\u201cA defini\u00e7\u00e3o precisa e suficiente do objeto licitado constitui regra indispens\u00e1vel da competi\u00e7\u00e3o, at\u00e9 mesmo como pressuposto do postulado de igualdade entre os licitantes, do qual \u00e9 subsidi\u00e1rio o princ\u00edpio da publicidade, que envolve o conhecimento, pelos concorrentes potenciais, das condi\u00e7\u00f5es b\u00e1sicas da licita\u00e7\u00e3o, constituindo, na hip\u00f3tese particular da licita\u00e7\u00e3o para compra, a quantidade demandada em uma das especifica\u00e7\u00f5es m\u00ednimas e essenciais \u00e0 defini\u00e7\u00e3o do objeto do preg\u00e3o\u201d <\/span><\/i><b><i>[6]<\/i><\/b><\/p><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><strong>Boletim TCE\/RJ n\u00ba 02<\/strong><\/li><\/ul><p><span style=\"font-weight: 400;\">Processo TCE-RJ n\u00ba 130.784-2\/11 (Relatora: Conselheira Marianna Montebello Willeman) ATA DE REGISTRO DE PRE\u00c7O. DIRECIONAMENTO.<\/span><\/p><p><i><span style=\"font-weight: 400;\">\u201cA <\/span><\/i><b><i>especifica\u00e7\u00e3o excessiva do objeto<\/i><\/b><i><span style=\"font-weight: 400;\"> pode originar fraudes em procedimento licitat\u00f3rios, porquanto podem caracterizar um vetor de <\/span><\/i><b><i>direcionamento<\/i><\/b><i><span style=\"font-weight: 400;\"> da contenda para determinado
