autoridade competente que, a partir de uma an\u00e1lise de toda a documenta\u00e7\u00e3o processual, autoriza o prosseguimento da contrata\u00e7\u00e3o. \n<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b258684 elementor-widget elementor-widget-image\" data-id=\"b258684\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"800\" height=\"533\" representa a \u00faltima etapa da Fase Preparat\u00f3ria do procedimento administrativo, tal como disposto no inciso XII, art. 5\u00ba, do <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.816\/23<\/strong><\/a>, da seguinte forma:<\/span><\/p><p><i><span style=\"font-weight: 400;\">Art. 5\u00ba S\u00e3o atos que constituem a fase preparat\u00f3ria, a serem observados, preferencialmente, na seguinte ordem:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">(&#8230;)<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">XII &#8211; aprova\u00e7\u00e3o do processo de contrata\u00e7\u00e3o pela autoridade competente, com o encaminhamento do instrumento convocat\u00f3rio ou do aviso de dispensa eletr\u00f4nica para respectiva publica\u00e7\u00e3o e divulga\u00e7\u00e3o no Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas &#8211; PNCP.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Ap\u00f3s o processo de contrata\u00e7\u00e3o percorrer todas as etapas da Fase Preparat\u00f3ria, inclusive contar com parecer favor\u00e1vel do \u00f3rg\u00e3o de assessoramento jur\u00eddico, caber\u00e1 \u00e0 autoridade competente a aprova\u00e7\u00e3o final de seus documentos e, em especial, do edital, se for o caso.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Observa-se ainda, a necessidade de promover o encaminhamento do instrumento convocat\u00f3rio ou o aviso de dispensa eletr\u00f4nica para a respectiva publica\u00e7\u00e3o, bem como a divulga\u00e7\u00e3o no Portal Nacional de Contrata\u00e7\u00f5es P\u00fablicas &#8211; PNCP.\u00a0\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">A autoridade competente para tais atos est\u00e1 definida no inciso III do art. 3\u00b0 do <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48817-2023-rio-de-janeiro-regulamenta-a-gestao-e-a-fiscalizacao-das-contratacoes-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48817&amp;origin=instituicao#\"><strong>Decreto 48.817\/23<\/strong><\/a>. <\/span><\/p><p><span style=\"font-weight: 400;\">Quanto aos atos que envolvem autoriza\u00e7\u00e3o de despesa dever\u00e1 ser observado o art. 82 da <\/span><a href=\"https:\/\/leisestaduais.com.br\/rj\/lei-ordinaria-n-287-1979-rio-de-janeiro-aprova-o-codigo-de-administracao-financeira-e-contabilidade-publica-do-estado-do-rio-de-janeiro-e-da-outras-providencias?q=287&amp;origin=instituicao#\"><b>Lei n\u00ba 287, de 04 de dezembro de 1979<\/b><\/a><span style=\"font-weight: 400;\">, o C\u00f3digo de Administra\u00e7\u00e3o Financeira e Contabilidade P\u00fablica do Estado do Rio de Janeiro:<\/span><\/p><p><i><span style=\"font-weight: 400;\">Art. 82 \u2013 S\u00e3o competentes para autorizar despesas, movimentar as cotas e transfer\u00eancias financeiras:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I \u2013 o Governador;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II \u2013 o Vice-Governador;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III \u2013 as autoridades do Poder Judici\u00e1rio, indicadas por lei ou respectivo regimentos;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IV \u2013 as autoridades do Poder Legislativo, indicadas no respectivo regimento;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">V \u2013 o Presidente do Tribunal de Contas;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VI \u2013 o Presidente do Conselho de Contas dos Munic\u00edpios;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VII \u2013 os Secret\u00e1rios de Estado;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VIII \u2013 o Chefe do Gabinete Militar;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IX \u2013 os titulares de autarquias, de empresas p\u00fablicas, de sociedades de economia mista e de funda\u00e7\u00f5es, de acordo com o estabelecido em lei, decreto ou estatuto.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">X \u2013 os Procuradores Gerais do Estado e da Justi\u00e7a e o Procurador Chefe do Minist\u00e9rio P\u00fablico Especial.<\/span><\/i><\/p><ul><li><i><span style=\"font-weight: 400;\"> 1\u00ba \u2013 A compet\u00eancia prevista neste artigo poder\u00e1 ser objeto de delega\u00e7\u00e3o a ordenadores de despesas, mediante ato normativo expresso, a ser comunicado ao Tribunal de Contas e \u00e0 Secretaria de Estado de Fazenda.<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\"> 2\u00ba \u2013 Os \u00f3rg\u00e3os de contabilidade inscrever\u00e3o como respons\u00e1veis todos os ordenadores de despesas, os quais s\u00f3 poder\u00e3o ser exonerados de responsabilidade ap\u00f3s julgadas regulares suas contas pelo Tribunal de Contas do Estado.<\/span><\/i><\/li><li><i><span style=\"font-weight: 400;\"> 3\u00ba \u2013 Para fins do disposto neste artigo, entende-se como ordenador de despesas toda e qualquer autoridade de cujos atos resultarem reconhecimento de d\u00edvida, emiss\u00e3o de empenho, autoriza\u00e7\u00e3o de pagamento, concess\u00e3o de adiantamento, suprimento de fundos ou disp\u00eandio de recursos do Estado ou pelos quais este responda.<\/span><\/i><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00c9 importante que a autoridade competente ou o ordenador de despesas com delega\u00e7\u00e3o de compet\u00eancia observem o disposto no <\/span><a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-43057-2011-rio-de-janeiro-institui-o-codigo-de-conduta-da-alta-administracao-estadual-e-da-outras-providencias\"><b>Decreto n\u00ba 43.057, de 04 de julho de 2011<\/b><\/a><span style=\"font-weight: 400;\">, que institui o C\u00f3digo de Conduta da Alta Administra\u00e7\u00e3o Estadual, no que diz respeito a poss\u00edveis conflitos entre o interesse privado e as atribui\u00e7\u00f5es do agente p\u00fablico, sempre zelando pelos princ\u00edpios da legalidade, impessoalidade, publicidade, efici\u00eancia, moralidade e probidade.<\/span><\/p><p><span style=\"font-weight: 400;\">Cabe \u00e0 autoridade competente, ainda, atentar \u00e0 <\/span><a href=\"https:\/\/leisestaduais.com.br\/rj\/lei-ordinaria-n-5427-2009-rio-de-janeiro-estabelece-normas-sobre-atos-e-processos-administrativos-no-ambito-do-estado-do-rio-de-janeiro-e-da-outras-providencias?q=5.427&amp;origin=instituicao#\"><b>Lei n\u00ba 5.427, de 01 de abril de 2009<\/b><\/a><span style=\"font-weight: 400;\">, que estabelece normas sobre atos e processos administrativos no \u00e2mbito do Estado do Rio de Janeiro. Al\u00e9m de dispor a respeito da forma de atua\u00e7\u00e3o dos agentes p\u00fablicos nos processos administrativos, resguardando os direitos dos interessados e da Administra\u00e7\u00e3o, o normativo destaca a possibilidade de impedimentos e suspei\u00e7\u00e3o em seu Cap\u00edtulo VII:<\/span><\/p><p><i><span style=\"font-weight: 400;\">Art. 16. Pode ser arg\u00fcida a suspei\u00e7\u00e3o de autoridade ou agente que tenha amizade \u00edntima ou inimizade not\u00f3ria com algum dos interessados ou com os respectivos c\u00f4njuges, companheiros, parentes e afins at\u00e9 o terceiro grau.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Art. 17. Fica impedido de atuar em processo administrativo o servidor ou autoridade que:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I \u2013 tenha interesse direto ou indireto na mat\u00e9ria ou na solu\u00e7\u00e3o do processo;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II \u2013 seja c\u00f4njuge, companheiro, parente ou afim at\u00e9 o terceiro grau de qualquer dos interessados;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III \u2013 tenha dele participado ou dele venha a participar como perito, testemunha ou representante ou se tais situa\u00e7\u00f5es ocorrerem quanto a qualquer das pessoas indicadas no artigo anterior;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IV \u2013 esteja litigando judicial ou administrativamente com o interessado ou com qualquer das pessoas indicadas no artigo anterior.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Art. 18. A autoridade ou servidor que incorrer em impedimento tem o dever de comunicar o fato \u00e0 autoridade competente, abstendo-se de atuar.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. A omiss\u00e3o no dever de comunicar o impedimento constitui falta grave, para efeitos disciplinares.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Dever\u00e3o, ainda, constar do processo administrativo de contrata\u00e7\u00e3o o ato da autoridade competente designando a Comiss\u00e3o de Licita\u00e7\u00e3o ou o Pregoeiro e Equipe de Apoio, incluindo, neste caso, o comprovante de sua admiss\u00e3o na Rede de Pregoeiro do Estado do Rio de Janeiro \u2013 REDEPREG.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-60b1823 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"60b1823\" data-element_type=\"section\"
