contrata\u00e7\u00e3o de bens e servi\u00e7os, enquanto o Projeto B\u00e1sico (PB) \u00e9 utilizado nas contrata\u00e7\u00f5es de obras e servi\u00e7os de engenharia. <\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bb262c6 elementor-widget elementor-widget-text-editor\" data-id=\"bb262c6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>O que o TR\/PB deve conter?<\/strong><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">O TR ou o PB s\u00e3o documentos anexos ao edital de uma licita\u00e7\u00e3o que deve conter os elementos necess\u00e1rios e suficientes, com n\u00edvel de precis\u00e3o adequado, para caracterizar o objeto da licita\u00e7\u00e3o, permitindo, assim, que os interessados em contratar com a Administra\u00e7\u00e3o P\u00fablica possam oferecer adequadamente suas propostas.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">A elabora\u00e7\u00e3o do TR ou do PB \u00e9 obrigat\u00f3ria para toda contrata\u00e7\u00e3o, independente da forma de sele\u00e7\u00e3o do fornecedor se dar por licita\u00e7\u00e3o, por contrata\u00e7\u00e3o direta ou por ades\u00e3o \u00e0 ata de registro de pre\u00e7os. XXIV do <\/strong><\/span><b>art. 6\u00ba e no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\">Decreto 48.816\/23<\/a>, dos Art. 22 a 24<\/b><span style=\"font-weight: 400;\">:<\/span><\/p><p><i><span style=\"font-weight: 400;\">a) demonstra\u00e7\u00e3o e justificativa do programa de necessidades, avalia\u00e7\u00e3o de demanda do p\u00fablico-alvo, motiva\u00e7\u00e3o t\u00e9cnico-econ\u00f4mico-social do empreendimento, vis\u00e3o global dos investimentos e defini\u00e7\u00f5es relacionadas ao n\u00edvel de servi\u00e7o desejado;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">b) condi\u00e7\u00f5es de solidez, de seguran\u00e7a e de durabilidade;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">c) prazo de entrega;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">d) est\u00e9tica do projeto arquitet\u00f4nico, tra\u00e7ado geom\u00e9trico e\/ou projeto da \u00e1rea de influ\u00eancia, quando cab\u00edvel;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">e) par\u00e2metros de adequa\u00e7\u00e3o ao interesse p\u00fablico, de economia na utiliza\u00e7\u00e3o, de facilidade na execu\u00e7\u00e3o, de impacto ambiental e de acessibilidade;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">f) proposta de concep\u00e7\u00e3o da obra ou do servi\u00e7o de engenharia;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">g) projetos anteriores ou estudos preliminares que embasaram a concep\u00e7\u00e3o proposta;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">h) levantamento topogr\u00e1fico e cadastral;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">i) pareceres de sondagem;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">j) memorial descritivo dos elementos da edifica\u00e7\u00e3o, dos componentes construtivos e dos materiais de constru\u00e7\u00e3o, de forma a estabelecer padr\u00f5es m\u00ednimos para a contrata\u00e7\u00e3o.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Quanto ao <\/span><b>Projeto B\u00e1sico<\/b><span style=\"font-weight: 400;\">, definido no <strong>inc. XXV do <\/strong><\/span><b>art. 6\u00ba<\/b><span style=\"font-weight: 400;\"> como o <\/span><i><span style=\"font-weight: 400;\">conjunto de elementos necess\u00e1rios e suficientes, com n\u00edvel de precis\u00e3o adequado para definir e dimensionar a obra ou o servi\u00e7o, ou o complexo de obras ou de servi\u00e7os objeto da licita\u00e7\u00e3o, elaborado com base nas indica\u00e7\u00f5es dos estudos t\u00e9cnicos preliminares, que assegure a viabilidade t\u00e9cnica e o adequado tratamento do impacto ambiental do empreendimento e que possibilite a avalia\u00e7\u00e3o do custo da obra e a defini\u00e7\u00e3o dos m\u00e9todos e do prazo de execu\u00e7\u00e3o<\/span><\/i><span style=\"font-weight: 400;\">, dele dever\u00e3o constar:<\/span><\/p><p><i><span style=\"font-weight: 400;\">a) levantamentos topogr\u00e1ficos e cadastrais, sondagens e ensaios geot\u00e9cnicos, ensaios e an\u00e1lises laboratoriais, estudos socioambientais e demais dados e levantamentos necess\u00e1rios para execu\u00e7\u00e3o da solu\u00e7\u00e3o escolhida;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">b) solu\u00e7\u00f5es t\u00e9cnicas globais e localizadas, suficientemente detalhadas, de forma a evitar, por ocasi\u00e3o da elabora\u00e7\u00e3o do projeto executivo e da realiza\u00e7\u00e3o das obras e montagem, a necessidade de reformula\u00e7\u00f5es ou variantes quanto \u00e0 qualidade, ao pre\u00e7o e ao prazo inicialmente definidos;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">c) identifica\u00e7\u00e3o dos tipos de servi\u00e7os a executar e dos materiais e equipamentos a incorporar \u00e0 obra, bem como das suas especifica\u00e7\u00f5es, de modo a assegurar os melhores resultados para o empreendimento e a seguran\u00e7a executiva na utiliza\u00e7\u00e3o do objeto, para os fins a que se destina, considerados os riscos e os perigos identific\u00e1veis, sem frustrar o car\u00e1ter competitivo para a sua execu\u00e7\u00e3o;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">d) informa\u00e7\u00f5es que possibilitem o estudo e a defini\u00e7\u00e3o de m\u00e9todos construtivos, de instala\u00e7\u00f5es provis\u00f3rias e de condi\u00e7\u00f5es organizacionais para a obra, sem frustrar o car\u00e1ter competitivo para a sua execu\u00e7\u00e3o;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">e) subs\u00eddios para montagem do plano de licita\u00e7\u00e3o e gest\u00e3o da obra, compreendidos a sua programa\u00e7\u00e3o, a estrat\u00e9gia de suprimentos, as normas de fiscaliza\u00e7\u00e3o e outros dados necess\u00e1rios em cada caso;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">f) or\u00e7amento detalhado do custo global da obra, fundamentado em quantitativos de servi\u00e7os e fornecimentos propriamente avaliados, obrigat\u00f3rio exclusivamente para os regimes de execu\u00e7\u00e3o previstos nos <strong>incisos I, II, III, IV e VII do caput do art. 46<\/strong> desta Lei.<\/span><\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c014481 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"c014481\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-af5e9c4 elementor-widget elementor-widget-heading\" data-id=\"af5e9c4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termo de Refer\u00eancia ou Projeto B\u00e1sico Incompleto ou Inconsistente<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a720179 elementor-widget elementor-widget-text-editor\" data-id=\"a720179\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">O Termo de Refer\u00eancia ou Projeto B\u00e1sico, se incompleto ou inconsistente, ter\u00e1 conte\u00fado que n\u00e3o permitir\u00e1 que seja selecionada a proposta mais vantajosa para a Administra\u00e7\u00e3o, ou resultar\u00e1 em contrato sem mecanismos adequados para a gest\u00e3o contratual, com consequente desperd\u00edcio de recursos p\u00fablicos. Assim, \u00e9 importante que seja adotada pela <\/span><strong><a href=\"https:\/\/redelog.rj.gov.br\/redelog\/equipe-de-planejamento-da-contratacao\/\">Equipe de Planejamento<\/a><\/strong><span style=\"font-weight: 400;\"> uma lista de verifica\u00e7\u00e3o (checklist) para averiguar se o TR ou PB atenderam a todos os requisitos necess\u00e1rios.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ebaa46 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"3ebaa46\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-44323bb elementor-widget elementor-widget-heading\" data-id=\"44323bb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Questionamentos Quanto a Exig\u00eancias N\u00e3o Usuais<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-662bea3 elementor-widget elementor-widget-text-editor\" data-id=\"662bea3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">A previs\u00e3o de exig\u00eancias no edital, legais e leg\u00edtimas, mas n\u00e3o usuais, pode levar a questionamentos no certame (impugna\u00e7\u00f5es, recursos) e junto a \u00f3rg\u00e3os externos (poder judici\u00e1rio, TCE), com consequente paralisa\u00e7\u00e3o do certame at\u00e9 que a exig\u00eancia seja compreendida.<\/span><\/p><p><span style=\"font-weight: 400;\">A fim de mitigar tal risco, a Equipe de Planejamento da contrata\u00e7\u00e3o poder\u00e1 incluir refer\u00eancia aos dispositivos legais e\/ou jurisprud\u00eancia que fundamentem a inclus\u00e3o das exig\u00eancias que n\u00e3o
