documento que consolidar\u00e1 as defini\u00e7\u00f5es do processo licitat\u00f3rio e que apresentar\u00e1 as fundamenta\u00e7\u00f5es de cada escolha realizada.\n\n<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9166895 elementor-widget elementor-widget-text-editor\" data-id=\"9166895\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">As determina\u00e7\u00f5es do ETP servir\u00e3o para instruir o preenchimento da <a href=\"https:\/\/redelog.rj.gov.br\/redelog\/mapa-de-riscos\/?preview_id=27443&amp;preview_nonce=c3bc63af7d&amp;preview=true\"><strong>Mapa de Riscos<\/strong><\/a>, do <a href=\"https:\/\/redelog.rj.gov.br\/redelog\/termo-de-referencia-projeto-basico\/\"><strong>Termo de Refer\u00eancia<\/strong><\/a>, do <strong>Edital e Minuta de Contrato<\/strong>, o que requer conhecimentos sobre:<br \/>\u2022 A necessidade e a demanda<br \/>\u2022 As solu\u00e7\u00f5es existentes no mercado<br \/>\u2022 Transforma\u00e7\u00e3o das descri\u00e7\u00f5es do mercado para a solu\u00e7\u00e3o pretendida nas descri\u00e7\u00f5es de um objeto licit\u00e1vel<br \/>\u2022 Os conceitos jur\u00eddicos que dever\u00e3o constar do Edital e da minuta de contrato<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d8d0540 elementor-widget elementor-widget-image\" data-id=\"d8d0540\" data-element_type=\"widget\" conta dessa natureza ampla, o estudo deve ser elaborado por uma equipe de planejamento das contrata\u00e7\u00f5es com membros do setor demandante, do pr\u00f3prio setor de planejamento das contrata\u00e7\u00f5es (caso exista) e do setor de licita\u00e7\u00f5es.<\/span><\/p><p><span style=\"font-weight: 400;\">O respons\u00e1vel pela demanda n\u00e3o precisa conhecer profundamente a legisla\u00e7\u00e3o de compras p\u00fablicas, nem ter a <\/span><i><span style=\"font-weight: 400;\">expertise<\/span><\/i><span style=\"font-weight: 400;\"> para transformar uma necessidade numa solu\u00e7\u00e3o licit\u00e1vel.<\/span><\/p><p><span style=\"font-weight: 400;\">Por outro lado, o setor de licita\u00e7\u00e3o tamb\u00e9m n\u00e3o pode ficar respons\u00e1vel por compreender todas as necessidades da \u00e1rea demandante, sob o risco de contratar um objeto que n\u00e3o atender\u00e1 aos usu\u00e1rios, implicando em desperd\u00edcio de recursos p\u00fablicos.<\/span><\/p><p><span style=\"font-weight: 400;\">Com essa composi\u00e7\u00e3o multissetorial, a responsabilidade pelo desenho da contrata\u00e7\u00e3o \u00e9 compartilhada entre os atores essenciais e mitiga-se o risco de uma contrata\u00e7\u00e3o ineficaz.<\/span><\/p><p><span style=\"font-weight: 400;\">Adicionalmente, uma op\u00e7\u00e3o de instrumento para entender melhor o mercado,\u00a0 promover o di\u00e1logo com a sociedade e buscar solu\u00e7\u00f5es de quest\u00f5es que contenham interesse p\u00fablico relevante \u00e9 a realiza\u00e7\u00e3o de audi\u00eancias e consultas p\u00fablicas, nas hip\u00f3teses previstas no Art. 54. e 55 do Decreto 48.816\/23.<\/span><\/p><p><span style=\"font-weight: 400;\">Assim final da leitura do documento ETP, deve restar claro:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Qual foi a solu\u00e7\u00e3o escolhida para atender \u00e0 necessidade do setor demandante e o porqu\u00ea dessa decis\u00e3o.<\/span><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">O v\u00ednculo entre a necessidade do setor demandante, a solu\u00e7\u00e3o escolhida e o planejamento de compras do \u00f3rg\u00e3o\/entidade.<\/span><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Que vari\u00e1veis do cen\u00e1rio pol\u00edtico, econ\u00f4mico, social, tecnol\u00f3gico, legal e ambiental podem impactar a licita\u00e7\u00e3o, gerar riscos ou embasar a escolha da solu\u00e7\u00e3o. Essa \u00e9 a An\u00e1lise PESTLE, sigla em ingl\u00eas para Political, Economic, Social, Technological, Legal, Environmental.<\/span><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">O desenho t\u00e9cnico e jur\u00eddico da contrata\u00e7\u00e3o, especificando a dura\u00e7\u00e3o do contrato, a possibilidade de participa\u00e7\u00e3o de cooperativas, o parcelamento do objeto, entre outras quest\u00f5es.<\/span><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A viabilidade da contrata\u00e7\u00e3o.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Cada tipo de contrata\u00e7\u00e3o exigir\u00e1 um ETP com n\u00edvel de complexidade diferente. Uma simples aquisi\u00e7\u00e3o de mobili\u00e1rio n\u00e3o precisa de tantos embasamentos quanto uma contrata\u00e7\u00e3o de <\/span><i><span style=\"font-weight: 400;\">software<\/span><\/i><span style=\"font-weight: 400;\"> para apoiar a atividade final\u00edstica do \u00f3rg\u00e3o\/entidade.<\/span><\/p><p><span style=\"font-weight: 400;\">Por esta raz\u00e3o, s\u00e3o apresentados dois modelos diferentes de documentos, dependendo do tipo de contrata\u00e7\u00e3o a ser realizada.<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><b>ETP para Servi\u00e7os Continuados<\/b><span style=\"font-weight: 400;\">: Geralmente, estes s\u00e3o objetos com maior complexidade e exigem maior detalhamento das informa\u00e7\u00f5es. Por exemplo: Servi\u00e7os de Limpeza Predial.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>ETP para Bens ou Servi\u00e7os por escopo<\/b><span style=\"font-weight: 400;\">: Para aquisi\u00e7\u00f5es de bens ou de servi\u00e7os pontuais (por escopo) n\u00e3o h\u00e1 necessidade de aprofundamento de informa\u00e7\u00f5es, o que tornam desnecess\u00e1rios alguns dos itens exigidos para o ETP para Servi\u00e7os Continuados. Por exemplo: <\/span><span style=\"font-weight: 400;\">Aquisi\u00e7\u00e3o de garraf\u00e3o de 20 litros de \u00e1gua mineral<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Nem todos os t\u00f3picos de cada um dos modelos ser\u00e3o aplic\u00e1veis, mas \u00e9 imposs\u00edvel determinar <\/span><i><span style=\"font-weight: 400;\">a priori<\/span><\/i><span style=\"font-weight: 400;\"> o que deve ser informado em cada tipo de contrata\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Contudo, o ETP n\u00e3o pode deixar de cobrir o conte\u00fado m\u00ednimo determinado na legisla\u00e7\u00e3o vigente.<\/span><\/p><p><span style=\"font-weight: 400;\">Caso um t\u00f3pico seja evidentemente incompat\u00edvel com a contrata\u00e7\u00e3o pretendida, como, por exemplo, defini\u00e7\u00e3o do \u201cprazo de contrato\u201d para uma aquisi\u00e7\u00e3o de mobili\u00e1rio com entrega imediata, sugere-se manter o t\u00f3pico no documento e explicar que a informa\u00e7\u00e3o n\u00e3o \u00e9 aplic\u00e1vel ao caso concreto.<\/span><\/p><p><span style=\"font-weight: 400;\">Por outro lado, pode ser necess\u00e1rio estabelecer informa\u00e7\u00f5es que n\u00e3o est\u00e3o contempladas pelo modelo (tipo de documento dispon\u00edvel no SEI-RJ). N\u00e3o existe nenhuma veda\u00e7\u00e3o quanto ao acr\u00e9scimo de informa\u00e7\u00f5es que enrique\u00e7am o embasamento da contrata\u00e7\u00e3o.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Os exemplos de preenchimento <\/span><b>n\u00e3o<\/b><span style=\"font-weight: 400;\"> precisam ser seguidos \u00e0 risca e constam deste documento apenas para facilitar o entendimento de cada tem\u00e1tica.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-96a037d elementor-widget
