400;\"><del><strong>O\u00a0 GOVERNADOR DO ESTADO DO RIO DE JANEIRO<\/strong>, no uso das atribui\u00e7\u00f5es\u00a0<span style=\"font-weight: 400;\">constitucionais e legais, de acordo com o art. 1\u00ba do Decreto n\u00ba 47.680, de 12 de julho de 2021, e tendo em vista o que consta no Processo Administrativo n\u00ba SEI-120001\/001078\/2023<\/span>,<\/del><\/p><p style=\"font-weight: 400;\"><del><strong>CONSIDERANDO:\u00a0<\/strong><\/del><\/p><p style=\"font-weight: 400;\"><del>&#8211;\u00a0a Lei n\u00ba 14.133, de 1\u00ba de abril de 2021, que estabelece normas gerais de licita\u00e7\u00e3o e contrata\u00e7\u00e3o para as Administra\u00e7\u00f5es P\u00fablicas diretas, aut\u00e1rquicas e fundacionais da Uni\u00e3o, dos Estados, do Distrito Federal e dos Munic\u00edpios;<\/del><\/p><p style=\"font-weight: 400;\"><del>&#8211;\u00a0a necessidade de regulamenta\u00e7\u00e3o infralegal de diversos institutos da Nova Lei de Licita\u00e7\u00f5es e Contratos possibilitando sua aplica\u00e7\u00e3o efetiva;<\/del><\/p><p style=\"font-weight: 400;\"><del>&#8211;\u00a0a extens\u00e3o e complexidade das inova\u00e7\u00f5es legais, que demanda grande esfor\u00e7o de capacita\u00e7\u00e3o de centenas de servidores estaduais que atuam na \u00e1rea log\u00edstica;<\/del><\/p><p style=\"font-weight: 400;\"><del>&#8211;\u00a0a transi\u00e7\u00e3o do atual Sistema de Gest\u00e3o de Aquisi\u00e7\u00f5es &#8211; SIGA para o Sistema Compras.gov.br no \u00e2mbito do Estado do Rio de Janeiro, visando a melhor utiliza\u00e7\u00e3o das ferramentas oferecidas pela nova legisla\u00e7\u00e3o; e<\/del><\/p><p style=\"font-weight: 400;\"><del>&#8211;\u00a0o ex\u00edguo prazo para adequar todo o Sistema Log\u00edstico do Estado do Rio de Janeiro \u00e0 Nova Lei de Licita\u00e7\u00f5es e Contratos e seus regulamentos, de forma a n\u00e3o interromper os ciclos de contrata\u00e7\u00f5es em curso e o planejamento dos \u00f3rg\u00e3os e entidades estaduais.<\/del><\/p><p style=\"font-weight: 400;\"><del><strong>DECRETA:<\/strong><\/del><\/p><p style=\"font-weight: 400;\"><del><strong>Art. 1\u00ba.<\/strong>\u00a0\u00a0<span style=\"font-weight: 400;\">Este Decreto disp\u00f5e sobre o marco temporal de transi\u00e7\u00e3o para a aplica\u00e7\u00e3o integral do novo regime de licita\u00e7\u00f5es e contratos sob a \u00e9gide da Lei n\u00ba 14.133, de 1\u00ba de abril de 2021, e respectivos regulamentos estaduais.<\/span><\/del><\/p><p style=\"font-weight: 400;\"><del><strong>Art. 2\u00ba.\u00a0<\/strong>\u00a0<span style=\"font-weight: 400;\">Os \u00f3rg\u00e3os e entidades integrantes da Administra\u00e7\u00e3o Direta, aut\u00e1rquica e fundacional, inclusive os fundos especiais do Poder Executivo do Estado do Rio de Janeiro poder\u00e3o optar por licitar ou contratar diretamente com fundamento na Lei n\u00ba 8.666, de 21 de junho de 1993, na Lei n\u00ba 10.520, de 17 de julho de 2002, ou na Lei n\u00ba 12.462, de 4 de agosto de 2011, e respectivos regulamentos, nos processos em que a autoriza\u00e7\u00e3o da contrata\u00e7\u00e3o pela autoridade competente para in\u00edcio do procedimento for assinada no documento gerado e indexado no processo eletr\u00f4nico at\u00e9 o dia 31 de mar\u00e7o de 2023.<\/span><\/del><\/p><p><del><strong>Art. 2\u00ba<\/strong> &#8211; Os \u00f3rg\u00e3os e entidades integrantes da Administra\u00e7\u00e3o Direta, aut\u00e1rquica e fundacional, inclusive os fundos especiais do Poder Executivo do Estado do Rio de Janeiro poder\u00e3o optar por licitar ou contratar diretamente com fundamento na Lei n\u00ba 8.666, de 21 de junho de 1993, na Lei n\u00ba 10.520, de 17 de julho de 2002, ou na Lei n\u00ba 12.462, de 4 de agosto de 2011, e respectivos regulamentos, por meio de manifesta\u00e7\u00e3o expressa da autoridade competente, mediante assinatura eletr\u00f4nica no Sistema Eletr\u00f4nico de Informa\u00e7\u00f5es &#8211; SEI, at\u00e9 o dia 31 de mar\u00e7o de 2023. <a href=\"https:\/\/www.redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2023\/03\/Decreto-no-48.419-Altera-o-Decreto-no-48.375.pdf\">(Reda\u00e7\u00e3o dada pelo Decreto n\u00ba 48.419, de 2023)<\/a><\/del><\/p><p style=\"font-weight: 400;\"><del><strong><b>\u00a71\u00ba <\/b><span style=\"font-weight: 400;\">&#8211; Na hip\u00f3tese do caput deste artigo, o processo de contrata\u00e7\u00e3o ser\u00e1 regido pela legisla\u00e7\u00e3o de escolha da autoridade competente at\u00e9 o t\u00e9rmino da vig\u00eancia do contrato ou at\u00e9 a entrega definitiva do objeto.<\/span><\/strong><\/del><\/p><p style=\"font-weight: 400;\"><del><b>\u00a72\u00ba &#8211; <\/b>Os procedimentos enquadrados na hip\u00f3tese do caput ser\u00e3o processados eletronicamente por meio do Sistema Integrado de Gest\u00e3o de Aquisi\u00e7\u00f5es &#8211; SIGA.<\/del><\/p><p style=\"font-weight: 400;\"><del><strong>Art. 3\u00ba.<\/strong>\u00a0\u00a0<span style=\"font-weight: 400;\">O ato de autoriza\u00e7\u00e3o da contrata\u00e7\u00e3o de que trata o art. 2\u00ba deste Decreto dever\u00e1 observar o disposto no inciso VII do art. 10 e no art. 19, ambos do Decreto Estadual n\u00ba 46.642, de 17 de abril de 2019, e conter, ainda, os seguintes elementos:<\/span><\/del><\/p><p><del><strong><span style=\"font-weight: 400;\"><strong>I<\/strong> &#8211; indica\u00e7\u00e3o expressa da legisla\u00e7\u00e3o a ser aplicada;<\/span><\/strong><strong><span style=\"font-weight: 400;\">\u00a0<\/span><\/strong><\/del><\/p><p style=\"font-weight: 400;\"><del><strong><span style=\"font-weight: 400;\"><strong>II<\/strong> &#8211; justificativa da contrata\u00e7\u00e3o do objeto, indicando, conforme o caso:<\/span><\/strong><\/del><\/p><p><del><strong><span style=\"font-weight: 400;\"><strong>a)<\/strong> risco \u00e0 descontinuidade de servi\u00e7o prestado ao \u00f3rg\u00e3o ou entidade contratante;<\/span><\/strong><\/del><\/p><p><del><strong><span style=\"font-weight: 400;\"><strong>b)<\/strong> risco \u00e0 descontinuidade de programa de governo ou pol\u00edtica p\u00fablica; ou<\/span><\/strong><\/del><\/p><p><del><strong><span style=\"font-weight: 400;\"><strong>c)<\/strong> risco \u00e0 seguran\u00e7a de pessoas ou patrim\u00f4nio.<\/span><\/strong><\/del><\/p><p style=\"font-weight: 400;\"><del><b>Par\u00e1grafo \u00fanico. <\/b><span style=\"font-weight: 400;\">Nos processos em tr\u00e2mite em que a autoriza\u00e7\u00e3o da contrata\u00e7\u00e3o n\u00e3o tenha preenchido os requisitos do caput deste artigo, admitir-se-\u00e1, por meio de ato apartado da autoridade competente, a complementa\u00e7\u00e3o da autoriza\u00e7\u00e3o anteriormente conferida, desde que isso ocorra at\u00e9 31 de mar\u00e7o de 2023, para fins de incid\u00eancia da regra de transi\u00e7\u00e3o do art. 2\u00ba deste Decreto<\/span><strong><span style=\"font-weight: 400;\">.<\/span><\/strong><\/del><\/p><p><del><strong>Art. 3\u00ba<\/strong> &#8211; A manifesta\u00e7\u00e3o da autoridade competente, de que trata o art. 2\u00ba, dever\u00e1 se dar na fase interna de contrata\u00e7\u00e3o, por meio de documento gerado e indexado no respectivo processo administrativo eletr\u00f4nico de contrata\u00e7\u00e3o. <a href=\"https:\/\/www.redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2023\/03\/Decreto-no-48.419-Altera-o-Decreto-no-48.375.pdf\">(Reda\u00e7\u00e3o dada pelo Decreto n\u00ba 48.419, de 2023)<\/a><\/del><\/p><p style=\"font-weight: 400;\"><del><strong>Art. 4\u00ba.\u00a0<\/strong>\u00a0\u00a0<span style=\"font-weight: 400;\">Quando a Administra\u00e7\u00e3o optar por realizar licita\u00e7\u00e3o para registro de pre\u00e7os, com fundamento na Lei n\u00ba 8.666, de 21 de junho de 1993, ou na Lei n\u00ba 10.520, de 17 de julho de 2002, e respectivos regulamentos, a Ata de Registro de Pre\u00e7os gerada continuar\u00e1 v\u00e1lida durante toda a sua vig\u00eancia, que ser\u00e1 de no m\u00e1ximo 12 (doze) meses, inclu\u00eddas eventuais prorroga\u00e7\u00f5es, sendo poss\u00edvel firmar as contrata\u00e7\u00f5es decorrentes desta ARP, mesmo ap\u00f3s a revoga\u00e7\u00e3o das referidas Leis.<\/span><\/del><\/p><p style=\"font-weight: 400;\"><del><strong>Art. 5\u00ba.<\/strong>\u00a0<span style=\"font-weight: 400;\">Os editais de licita\u00e7\u00e3o e os extratos das ratifica\u00e7\u00f5es de contrata\u00e7\u00e3o direta de que trata o artigo 2\u00b0 deste Decreto dever\u00e3o, obrigatoriamente, ser publicados no Di\u00e1rio Oficial do Estado do Rio de Janeiro at\u00e9 o dia 30 de setembro de 2023. <\/span><\/del><\/p><p><del><strong>Art. 5\u00ba<\/strong> &#8211; Os editais de licita\u00e7\u00e3o e os extratos das ratifica\u00e7\u00f5es de contrata\u00e7\u00e3o direta de que trata o artigo 2\u00b0 deste Decreto dever\u00e3o, obrigatoriamente, ser publicados no Di\u00e1rio Oficial do Estado do Rio de Janeiro at\u00e9 o dia 31 de dezembro de 2023. <a
