class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>O\u202fGOVERNADOR DO ESTADO DO RIO DE JANEIRO<\/strong>, no uso de suas atribui\u00e7\u00f5es constitucionais e legais, tendo em vista o disposto no Decreto n\u00ba 47.680 de 12 de julho de 2021, e no art. 20 da Lei Federal n\u00ba 14.133, de 1\u00ba de abril de 2021, e consoante os termos do Processo Administrativo n\u00ba SEI-120001\/015210\/2021,\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>DECRETA:<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Objeto e \u00e2mbito de aplica\u00e7\u00e3o\u00a0<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Art. 1\u00ba<\/strong>\u00a0-\u202fEste Decreto disp\u00f5e sobre o enquadramento dos bens de consumo, adquiridos para suprir as demandas das estruturas da administra\u00e7\u00e3o p\u00fablica estadual, nas categorias de qualidade comum e de luxo. \u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>\u00a71\u00ba\u202f<\/strong>As disposi\u00e7\u00f5es deste Decreto aplicam-se \u00e0s contrata\u00e7\u00f5es realizadas por outros entes federativos que utilizem recursos do Estado oriundos de transfer\u00eancias volunt\u00e1rias, desde que previstas no instrumento que formaliza a transfer\u00eancia.\u00a0\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>\u00a72\u00ba<\/strong>\u00a0As contrata\u00e7\u00f5es realizadas por empresas estatais dever\u00e3o observar a Lei n\u00b0 13.303, de 30 de junho de 2016, e os respectivos regulamentos internos de licita\u00e7\u00f5es e contratos, sem preju\u00edzo da aplica\u00e7\u00e3o subsidi\u00e1ria do presente Decreto, no que for compat\u00edvel.\u00a0\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Defini\u00e7\u00f5es\u00a0<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\"><strong>Art. 2\u00ba\u00a0<\/strong>-\u202fPara efeito deste Decreto, considera-se bem de consumo todo material que atenda a, pelo menos, um dos crit\u00e9rios a seguir:\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>I\u00a0<\/strong>&#8211; \u00a0durabilidade: quando, em uso normal, perde ou tem reduzidas as suas condi\u00e7\u00f5es de funcionamento, no prazo m\u00e1ximo de 2 (dois) anos;\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>II<\/strong>\u00a0&#8211; fragilidade: possui estrutura sujeita a modifica\u00e7\u00e3o, por ser quebradi\u00e7o ou deform\u00e1vel, caracterizando-se pela irrecuperabilidade e\/ou perda de sua identidade;\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>III\u00a0<\/strong>&#8211; perecibilidade: quando sujeito a modifica\u00e7\u00f5es qu\u00edmicas ou f\u00edsicas, deteriora-se ou perde suas caracter\u00edsticas normais de uso;\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>IV<\/strong>\u00a0&#8211; \u00a0incorporabilidade: quando destinado \u00e0 incorpora\u00e7\u00e3o a outro bem, n\u00e3o podendo ser retirado sem preju\u00edzo das caracter\u00edsticas do principal; e\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>V<\/strong>\u00a0&#8211; transformabilidade: quando adquirido para fins de transforma\u00e7\u00e3o.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\"><strong>Par\u00e1grafo \u00danico:<\/strong>\u202fDemais crit\u00e9rios advindos de atualiza\u00e7\u00f5es das normas brasileiras de contabilidade aplicada ao Setor P\u00fablico dever\u00e3o ser observados para fins de enquadramento dos bens de consumo.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Art. 3\u00ba -\u202fNo enquadramento dos bens de consumo as seguintes defini\u00e7\u00f5es ser\u00e3o consideradas:\u00a0<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>I<\/strong>\u00a0&#8211; artigo de qualidade comum: bem de consumo que atenda\u202festritamente \u00e0s caracter\u00edsticas t\u00e9cnicas e funcionais necess\u00e1rias para o atendimento da demanda identificada; \u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>II<\/strong>\u00a0&#8211; artigo de luxo: bem de consumo que supera as caracter\u00edsticas t\u00e9cnicas e funcionais necess\u00e1rias ao atendimento da demanda identificada, de qualidade desnecessariamente requintada, dispens\u00e1vel ao adequado funcionamento da Administra\u00e7\u00e3o, e identific\u00e1vel por meio de caracter\u00edsticas tais como ostenta\u00e7\u00e3o, opul\u00eancia, forte apelo est\u00e9tico ou requinte; e\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>III<\/strong>\u00a0&#8211; Documento de Formaliza\u00e7\u00e3o da Demanda: identifica a demanda\/necessidade a ser atendida, contendo descri\u00e7\u00f5es preliminares sobre o objeto.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>\u00a7 1\u00ba<\/strong>&#8211; \u00c9 vedada a aquisi\u00e7\u00e3o de bens de luxo.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>\u00a7 2\u00ba<\/strong>\u00a0&#8211; A aquisi\u00e7\u00e3o de bens que esteja dentro do limite de valor de dispensa de licita\u00e7\u00e3o previsto no art. 75, inciso II da Lei n\u00ba 14.133, de 1\u00ba de abril de 2021, n\u00e3o afasta a possibilidade de enquadramento como artigos de luxo.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>\u00a7 3\u00ba<\/strong>\u00a0&#8211; N\u00e3o ser\u00e1 considerado como artigo de luxo aquele que, mesmo enquadrado na defini\u00e7\u00e3o do inciso II do\u202fcaput\u202fdeste artigo:\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>I<\/strong>\u00a0&#8211; for adquirido a pre\u00e7o equivalente ou inferior ao pre\u00e7o do artigo de qualidade comum similar; ou\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>II<\/strong>\u00a0&#8211; tenha as caracter\u00edsticas superiores justificadas em face da estrita atividade do \u00f3rg\u00e3o ou da entidade.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Art. 4\u00ba<\/strong>\u202f- O enquadramento dos bens constantes do Documento da Formaliza\u00e7\u00e3o da Demanda &#8211; DFD dever\u00e1 ser realizado pela equipe de planejamento da contrata\u00e7\u00e3o.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Par\u00e1grafo \u00danico<\/strong>\u202f\u2013 Na hip\u00f3tese de identifica\u00e7\u00e3o de demandas por bens de consumo de luxo, os DFDs retornar\u00e3o aos setores requisitantes para supress\u00e3o ou substitui\u00e7\u00e3o dos bens demandados.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Disposi\u00e7\u00f5es Finais\u00a0<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\"><strong>Art. 5\u00ba<\/strong>\u00a0-\u202fOs casos omissos decorrentes da aplica\u00e7\u00e3o deste Decreto ser\u00e3o dirimidos pelo \u00d3rg\u00e3o Central do Sistema Log\u00edstico.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Art. 6\u00ba<\/strong>\u202f- O \u00d3rg\u00e3o Central do Sistema Log\u00edstico poder\u00e1 editar regulamenta\u00e7\u00f5es e orienta\u00e7\u00f5es complementares ao cumprimento deste Decreto.\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\">\u00a0<\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\"><strong>Vig\u00eancia\u00a0<\/strong><\/p><p class=\"Texto_Justificado_Recuo_Primeira_Linha\" xml:lang=\"PT-BR\"><strong>Art.\u202f7\u00ba<\/strong>\u00a0-\u202fEste Decreto entra em vigor na data de sua publica\u00e7\u00e3o.<\/p><p style=\"text-align: center;\">Rio de Janeiro, 13 de janeiro
