san\u00e7\u00f5es, isso porque algumas pr\u00e1ticas j\u00e1 realizadas na Lei 10.520\/2002 e Lei 12.462\/2011, foram implantadas, assim como a incorpora\u00e7\u00e3o do rol de infra\u00e7\u00f5es da Lei <\/span><span style=\"font-weight: 400;\">12.846\/2013. Desta forma, a nova legisla\u00e7\u00e3o trata das infra\u00e7\u00f5es e san\u00e7\u00f5es administrativas, no t\u00edtulo IV, que trata das irregularidades, disposto no art. 155 a diverg\u00eancias que eram debatidas na legisla\u00e7\u00e3o anterior.<\/span><\/p><p><span style=\"font-weight: 400;\">No que tange a nova legisla\u00e7\u00e3o e suas inova\u00e7\u00f5es, \u00e9 sabido a condi\u00e7\u00e3o estabelecida de <\/span><b>assessoramento da assessoria jur\u00eddica e controle interno<\/b><span style=\"font-weight: 400;\">, o que viabiliza uma a\u00e7\u00e3o mais assertiva por parte do gestor do contrato na ocorr\u00eancia de uma ou mais infra\u00e7\u00f5es, por parte do contratado. Em que pese a legisla\u00e7\u00e3o trazer expresso a necessidade de an\u00e1lise jur\u00eddica em apenas uma das san\u00e7\u00f5es \u00e9 aconselh\u00e1vel o uso da prerrogativa dispon\u00edvel.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre a nova lei, outro ponto de destaque \u00e9 a <\/span><b>obrigatoriedade da publicidade<\/b><span style=\"font-weight: 400;\"> das san\u00e7\u00f5es, que atrelado ao princ\u00edpio da publicidade e transpar\u00eancia, o legislador estabelece que no <\/span><b>prazo m\u00e1ximo de 15 (quinze) dias \u00fateis,<\/b><span style=\"font-weight: 400;\"> a contar da aplica\u00e7\u00e3o da san\u00e7\u00e3o, dever\u00e1 ser dada a publicidade no Cadastro Nacional de Empresas Inid\u00f4neas e Suspensas (Ceis) e no Cadastro Nacional de Empresas Punidas (Cnep), institu\u00eddos no \u00e2mbito do Poder Executivo federal.<\/span><\/p><p><span style=\"font-weight: 400;\">No \u00e2mbito da an\u00e1lise para aplica\u00e7\u00e3o das san\u00e7\u00f5es ser\u00e3o considerados os crit\u00e9rios abaixo, bem como o balizamento com base no princ\u00edpio da razoabilidade e par\u00e1grafo \u00fanico do art. 161, da Lei 14.133\/2023, determina a regulamenta\u00e7\u00e3o por parte do Poder Executivo para estabelecer a forma de c\u00f4mputo e as consequ\u00eancias da soma de diversas san\u00e7\u00f5es aplicadas a uma mesma empresa e derivadas de contratos distintos.<\/span><\/p><p><span style=\"font-weight: 400;\">Antes de adentrar nas san\u00e7\u00f5es propriamente ditas, vale destacar que a aplica\u00e7\u00e3o destas n\u00e3o exime, em hip\u00f3tese alguma, a obriga\u00e7\u00e3o de repara\u00e7\u00e3o integral do dano causado \u00e0 Administra\u00e7\u00e3o P\u00fablica.<\/span><\/p><p><span style=\"font-weight: 400;\">Isto posto, inicialmente, ser\u00e3o apresentadas as san\u00e7\u00f5es de acordo com o art. 156, da Lei 14.133\/2023, no entanto \u00e9 importante destacar que os procedimentos para tal ser\u00e3o regulamentados pelo Poder Executivo.<\/span><\/p><ul><li aria-level=\"1\"><b>Advert\u00eancia<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">Considerada a san\u00e7\u00e3o mais branda, advert\u00eancia ocorrer\u00e1 quando houver a inexecu\u00e7\u00e3o parcial do objeto por parte do contratado, desta forma a Administra\u00e7\u00e3o poder\u00e1 unilateralmente aplicar a advert\u00eancia.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><b>Multa<\/b><\/li><\/ul><p><b>Multa Compensat\u00f3ria\u00a0<\/b><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8068069 aplic\u00e1vel a todos os atos de infra\u00e7\u00e3o, podendo tamb\u00e9m ser cumulativa com outra san\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Conforme exposto na ilustra\u00e7\u00e3o, a multa dever\u00e1 estar expressa no edital ou no contrato, n\u00e3o podendo o c\u00e1lculo n\u00e3o ser inferior a 0,5% (cinco d\u00e9cimos por cento) ou superior a 30% (trinta por cento) do valor do contrato licitado ou celebrado com contrata\u00e7\u00e3o direta, sob a consequ\u00eancia de n\u00e3o aplica\u00e7\u00e3o na execu\u00e7\u00e3o do contrato.<\/span><\/p><p><span style=\"font-weight: 400;\">Destaca-se que a Lei traz o procedimento para aplica\u00e7\u00e3o da multa, de modo que ocorrendo a infra\u00e7\u00e3o, verificada a necessidade de emprego da multa, o contratado ser\u00e1 intimado e ter\u00e1 15 (quinze) dias \u00fateis para defesa, sendo aqui evidenciado o princ\u00edpio do devido processo legal, garantindo o contradit\u00f3rio e ampla defesa.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 importante ao determinado no \u00a78\u00ba do art. 156, tendo em vista que dependendo do valor a ser descontado da garantia, poder\u00e1 incorrer em preju\u00edzo na execu\u00e7\u00e3o do contrato, uma vez que o contratado corre o risco de n\u00e3o ter recursos suficientes para arcar com a parcela remanescente.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0510127 elementor-widget elementor-widget-image\" data-id=\"0510127\" poss\u00edvel a aplica\u00e7\u00e3o da multa de mora, prevista no art. 162, da Lei 14.133\/2023, quando prevista no edital ou no contrato.<\/span><\/p><p><span style=\"font-weight: 400;\">A multa de mora difere da multa compensat\u00f3ria, tendo em vista que esta ocorre quando o contratado atrasar de maneira injustificada o cumprimento do contrato.<\/span><\/p><p><b>O que fazer quando o dever\u00e1 por meio de processo administrativo, atentando ao devido processo legal, promovendo o contradit\u00f3rio e ampla defesa, para assim realizar a apura\u00e7\u00e3o e cobran\u00e7a da multa.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 importante destacar que a Administra\u00e7\u00e3o reconhecendo que o atraso tornou-se um inadimplemento, esta multa de atraso poder\u00e1 ser convertida em multa compensat\u00f3ria, tendo em vista caracterizar o descumprimento das obriga\u00e7\u00f5es contratuais.<\/span><\/p><ul><li aria-level=\"1\"><b>\u00a0Impedimento de class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">O impedimento de licitar e contratar \u00e9 aplic\u00e1vel \u00e0s penas de m\u00e9dia gravidade, apresentadas nos incisos II a VII do art. 155, da Lei 14.133\/2021, no entanto na execu\u00e7\u00e3o do contrato cabe destacar os seguintes incisos.<\/span><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; dar causa \u00e0 inexecu\u00e7\u00e3o parcial do contrato que cause grave dano \u00e0 Administra\u00e7\u00e3o, ao funcionamento dos servi\u00e7os p\u00fablicos ou ao interesse coletivo;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III &#8211; dar causa \u00e0 inexecu\u00e7\u00e3o total do contrato;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">V &#8211; n\u00e3o manter a proposta, salvo em decorr\u00eancia de fato superveniente devidamente justificado;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VII &#8211; ensejar o retardamento da execu\u00e7\u00e3o ou da entrega do objeto da licita\u00e7\u00e3o sem motivo justificado;<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">A nova Lei <\/span>14.133\/2023, no \u00a74\u00ba, do art. 156, deixa expl\u00edcito que o respons\u00e1vel pela infra\u00e7\u00e3o n\u00e3o poder\u00e1 contratar ou licitar com a Administra\u00e7\u00e3o P\u00fablica direta e indireta do ente federativo que tiver aplicado a san\u00e7\u00e3o, no prazo m\u00e1ximo de 3 (tr\u00eas) anos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6b2f46a licitar a declara\u00e7\u00e3o de inidoneidade, consiste em pena restritiva de direitos, no entanto neste cen\u00e1rio a proibi\u00e7\u00e3o \u00e9 de realizar neg\u00f3cios como Poder P\u00fablico em <\/span><b>GERAL<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Diante da peculiaridade, a aplica\u00e7\u00e3o desta san\u00e7\u00e3o ser\u00e1 precedida de an\u00e1lise jur\u00eddica, sendo observado regra de compet\u00eancia para aplica\u00e7\u00e3o da san\u00e7\u00e3o, de modo que a autoridade de n\u00edvel hier\u00e1rquico mais alto, conforme inciso I e II do \u00a7 6\u00ba da Lei 14.133\/2021.<\/span><\/p><p><span style=\"font-weight: 400;\">Destaca-se que a declara\u00e7\u00e3o de inidoneidade poder\u00e1 ter dura\u00e7\u00e3o de no m\u00ednimo 3 (tr\u00eas) anos e no m\u00e1ximo 6 (seis) anos.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 imprescind\u00edvel mencionar que as infra\u00e7\u00f5es apresentadas nos incisos II a VII do art. 155, da Lei 14.133, mediante justificativa poder\u00e3o ser aplicadas a san\u00e7\u00e3o de declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p><ul><li aria-level=\"1\"><b>Aplica\u00e7\u00e3o das San\u00e7\u00f5es<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">Identificadas as infra\u00e7\u00f5es e as respectivas san\u00e7\u00f5es, caber\u00e1 aos agentes da execu\u00e7\u00e3o a ci\u00eancia do fato e a promo\u00e7\u00e3o dos tr\u00e2mites, respeitando o devido processo legal, garantindo \u00e0 contratada o contradit\u00f3rio e ampla defesa, sendo de<\/span><span style=\"font-weight: 400;\"> responsabilidade da autoridade competente superior a aplica\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Dentre as san\u00e7\u00f5es dispon\u00edveis (art. 156) para as infra\u00e7\u00f5es apresentadas (art. 155), o legislador inova ao trazer procedimentos espec\u00edficos para os incisos II, III e IV do art. 156, ou seja, multa, impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p><p><span style=\"font-weight: 400;\">Desta forma, se a contratada incorrer em condutas cuja san\u00e7\u00e3o seja multa (art. 156, II), respeitando a correta instru\u00e7\u00e3o processual, ser\u00e1 facultado ao interessado a defesa no prazo de 15 (quinze) \u00fateis.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre as san\u00e7\u00f5es, os incisos III e IV do art. 156, o legislador traz particularidades. Confira na sequ\u00eancia.<\/span><\/p><p><b>Processo de Responsabiliza\u00e7\u00e3o<\/b><\/p><p><span style=\"font-weight: 400;\">Em que pese o tr\u00e2mite usual para apura\u00e7\u00e3o e aplica\u00e7\u00e3o de san\u00e7\u00e3o, a nova lei de licita\u00e7\u00f5es e contratos traz como inova\u00e7\u00e3o um procedimento espec\u00edfico para as infra\u00e7\u00f5es que trata nos incisos III e IV do caput do art. 156 desta Lei, ou seja, impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p><p><span style=\"font-weight: 400;\">A partir do art. 158, a lei determina que instaura\u00e7\u00e3o de processo de responsabiliza\u00e7\u00e3o dever\u00e1 ser conduzido por comiss\u00e3o composta por 2 (dois) ou mais empregados\/servidores p\u00fablicos pertencentes aos seus quadros permanentes, preferencialmente com, no m\u00ednimo, 3 (tr\u00eas) anos de tempo de servi\u00e7o no \u00f3rg\u00e3o ou entidade.<\/span><\/p><p><b>Das provas<\/b><\/p><p><span style=\"font-weight: 400;\">Instaurado o processo, analisado os fatos e circunst\u00e2ncias, ser\u00e1 promovida a intima\u00e7\u00e3o da contratada para apresenta\u00e7\u00e3o, em 15 (quinze) dias \u00fateis, da defesa e especifica\u00e7\u00e3o das provas que pretende produzir.<\/span><\/p><p><span style=\"font-weight: 400;\">Sendo manifestado o interesse em produzir as provas, a comiss\u00e3o poder\u00e1:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Deferir o pedido viabilizando a produ\u00e7\u00e3o de novas provas ou juntada das existentes.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indeferir, mediante decis\u00e3o fundamentada, se as provas forem consideradas il\u00edcitas, impertinentes, desnecess\u00e1rias, protelat\u00f3rias ou intempestivas.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00c9 importante frisar que a comiss\u00e3o possui a prerrogativa de produ\u00e7\u00e3o ou juntada de provas que julgue indispens\u00e1veis para condu\u00e7\u00e3o do processo.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Produzida ou juntada \u00e0s provas, poder\u00e1 o contratante apresentar alega\u00e7\u00f5es finais no prazo de 15 (quinze) dias \u00fateis, a partir da intima\u00e7\u00e3o.<\/span><\/p><p><b>Da prescri\u00e7\u00e3o<\/b><\/p><p><span style=\"font-weight: 400;\">A Lei, no \u00a7 4\u00ba do art. 158, menciona o prazo prescricional na apura\u00e7\u00e3o da responsabilidade das infra\u00e7\u00f5es que deem ensejo \u00e0s san\u00e7\u00f5es de <span style=\"text-decoration: underline;\">impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element destacar, que a desconsidera\u00e7\u00e3o da personalidade jur\u00eddica consiste na quebra da barreira entre a pessoa jur\u00eddica e seus s\u00f3cios e administradores, de modo que ser\u00e1 d<\/span><span style=\"font-weight: 400;\">esconsiderada a pessoa jur\u00eddica e adentrado ao patrim\u00f4nio dos s\u00f3cios e administradores para satisfa\u00e7\u00e3o da Administra\u00e7\u00e3o P\u00fablica que sofreu a infra\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Partindo deste entendimento, buscando a efetividade das san\u00e7\u00f5es administrativas, o legislador traz no art. 160, apresenta as circunst\u00e2ncias em que ser\u00e1 desconsiderada a personalidade jur\u00eddica, bem como a extens\u00e3o dos seus efeitos, sendo enfatizado a observ\u00e2ncia do devido processo legal e a an\u00e1lise pr\u00e9via do jur\u00eddico.<\/span><span style=\"font-weight:
