ser pr\u00e9-estabelecida na fase preparat\u00f3ria do processo licitat\u00f3rio, sendo determinadas as especifica\u00e7\u00f5es da execu\u00e7\u00e3o, modelo de gest\u00e3o, pagamento e as condi\u00e7\u00f5es de recebimento, no que tange aos locais de entrega dos produtos e das regras para recebimentos provis\u00f3rio e definitivo, quando for o caso.<\/span><\/p><p><span style=\"font-weight: 400;\">Com isso, a nova Lei de Licita\u00e7\u00f5es e Contratos estabelece que \u00e9 necess\u00e1rio que todos os contratos possuam cl\u00e1usulas que estabele\u00e7am os prazos de in\u00edcio das etapas de execu\u00e7\u00e3o, conclus\u00e3o, entrega, observa\u00e7\u00f5es e recebimento definitivo, quando couber.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre a nova lei, \u00e9 importante destacar a flexibilidade para os procedimentos e prazos de recebimento, n\u00e3o tendo sido estabelecido tempo ou modelo no texto normativo, no entanto se torna indispens\u00e1vel a aplica\u00e7\u00e3o dos princ\u00edpios da razoabilidade e proporcionalidade na elabora\u00e7\u00e3o dos instrumentos servi\u00e7os ou de compras, uma vez que ambos envolvem procedimentos realizados em duas etapas, ou seja, a elabora\u00e7\u00e3o de termos de recebimento provis\u00f3rio e definitivo, cujas particularidades ser\u00e3o apresentadas.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b1a774 elementor-widget href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong><em> inciso I, do art. 140, da Lei 14.133\/2023<\/em><\/strong><\/a>, traz os instrumentos a serem preenchidos, bem como o conte\u00fado e os respons\u00e1veis pela elabora\u00e7\u00e3o.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u00a0Recebimento Provis\u00f3rio<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">O recebimento provis\u00f3rio ser\u00e1 realizado pelo respons\u00e1vel da fiscaliza\u00e7\u00e3o e acompanhamento do contrato, mediante termo detalhado, quando verificado o cumprimento das exig\u00eancias de car\u00e1ter t\u00e9cnico, de forma parcial ou total.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 importante destacar que, em se tratando de contrata\u00e7\u00f5es com entregas parciais, os pagamentos ser\u00e3o realizados a cada medi\u00e7\u00e3o das etapas estabelecidas, sendo elaborados termos de recebimento provis\u00f3rio at\u00e9 a sua conclus\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Com isso, n\u00e3o sendo evidenciados ou sanados v\u00edcios, omiss\u00f5es ou desconformidades constatadas, o termo provis\u00f3rio ser\u00e1 assinado pelas partes, transferindo a posse do objeto \u00e0 Administra\u00e7\u00e3o. E, se tratando a \u00faltima etapa da execu\u00e7\u00e3o contratual, ser\u00e1 iniciada a fase de recebimento definitivo.<\/span><\/p><ul><li aria-level=\"1\"><b>Recebimento Definitivo<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">O recebimento definitivo ser\u00e1 realizado por servidor ou comiss\u00e3o designada pela autoridade competente, mediante termo detalhado que comprove o atendimento das exig\u00eancias contratuais.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32b0273
