contratuais encontram-se apresentadas no art. 96 a 102, da Lei 14.133\/2021, embora a n\u00e3o obrigatoriedade, quando necess\u00e1ria, dever\u00e1 ter previs\u00e3o no edital, conforme determinado no<\/span><i><span style=\"font-weight: 400;\"> caput<\/span><\/i><span style=\"font-weight: 400;\"> do art. 96.<\/span><\/p><p><span style=\"font-weight: 400;\">Caso prevista a garantia, \u00e9 importante destacar que se ocorrer a suspens\u00e3o do contrato por ordem ou inadimplemento da Administra\u00e7\u00e3o, o contratado ficar\u00e1 desobrigado de renovar a garantia ou endossar a ap\u00f3lice de seguro at\u00e9 a ordem de rein\u00edcio da execu\u00e7\u00e3o ou o adimplemento pela Administra\u00e7\u00e3o.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>Percentual atribu\u00eddo \u00e0s garantias:<\/b><\/p><p><span style=\"font-weight: 400;\">Nesta linha, as contrata\u00e7\u00f5es de obras, servi\u00e7os e fornecimento ter\u00e3o percentual de garantia atribu\u00eddo de acordo com a especificidade do objeto.<\/span><\/p><ul><li><b>At\u00e9 5%:<\/b><span style=\"font-weight: 400;\"> \u00c9 a regra geral utilizada quando verificada a necessidade de garantia.<\/span><\/li><li aria-level=\"1\"><b>At\u00e9 10%: <\/b><span style=\"font-weight: 400;\">Consiste na majora\u00e7\u00e3o do percentual anterior, que ser\u00e1 alterado mediante a apresenta\u00e7\u00e3o de justificativa, ap\u00f3s a an\u00e1lise t\u00e9cnica e dos riscos envolvidos.<\/span><\/li><li aria-level=\"1\"><b>At\u00e9 30%: <\/b><span style=\"font-weight: 400;\">Aplic\u00e1vel nas contrata\u00e7\u00f5es de obras e servi\u00e7os de engenharia de grande vulto, ou seja, montante que supere R$ 200.000.000,00 (duzentos milh\u00f5es de reais).<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Isto posto, \u00e9 importante ressaltar que a escolha do tipo de garantia \u00e9 discricion\u00e1ria do particular, no entanto se torna imprescind\u00edvel conhecer as suas modalidades e a aplicabilidade.<\/span><\/p><ul><li aria-level=\"1\"><b>Cau\u00e7\u00e3o<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">Definido no inciso I, do art. 96, o cau\u00e7\u00e3o em dinheiro ou em t\u00edtulos da d\u00edvida p\u00fablica, dever\u00e1 seguir cumprir as caracter\u00edsticas definidas na lei, ou seja,\u00a0 ser emitidos sob a forma escritural, ter registro em sistema centralizado de liquida\u00e7\u00e3o e de cust\u00f3dia autorizado pelo Banco Central do Brasil, e ser avaliados por seus valores econ\u00f4micos, de acordo com a defini\u00e7\u00e3o do Minist\u00e9rio da Economia.<\/span><\/p><ul><li aria-level=\"1\"><b>Seguro-garantia<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">O seguro-garantia que busca garantir o fiel cumprimento das obriga\u00e7\u00f5es assumidas pelo contratado perante \u00e0 Administra\u00e7\u00e3o, inclusive as multas, os preju\u00edzos e as indeniza\u00e7\u00f5es decorrentes de inadimplemento, devendo seguir os par\u00e2metros estabelecidos nos <em><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>incisos I e II do art. 97 da Lei 14.133\/2021.<\/strong><\/a><\/em><\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 sabido que caber\u00e1 ao particular a escolha da modalidade de garantia, no entanto, se a escolhida for o seguro-garantia, o prazo para apresenta\u00e7\u00e3o desta estar\u00e1 fixada no edital, sendo de no m\u00ednimo de 1 (um) m\u00eas, contado da data de homologa\u00e7\u00e3o da licita\u00e7\u00e3o e anterior \u00e0 assinatura do contrato.<\/span><\/p><p><b>Da substitui\u00e7\u00e3o da ap\u00f3lice:<\/b><\/p><p><span style=\"font-weight: 400;\">Conforme exposto no par\u00e1grafo \u00fanico do art. 97, \u00e9 permitida a substitui\u00e7\u00e3o da ap\u00f3lice de seguro-garantia na data de renova\u00e7\u00e3o ou de anivers\u00e1rio, nos contratos de execu\u00e7\u00e3o continuada ou de fornecimento cont\u00ednuo de bens e servi\u00e7os, <\/span><span style=\"font-weight: 400;\">desde que mantidas as mesmas condi\u00e7\u00f5es e coberturas da ap\u00f3lice vigente e desde que nenhum per\u00edodo fique descoberto<\/span><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre o seguro-garantia, a nova lei traz inova\u00e7\u00e3o com a possibilidade do edital para contrata\u00e7\u00e3o de obras e servi\u00e7os de engenharia de grande vulto a determina\u00e7\u00e3o da cl\u00e1usula de retomada.<\/span><\/p><p><b>Cl\u00e1usula de Retomada<\/b><\/p><p><span style=\"font-weight: 400;\">A cl\u00e1usula de retomada corresponde \u00e0 determina\u00e7\u00e3o estabelecida no edital, com percentual de at\u00e9 30% (trinta por cento) do valor inicial do contrato, para que a seguradora, no caso de inadimplemento da contratada, assuma o t\u00e9rmino da obra.<\/span><\/p><p><span style=\"font-weight: 400;\">A novidade tem como escopo resguardar o interesse p\u00fablico na execu\u00e7\u00e3o contratual, de modo que incorrendo o contratado no inadimplemento a seguradora assumir\u00e1, tendo como prerrogativa subcontratar parcialmente ou totalmente.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre esta cl\u00e1usula \u00e9 imprescind\u00edvel frisar que a seguradora figurar\u00e1 como interveniente anuente, ou seja, esta dever\u00e1 concordar com todos os termos do contrato, uma vez que h\u00e1 a possibilidade de assumi-lo.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Na execu\u00e7\u00e3o do contrato, incorrendo a contratada para aplica\u00e7\u00e3o da cl\u00e1usula, a seguradora poder\u00e1 assumir ou n\u00e3o a contrata\u00e7\u00e3o devendo ser observado:<\/span><\/p><ul><li aria-level=\"1\"><b>Se a seguradora seguir com a execu\u00e7\u00e3o, dever\u00e1 ser verificado:<\/b><\/li><\/ul><ol><li><span style=\"font-weight: 400;\">Se a pr\u00f3pria assumiu a contrata\u00e7\u00e3o; ou<\/span><\/li><li><span style=\"font-weight: 400;\">Se houve subcontrata\u00e7\u00e3o parcial ou total para execu\u00e7\u00e3o do contrato; e<\/span><\/li><li><span style=\"font-weight: 400;\">A emiss\u00e3o da nota de empenho, que ser\u00e1 em nome da seguradora ou do subcontratado.<\/span><\/li><\/ol><ul><li aria-level=\"1\"><b>Se a seguradora n\u00e3o seguir com a execu\u00e7\u00e3o:<\/b><\/li><\/ul><ol><li><span style=\"font-weight: 400;\">Observar o pagamento integral da import\u00e2ncia segurada indicada na ap\u00f3lice.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-149966c elementor-widget elementor-widget-image\" data-id=\"149966c\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" Administra\u00e7\u00e3o<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">O art. 101 da nova lei \u00e9 um tema de cautela, tendo em vista tratar de casos em que a garantia dos contratos\u00a0 implica na entrega de bens pela Administra\u00e7\u00e3o, dos quais o contratado ficar\u00e1 deposit\u00e1rio, e o valor do bem dever\u00e1 ser acrescentado ao montante da garantia.<\/span><\/p><ul><li aria-level=\"1\"><b>Libera\u00e7\u00e3o das Garantias<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">De acordo com o<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><em><strong> art. 100 da Lei 14.133\/2021<\/strong><\/em><\/a>, a garantia prestada pelo contratado ser\u00e1 liberada ou restitu\u00edda ap\u00f3s a fiel execu\u00e7\u00e3o do contrato ou ap\u00f3s a sua extin\u00e7\u00e3o por culpa exclusiva da Administra\u00e7\u00e3o e, quando em dinheiro, atualizada monetariamente.<\/span><\/p><p><span style=\"font-weight: 400;\">Vale frisar que a fiel execu\u00e7\u00e3o do contrato \u00e9 atestada por meio do <span style=\"text-decoration:
