A finalidade da contrata\u00e7\u00e3o p\u00fablica \u00e9 a efici\u00eancia da contrata\u00e7\u00e3o, que vai ser fruto de uma correta execu\u00e7\u00e3o do class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Com a publica\u00e7\u00e3o do extrato do contrato nasce a fase de execu\u00e7\u00e3o e, consequentemente, a fase de maior controle considerando que a efici\u00eancia da contrata\u00e7\u00e3o vai depender do envolvimento e desempenho dos agentes que atuar\u00e3o nesta fase do processo.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Iniciada a fase de execu\u00e7\u00e3o, torna-se imprescind\u00edvel a instaura\u00e7\u00e3o da Comiss\u00e3o de Gest\u00e3o e Fiscaliza\u00e7\u00e3o do Contrato, devendo ser observado o disposto no <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><span style=\"text-decoration: underline;\"><strong>Art. 7\u00ba da Lei 14.133\/2021.<\/strong><\/span><\/a><\/span><\/p><p><span style=\"font-weight: 400;\">A designa\u00e7\u00e3o a que se refere o artigo 7\u00ba, depende de ato formal regulamentar, o qual dever\u00e1 ser promovida a devida publicidade,\u00a0 crit\u00e9rios que s\u00e3o condi\u00e7\u00f5es de validade da indica\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Importante mencionar que a indica\u00e7\u00e3o pelo legislador de &#8220;gest\u00e3o de compet\u00eancias&#8221;, prevista no caput do artigo 7\u00ba, se refere \u00e0 identifica\u00e7\u00e3o dos crit\u00e9rios de aptid\u00e3o t\u00e9cnica, ou seja, qualifica\u00e7\u00e3o adequada e compat\u00edvel com as fun\u00e7\u00f5es essenciais \u00e0 execu\u00e7\u00e3o da Nova Lei de Licita\u00e7\u00f5es e Contratos.<\/span><\/p><p><span style=\"font-weight: 400;\">Como visto, verifica-se que os inciso I e II do caput, trazem condi\u00e7\u00f5es positivas, requisitos a serem preenchidos para desempenho das fun\u00e7\u00f5es, j\u00e1 o inciso III, uma condi\u00e7\u00e3o negativa, que se trata de uma veda\u00e7\u00e3o a qual o agente n\u00e3o pode deter para exerc\u00edcio dessas fun\u00e7\u00f5es.<\/span><\/p><p><span style=\"font-weight: 400;\">Assim, o inciso I requer que o agente seja servidor efetivo ou empregado p\u00fablico dos quadros permanentes. Logo, quando ele prop\u00f5e o termo &#8220;preferencialmente&#8221; a expectativa \u00e9 de que a autoridade m\u00e1xima sempre se atente para a indica\u00e7\u00e3o de um servidor de carreira e podemos afirmar que quando n\u00e3o for poss\u00edvel atender esse requisito, ter\u00e1 que haver pr\u00e9via justificativa para indica\u00e7\u00e3o que n\u00e3o se enquadre nesses crit\u00e9rios.<\/span><\/p><p><span style=\"font-weight: 400;\">Em seguida, o inciso II demonstra que para ocupar cargo ou fun\u00e7\u00e3o essencial na execu\u00e7\u00e3o da NLLC a autoridade m\u00e1xima, observada a gest\u00e3o de compet\u00eancias das atividades, dever\u00e1 observar primordialmente a qualifica\u00e7\u00e3o t\u00e9cnica do agente, a fim de que seja compat\u00edvel com a fun\u00e7\u00e3o \u00e0 qual seja designado.<\/span><\/p><p><span style=\"font-weight: 400;\">Enfim, no inciso III consta veda\u00e7\u00e3o de indica\u00e7\u00e3o de agente que mantenha rela\u00e7\u00e3o de parentesco, at\u00e9 terceiro grau, nem c\u00f4njuge ou companheiro, bem como pessoa que mantenha v\u00ednculo com o licitante ou contratante. Complementa-se, ainda, que esse inciso se relaciona com o inciso IV, do artigo 14, da NLLC.<\/span><\/p><p><span style=\"font-weight: 400;\">Conclui-se, portanto, que compete \u00e0 autoridade m\u00e1xima do \u00f3rg\u00e3o, pass\u00edvel de delega\u00e7\u00e3o, a indica\u00e7\u00e3o dos agentes que atuam nas contrata\u00e7\u00f5es p\u00fablicas, ou seja, os ocupantes de cargos em comiss\u00e3o ou fun\u00e7\u00e3o de confian\u00e7a, que ter\u00e3o atua\u00e7\u00e3o essencial na execu\u00e7\u00e3o das fases das contrata\u00e7\u00f5es p\u00fablicas<\/span><\/p><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a46b588 elementor-widget elementor-widget-heading\" data-id=\"a46b588\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><h2 style=\"letter-spacing: normal;text-align: center\">A Forma do Ato de Designa\u00e7\u00e3o<span style=\"font-size: 20px;letter-spacing: 0px;text-align: fiscalizar os contratos que possuam alguma especialidade t\u00e9cnica, sendo necess\u00e1ria a comprova\u00e7\u00e3o por Diploma, Certificado ou documento equivalente ou experi\u00eancia em contrata\u00e7\u00f5es similares;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>FISCAL ADMINISTRATIVO<\/strong> &#8211; servidor que ficar\u00e1 a cargo do acompanhamento da execu\u00e7\u00e3o dos servi\u00e7os nos contratos com regime de dedica\u00e7\u00e3o exclusiva de m\u00e3o de obra quanto \u00e0s obriga\u00e7\u00f5es previdenci\u00e1rias, fiscais e trabalhistas, bem como quanto \u00e0s provid\u00eancias tempestivas nos casos de inadimplemento;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span
