trouxe mudan\u00e7as importantes em rela\u00e7\u00e3o \u00e0 <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Leis\/L8666cons.htm\"><strong>Lei n\u00ba 8.666\/1993<\/strong><\/a>, principalmente no que diz respeito \u00e0s san\u00e7\u00f5es aplicadas em caso de irregularidades.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05beee6 elementor-widget elementor-widget-heading\" data-id=\"05beee6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Mas o que mudou?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8aba8b3 elementor-widget elementor-widget-text-editor\" data-id=\"8aba8b3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div Nacional de Empresas Inid\u00f4neas e Suspensas (Ceis) e no Cadastro Nacional de Empresas Punidas (Cnep), e determina a regulamenta\u00e7\u00e3o da forma de aplica\u00e7\u00e3o das san\u00e7\u00f5es pelo Poder Executivo.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11abb06 elementor-widget elementor-widget-heading\" underline;\">Maior justi\u00e7a:<\/span> As san\u00e7\u00f5es s\u00e3o proporcionais \u00e0 gravidade da infra\u00e7\u00e3o, o que garante que os infratores sejam punidos de forma justa.<\/span><\/p><p><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">Maior efici\u00eancia:<\/span> A aplica\u00e7\u00e3o das san\u00e7\u00f5es pode desestimular a pr\u00e1tica de irregularidades, o que contribui para a boa gest\u00e3o dos recursos p\u00fablicos.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e96cf64 elementor-widget elementor-widget-heading\" data-id=\"e96cf64\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Os tipos de infra\u00e7\u00f5es e como elas s\u00e3o aplicadas j\u00e1 foram supracitadas, contudo, o que se deve fazer nesse caso?\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-95c456f elementor-widget elementor-widget-text-editor\" data-id=\"95c456f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Se a Administra\u00e7\u00e3o P\u00fablica identificar uma infra\u00e7\u00e3o, ela seguir\u00e1 o seguinte procedimento:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Notificar\u00e1 o infrator, dando-lhe a oportunidade de se defender.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Analisar\u00e1 a defesa do infrator e decidir\u00e1 se a san\u00e7\u00e3o ser\u00e1 aplicada.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Aplicar\u00e1 a san\u00e7\u00e3o, caso seja o caso.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Publicar\u00e1 a san\u00e7\u00e3o no Ceis e no Cnep.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Nesse sentido, o artigo 156 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133<\/strong><\/a> disp\u00f5e sobre as san\u00e7\u00f5es discutidas:<\/span><\/p><p><span style=\"font-weight: 400;\">\u201c<\/span><b><i>Art. 156.<\/i><\/b><i><span style=\"font-weight: 400;\"> Ser\u00e3o aplicadas ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nesta Lei as seguintes san\u00e7\u00f5es:<\/span><\/i><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>I<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; advert\u00eancia;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>II<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; multa;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>III<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; impedimento de licitar e contratar;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>IV<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 1\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> Na aplica\u00e7\u00e3o das san\u00e7\u00f5es ser\u00e3o considerados:<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>I<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; a natureza e a gravidade da infra\u00e7\u00e3o cometida;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>II<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; as peculiaridades do caso concreto;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>III<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; as circunst\u00e2ncias agravantes ou atenuantes;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>IV<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; os danos que dela provierem para a Administra\u00e7\u00e3o P\u00fablica;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>V<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; a implanta\u00e7\u00e3o ou o aperfei\u00e7oamento de programa de integridade, conforme normas e orienta\u00e7\u00f5es dos \u00f3rg\u00e3os de controle.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 2\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A san\u00e7\u00e3o prevista no inciso I do caput deste artigo ser\u00e1 aplicada exclusivamente pela infra\u00e7\u00e3o administrativa prevista no inciso I do caput do art. 155 desta Lei, quando n\u00e3o se justificar a imposi\u00e7\u00e3o de penalidade mais grave.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 3\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A san\u00e7\u00e3o prevista no inciso II do caput deste artigo, calculada na forma do edital ou do contrato, n\u00e3o poder\u00e1 ser inferior a 0,5% (cinco d\u00e9cimos por cento) nem superior a 30% (trinta por cento) do valor do contrato licitado ou celebrado com contrata\u00e7\u00e3o direta e ser\u00e1 aplicada ao respons\u00e1vel por qualquer das infra\u00e7\u00f5es administrativas previstas no art. 155 desta Lei.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 4\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A san\u00e7\u00e3o prevista no inciso III do caput deste artigo ser\u00e1 aplicada ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nos incisos II, III, IV, V, VI e VII do caput do art. 155 desta Lei, quando n\u00e3o se justificar a imposi\u00e7\u00e3o de penalidade mais grave, e impedir\u00e1 o respons\u00e1vel de licitar ou contratar no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica direta e indireta do ente federativo que tiver aplicado a san\u00e7\u00e3o, pelo prazo m\u00e1ximo de 3 (tr\u00eas) anos.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 5\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A san\u00e7\u00e3o prevista no inciso IV do caput deste artigo ser\u00e1 aplicada ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nos incisos VIII, IX, X, XI e XII do caput do art. 155 desta Lei, bem como pelas infra\u00e7\u00f5es administrativas previstas nos incisos II, III, IV, V, VI e VII do caput do referido artigo que justifiquem a imposi\u00e7\u00e3o de penalidade mais grave que a san\u00e7\u00e3o referida no \u00a7 4\u00ba deste artigo, e impedir\u00e1 o respons\u00e1vel de licitar ou contratar no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica direta e indireta de todos os entes federativos, pelo prazo m\u00ednimo de 3 (tr\u00eas) anos e m\u00e1ximo de 6 (seis) anos.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 6\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A san\u00e7\u00e3o estabelecida no inciso IV do caput deste artigo ser\u00e1 precedida de an\u00e1lise jur\u00eddica e observar\u00e1 as seguintes regras:<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>I<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; quando aplicada por \u00f3rg\u00e3o do Poder Executivo, ser\u00e1 de compet\u00eancia exclusiva de ministro de Estado, de secret\u00e1rio estadual ou de secret\u00e1rio municipal e, quando aplicada por autarquia ou funda\u00e7\u00e3o, ser\u00e1 de compet\u00eancia exclusiva da autoridade m\u00e1xima da entidade;<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>II<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; quando aplicada por \u00f3rg\u00e3os dos Poderes Legislativo e Judici\u00e1rio, pelo Minist\u00e9rio P\u00fablico e pela Defensoria P\u00fablica no desempenho da fun\u00e7\u00e3o administrativa, ser\u00e1 de compet\u00eancia exclusiva de autoridade de n\u00edvel hier\u00e1rquico equivalente \u00e0s autoridades referidas no inciso I deste par\u00e1grafo, na forma de regulamento.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 7\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> As san\u00e7\u00f5es previstas nos incisos I, III e IV do caput deste artigo poder\u00e3o ser aplicadas cumulativamente com a prevista no inciso II do caput deste artigo.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 8\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> Se a multa aplicada e as indeniza\u00e7\u00f5es cab\u00edveis forem superiores ao valor de pagamento eventualmente devido pela Administra\u00e7\u00e3o ao contratado, al\u00e9m da perda desse valor, a diferen\u00e7a ser\u00e1 descontada da garantia prestada ou ser\u00e1 cobrada judicialmente.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a7 9\u00ba<\/i><\/b><i><span style=\"font-weight: 400;\"> A aplica\u00e7\u00e3o das san\u00e7\u00f5es previstas no caput deste artigo n\u00e3o exclui, em hip\u00f3tese alguma, a obriga\u00e7\u00e3o de repara\u00e7\u00e3o integral do dano causado \u00e0 Administra\u00e7\u00e3o P\u00fablica.\u201d<\/span><\/i><\/li><\/ul><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a8c2992 elementor-widget licita\u00e7\u00f5es e contratos p\u00fablicos. Essa medida visa proteger a Administra\u00e7\u00e3o P\u00fablica de empresas que n\u00e3o cumprem suas obriga\u00e7\u00f5es com \u00e9tica e responsabilidade.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79acc73 elementor-widget elementor-widget-heading\" data-id=\"79acc73\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Mas o que s\u00e3o infra\u00e7\u00f5es graves?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-17367a5 elementor-widget elementor-widget-text-editor\" data-id=\"17367a5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">S\u00e3o infra\u00e7\u00f5es consideradas extremamente s\u00e9rias e que podem causar preju\u00edzos significativos \u00e0 Administra\u00e7\u00e3o P\u00fablica. A <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2021<\/strong><\/a> define cinco tipos de infra\u00e7\u00f5es graves:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prestar informa\u00e7\u00f5es falsas durante a licita\u00e7\u00e3o ou na execu\u00e7\u00e3o do contrato;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Praticar fraude na execu\u00e7\u00e3o do contrato;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ter comportamento anti\u00e9tico ou cometer fraudes de qualquer natureza;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Praticar atos que violam os princ\u00edpios da administra\u00e7\u00e3o p\u00fablica, como a impessoalidade e a moralidade;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cometer atos que lesem o er\u00e1rio p\u00fablico, como desvio de recursos ou enriquecimento il\u00edcito.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ba2657 elementor-widget elementor-widget-heading\" data-id=\"1ba2657\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Mas o que \u00e9 a declara\u00e7\u00e3o de inidoneidade?\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f579e99 elementor-widget elementor-widget-text-editor\" data-id=\"f579e99\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">\u00c9 uma san\u00e7\u00e3o que impede a empresa de participar de qualquer licita\u00e7\u00e3o p\u00fablica e de contratar com a Administra\u00e7\u00e3o P\u00fablica em todo o pa\u00eds por um per\u00edodo de no m\u00ednimo 3 anos e no m\u00e1ximo 6 anos. Essa san\u00e7\u00e3o significa que a empresa perde a confian\u00e7a da Administra\u00e7\u00e3o P\u00fablica e fica inabilitada para fazer neg\u00f3cios com o governo.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6514358 elementor-widget elementor-widget-heading\" data-id=\"6514358\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Mas como funciona esta declara\u00e7\u00e3o?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b1560ac elementor-widget elementor-widget-text-editor\" data-id=\"b1560ac\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">A san\u00e7\u00e3o \u00e9 aplicada pela Administra\u00e7\u00e3o P\u00fablica ap\u00f3s a apura\u00e7\u00e3o da infra\u00e7\u00e3o grave.<\/span><\/p><p><span style=\"font-weight: 400;\">A empresa tem o direito de se defender antes da aplica\u00e7\u00e3o da san\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">A empresa fica impedida de licitar e contratar com todos os \u00f3rg\u00e3os da Administra\u00e7\u00e3o P\u00fablica em todo o territ\u00f3rio nacional.<\/span><\/p><p><span style=\"font-weight: 400;\">A empresa pode solicitar a revis\u00e3o da san\u00e7\u00e3o em casos excepcionais, mediante justificativa plaus\u00edvel.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Nesta toada, cabe registrar o disposto no <a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48817-2023-rio-de-janeiro-regulamenta-a-gestao-e-a-fiscalizacao-das-contratacoes-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional-e-da-outras-providencias?q=48817&amp;origin=instituicao#\"><strong>Decreto n\u00ba 48.817\/2023<\/strong> <\/a>acerca das san\u00e7\u00f5es administrativas:<\/span><\/p><p><b><i>\u201cArt. 31.<\/i><\/b><i><span style=\"font-weight: 400;\"> A aplica\u00e7\u00e3o de san\u00e7\u00f5es administrativas e demais penalidades \u00e0s licitantes, adjudicat\u00e1rias, contratadas e cession\u00e1rias de contratos administrativos em virtude de participa\u00e7\u00e3o em processo licitat\u00f3rio ou de contrato celebrado com os \u00f3rg\u00e3os integrantes da Administra\u00e7\u00e3o direta, aut\u00e1rquica e fundacional do Estado do Rio de Janeiro ser\u00e1 objeto de regulamenta\u00e7\u00e3o espec\u00edfica, que dever\u00e1 estabelecer, dentre outros temas, sem preju\u00edzo das previs\u00f5es constantes nos contratos e respeitadas as disposi\u00e7\u00f5es do T\u00edtulo IV da Lei n\u00ba <\/span><\/i><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">, de 2021:<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">I &#8211; as san\u00e7\u00f5es previstas nas leis que regem as diversas modalidades de licita\u00e7\u00f5es e contratos, com a previs\u00e3o, a t\u00edtulo exemplificativo, de algumas das condutas ensejadoras de sua incid\u00eancia, e, se for o caso, prazo de vig\u00eancia;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">II &#8211; a incid\u00eancia de multa de mora e, se for o caso, de multa compensat\u00f3ria, com seus percentuais e base de c\u00e1lculo;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">III &#8211; o procedimento a ser observado pela Administra\u00e7\u00e3o P\u00fablica e pelo administrado, que garanta os princ\u00edpios da legalidade, do devido processo legal, do contradit\u00f3rio, da ampla defesa, da motiva\u00e7\u00e3o, da proporcionalidade, bem como os demais princ\u00edpios constitucionais e legais que regem a atua\u00e7\u00e3o da Administra\u00e7\u00e3o P\u00fablica;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">IV &#8211; a forma e o conte\u00fado da notifica\u00e7\u00e3o, o prazo para apresenta\u00e7\u00e3o de defesa e produ\u00e7\u00e3o de provas;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">V &#8211; a compet\u00eancia para dar in\u00edcio e para proferir decis\u00e3o no processo sancionat\u00f3rio, os requisitos a serem observados na decis\u00e3o exarada e a publiciza\u00e7\u00e3o da decis\u00e3o;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VI &#8211; a fase recursal do procedimento sancionat\u00f3rio, com os respectivos prazos, efeitos do recebimento e compet\u00eancia para decidir sobre o recurso interposto;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VII &#8211; o procedimento a ser adotado para recebimento de valores devidos pela licitante, adjudicat\u00e1ria ou contratada;<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">VIII &#8211; outras provid\u00eancias administrativas a serem adotadas em caso de aplica\u00e7\u00e3o de san\u00e7\u00f5es.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. Poder\u00e3o ser utilizados meios alternativos de preven\u00e7\u00e3o e resolu\u00e7\u00e3o de controv\u00e9rsias, notadamente a concilia\u00e7\u00e3o, a media\u00e7\u00e3o, o comit\u00ea de resolu\u00e7\u00e3o de disputas e a arbitragem, conforme previsto no Cap\u00edtulo XII do T\u00edtulo III da Lei n\u00ba <\/span><\/i><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><i><span style=\"font-weight: 400;\">14.133<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">, de 2021.\u201d<\/span><\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a74ee2c elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"a74ee2c\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe0ab24 elementor-widget elementor-widget-heading\" data-id=\"fe0ab24\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Aplica\u00e7\u00e3o das San\u00e7\u00f5es<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e21dce3 elementor-widget elementor-widget-text-editor\" data-id=\"e21dce3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Identificadas as infra\u00e7\u00f5es e as respectivas san\u00e7\u00f5es, caber\u00e1 aos agentes da execu\u00e7\u00e3o a ci\u00eancia do fato e a promo\u00e7\u00e3o dos tr\u00e2mites, respeitando o devido processo legal, garantindo \u00e0 contratada o contradit\u00f3rio e ampla defesa, sendo de<\/span><span style=\"font-weight: 400;\"> responsabilidade da autoridade competente superior a aplica\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Dentre as san\u00e7\u00f5es dispon\u00edveis (art. 156) para as infra\u00e7\u00f5es apresentadas (art. 155), o legislador inova ao trazer procedimentos espec\u00edficos para os incisos II, III e IV do art. 156, ou seja, multa, impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p><p><span style=\"font-weight: 400;\">Desta forma, se a contratada incorrer em condutas cuja san\u00e7\u00e3o seja multa (art. 156, II), respeitando a correta instru\u00e7\u00e3o processual, ser\u00e1 facultado ao interessado a defesa no prazo de 15 (quinze) \u00fateis.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainda sobre as san\u00e7\u00f5es, os incisos III e IV do art. 156, o legislador traz particularidades.\u00a0<\/span><\/p><p><b><i>\u201cArt. 156.<\/i><\/b><i><span style=\"font-weight: 400;\"> Ser\u00e3o aplicadas ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nesta Lei as seguintes san\u00e7\u00f5es:<\/span><\/i><\/p><p><b><i>I<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; advert\u00eancia;<\/span><\/i><\/p><p><b><i>II<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; multa;<\/span><\/i><\/p><p><b><i>III<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; impedimento de licitar e contratar;<\/span><\/i><\/p><p><b><i>IV<\/i><\/b><i><span style=\"font-weight: 400;\"> &#8211; declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.\u201d<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Confira na sequ\u00eancia.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fdb6a96 elementor-widget elementor-widget-heading\" data-id=\"fdb6a96\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Processo de Responsabiliza\u00e7\u00e3o\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4d67d4d elementor-widget elementor-widget-text-editor\" data-id=\"4d67d4d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Em que pese o tr\u00e2mite usual para apura\u00e7\u00e3o e aplica\u00e7\u00e3o de san\u00e7\u00e3o, a nova lei de licita\u00e7\u00f5es e contratos traz como inova\u00e7\u00e3o um procedimento espec\u00edfico para as infra\u00e7\u00f5es que trata nos incisos III e IV do caput do art. 156 desta Lei, ou seja, impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p><p><span style=\"font-weight: 400;\">A partir do art. 158, a lei determina que instaura\u00e7\u00e3o de processo de responsabiliza\u00e7\u00e3o dever\u00e1 ser conduzido por comiss\u00e3o composta por 2 (dois) ou mais empregados\/servidores p\u00fablicos pertencentes aos seus quadros permanentes, preferencialmente com, no m\u00ednimo, 3 (tr\u00eas) anos de tempo de servi\u00e7o no \u00f3rg\u00e3o ou entidade.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9cad23 elementor-widget elementor-widget-heading\" data-id=\"f9cad23\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Das provas\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3747bcd elementor-widget elementor-widget-text-editor\" data-id=\"3747bcd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Instaurado o processo, analisado os fatos e circunst\u00e2ncias, ser\u00e1 promovida a intima\u00e7\u00e3o da contratada para apresenta\u00e7\u00e3o, em 15 (quinze) dias \u00fateis, da defesa e especifica\u00e7\u00e3o das provas que pretende produzir.<\/span><\/p><p><span style=\"font-weight: 400;\">Sendo manifestado o interesse em produzir as provas, a comiss\u00e3o poder\u00e1:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Deferir o pedido viabilizando a produ\u00e7\u00e3o de novas provas ou juntada das existentes.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indeferir, mediante decis\u00e3o fundamentada, se as provas forem consideradas il\u00edcitas, impertinentes, desnecess\u00e1rias, protelat\u00f3rias ou intempestivas.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00c9 importante frisar que a comiss\u00e3o possui a prerrogativa de produ\u00e7\u00e3o ou juntada de provas que julgue indispens\u00e1veis para condu\u00e7\u00e3o do processo.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Produzida ou juntada \u00e0s provas, poder\u00e1 o contratante apresentar alega\u00e7\u00f5es finais no prazo de 15 (quinze) dias \u00fateis, a partir da intima\u00e7\u00e3o.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-237fc85 elementor-widget elementor-widget-heading\" data-id=\"237fc85\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Da prescri\u00e7\u00e3o\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4fd4723 elementor-widget elementor-widget-text-editor\" data-id=\"4fd4723\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">A Lei, no \u00a7 4\u00ba do art. 158, menciona o prazo prescricional na apura\u00e7\u00e3o da responsabilidade das infra\u00e7\u00f5es que deem ensejo \u00e0s san\u00e7\u00f5es de impedimento de licitar e contratar, e declara\u00e7\u00e3o de inidoneidade para licitar ou contratar.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c86e463 elementor-widget elementor-widget-image\" data-id=\"c86e463\"
