A <\/span>designa\u00e7\u00e3o dos agentes da execu\u00e7\u00e3o contratual<\/b> \u00e9 o ato promovido pela autoridade competente do \u00f3rg\u00e3o ou entidade contratante, que indicar\u00e1 o gestor e fiscais para cada contrato, bem como seus substitutos, vide art. 4\u00ba do Decreto 48.817\/2023<\/strong><\/a>.<\/span><\/p>

Este ato deve atender 4 requisitos de validade, que s\u00e3o: <\/span>i) <\/i><\/b>publicidade; <\/span>ii)<\/i><\/b> qualifica\u00e7\u00e3o dos agentes; <\/span>iii)<\/i><\/b> forma; e <\/span>iv)<\/i><\/b> compet\u00eancia.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Publicidade dos Atos<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Ap\u00f3s a <\/span>escolha do fornecedor<\/a><\/strong>, o processo de contrata\u00e7\u00e3o segue para a assinatura do contrato.\u00a0<\/span><\/p>

Desta forma, a publica\u00e7\u00e3o do contrato, no PNCP e no Di\u00e1rio Oficial do Estado do Rio de Janeiro, s\u00e3o condi\u00e7\u00f5es de validade do mesmo, com base no art. 91 e 94 da Lei n\u00ba 14.133\/2021<\/strong><\/a> c\/c art. 60 do Decreto n\u00ba 48.816\/2023<\/strong><\/a>.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Qualifica\u00e7\u00e3o dos Agentes<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Com foco na gest\u00e3o de compet\u00eancias, o legislador se refere \u00e0 identifica\u00e7\u00e3o dos crit\u00e9rios de aptid\u00e3o t\u00e9cnica, ou seja, qualifica\u00e7\u00e3o adequada e compat\u00edvel com as fun\u00e7\u00f5es essenciais \u00e0 execu\u00e7\u00e3o da Nova Lei de Licita\u00e7\u00f5es e Contratos<\/strong><\/a>, como se observa no art.<\/span> 7\u00ba da LLC.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Como visto, verifica-se que os inciso I e II do <\/span>caput <\/span><\/i>do artigo supracitado, trazem <\/span>condi\u00e7\u00f5es positivas<\/b>, requisitos a serem preenchidos para desempenho das fun\u00e7\u00f5es, j\u00e1 o inciso III, do mesmo dispositivo legal, traz uma <\/span>condi\u00e7\u00e3o negativa<\/b>, que se trata de uma veda\u00e7\u00e3o a qual o agente n\u00e3o pode deter para exerc\u00edcio dessas fun\u00e7\u00f5es.<\/span><\/p>

Em regulamenta\u00e7\u00e3o o art. 6\u00ba do <\/span>Decreto de Gest\u00e3o e Fiscaliza\u00e7\u00e3o das Contrata\u00e7\u00f5es P\u00fablicas<\/strong><\/span><\/a>, identifica-se que os gestores e fiscais, bem como dos respectivos substitutos, dever\u00e3o preencher os seguintes requisitos:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Quanto a Forma e a Compet\u00eancia<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Os gestores e fiscais, bem como os respectivos substitutos, ser\u00e3o indicados <\/span>por autoridade competente<\/b>, conforme art. 7\u00ba do Decreto n\u00ba 48.817\/2023, que \u00e9 o agente p\u00fablico com poder decis\u00f3rio para realizar os atos e autoriza\u00e7\u00f5es que lhe cabem, conforme estabelecido neste Decreto, em delega\u00e7\u00e3o ou na estrutura administrativa, como conceituou o Decreto n\u00ba 48.650\/2023<\/strong><\/a>.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

J\u00e1 a <\/span>forma<\/b> diz respeito ao m\u00e9todo pelo qual esse ato ser\u00e1 praticado, observada a regulamenta\u00e7\u00e3o interna de cada \u00f3rg\u00e3o ou entidade do Estado do Rio de Janeiro, e, na aus\u00eancia desta, sugere-se optar pela designa\u00e7\u00e3o por meio de Resolu\u00e7\u00e3o, ou ato equivalente.<\/span><\/p>
