class=\"elementor-image-box-content\"><p class=\"elementor-image-box-description\">As san\u00e7\u00f5es s\u00e3o penalidades previstas em lei, instrumento edital\u00edcio ou contrato, aplicadas pelo Estado no exerc\u00edcio da fun\u00e7\u00e3o administrativa, como consequ\u00eancia de um fato t\u00edpico administrativo com a observ\u00e2ncia dos princ\u00edpios constitucionais do contradit\u00f3rio e da ampla defesa, garantidos por meio do devido processo legal.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2aa5a8b elementor-widget elementor-widget-text-editor\" data-id=\"2aa5a8b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">A aplica\u00e7\u00e3o de san\u00e7\u00f5es administrativas tem previs\u00e3o legal e visa a preservar o interesse p\u00fablico, quando este \u00e9 abalado por atos il\u00edcitos cometidos por licitantes ou contratadas, em procedimentos de aquisi\u00e7\u00e3o p\u00fablica ou na execu\u00e7\u00e3o de contratos administrativos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-62c91fb elementor-widget elementor-widget-image\" data-id=\"62c91fb\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"http:\/\/redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2021\/10\/sancao.png\" title=\"\" alt=\"\" loading=\"lazy\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f5fcc4 elementor-widget elementor-widget-text-editor\" data-id=\"6f5fcc4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">O poder sancionat\u00f3rio que possui a Administra\u00e7\u00e3o P\u00fablica deve ser utilizado sempre que necess\u00e1rio para que ocorra <strong>justi\u00e7a com os licitantes infratores e responsabilidade com o er\u00e1rio<\/strong>. A pr\u00e1tica revela que o \u00f3rg\u00e3o ou entidade p\u00fablica que se utiliza do seu dever de sancionar possui melhores compras e servi\u00e7os em seu cotidiano, afastando os maus prestadores de servi\u00e7os, obtendo-se o resultado em concentrar, em sua maioria, apenas licitantes capazes de concretizar com efic\u00e1cia o contrato administrativo. Cabe ponderar que, em se tratando da aplica\u00e7\u00e3o de san\u00e7\u00f5es pela Administra\u00e7\u00e3o P\u00fablica, n\u00e3o h\u00e1 que se falar em discricionariedade por parte do agente p\u00fablico que, diante do descumprimento contratual, possui o <strong>dever de penalizar<\/strong> o particular infrator ante o risco de ser responsabilizado pessoalmente.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-35e7ee7 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"35e7ee7\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e80b4d6 elementor-widget elementor-widget-heading\" data-id=\"e80b4d6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Previs\u00e3o Legal das San\u00e7\u00f5es<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7417eb5 elementor-widget elementor-widget-text-editor\" data-id=\"7417eb5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">De acordo com a <strong><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\" target=\"_blank\" rel=\"noopener\">Lei n\u00ba 8.666\/1993<\/a><\/strong>, podem ser aplicadas aos fornecedores as seguintes penalidades:<\/p><ul><li style=\"text-align: justify;\"><strong>Advert\u00eancia<\/strong>;<\/li><li style=\"text-align: justify;\"><strong>Multa<\/strong>;<\/li><li style=\"text-align: justify;\"><strong>Suspens\u00e3o tempor\u00e1ria<\/strong> do direito de participar em licita\u00e7\u00e3o e impedimento de contratar com a Administra\u00e7\u00e3o, por prazo n\u00e3o superior a 02 (dois) anos; e<\/li><li style=\"text-align: justify;\"><strong>Declara\u00e7\u00e3o de inidoneidade<\/strong> para licitar e contratar com a Administra\u00e7\u00e3o P\u00fablica, enquanto perdurarem os motivos determinantes da puni\u00e7\u00e3o ou at\u00e9 que seja promovida a reabilita\u00e7\u00e3o perante a pr\u00f3pria autoridade que aplicou a penalidade, que ser\u00e1 concedida sempre que o contratado ressarcir a Administra\u00e7\u00e3o pelos preju\u00edzos resultantes e ap\u00f3s decorrido o prazo da san\u00e7\u00e3o aplicada com base no inciso anterior.<\/li><\/ul><p style=\"text-align: justify;\">A Lei n\u00ba 8.666\/1993 disp\u00f5e a respeito conforme abaixo:<\/p><p><em><strong>Art. 87.<\/strong>\u00a0Pela inexecu\u00e7\u00e3o total ou parcial do contrato a Administra\u00e7\u00e3o poder\u00e1, garantida a pr\u00e9via defesa, aplicar ao contratado as seguintes san\u00e7\u00f5es:<\/em><\/p><p><em><strong>I<\/strong>\u00a0&#8211; advert\u00eancia;<\/em><\/p><p><em><strong>II<\/strong>\u00a0&#8211; multa, na forma prevista no instrumento convocat\u00f3rio ou no contrato;<\/em><\/p><p><em><strong>III<\/strong>\u00a0&#8211; suspens\u00e3o tempor\u00e1ria de participa\u00e7\u00e3o em licita\u00e7\u00e3o e impedimento de contratar com a Administra\u00e7\u00e3o, por prazo n\u00e3o superior a 2 (dois) anos;<\/em><\/p><p><em><strong>IV<\/strong>\u00a0&#8211; declara\u00e7\u00e3o de inidoneidade para licitar ou contratar com a Administra\u00e7\u00e3o P\u00fablica enquanto perdurarem os motivos determinantes da puni\u00e7\u00e3o ou at\u00e9 que seja promovida a reabilita\u00e7\u00e3o perante a pr\u00f3pria autoridade que aplicou a penalidade, que ser\u00e1 concedida sempre que o contratado ressarcir a Administra\u00e7\u00e3o pelos preju\u00edzos resultantes e ap\u00f3s decorrido o prazo da san\u00e7\u00e3o aplicada com base no inciso anterior.<\/em><\/p><p><em><strong>\u00a7 1\u00ba &#8211; <\/strong>Se a multa aplicada for superior ao valor da garantia prestada, al\u00e9m da perda desta, responder\u00e1 o contratado pela sua diferen\u00e7a, que ser\u00e1 descontada dos pagamentos eventualmente devidos pela Administra\u00e7\u00e3o ou cobrada judicialmente.<\/em><\/p><p><em><strong>\u00a7 2\u00ba &#8211;\u00a0 <\/strong>As san\u00e7\u00f5es previstas nos incisos I, III e IV deste artigo poder\u00e3o ser aplicadas juntamente com a do inciso II, facultada a defesa pr\u00e9via do interessado, no respectivo processo, no prazo de 5 (cinco) dias \u00fateis.<\/em><\/p><p><em><strong>\u00a7 3\u00ba &#8211; <\/strong>A san\u00e7\u00e3o estabelecida no inciso IV deste artigo \u00e9 de compet\u00eancia exclusiva do Ministro de Estado, do Secret\u00e1rio Estadual ou Municipal, conforme o caso, facultada a defesa do interessado no respectivo processo, no prazo de 10 (dez) dias da abertura de vista, podendo a reabilita\u00e7\u00e3o ser requerida ap\u00f3s 2 (dois) anos de sua aplica\u00e7\u00e3o. (Vide art 109 inciso III).\u201d<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c7b278b elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"c7b278b\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c30a32e elementor-widget elementor-widget-heading\" data-id=\"c30a32e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Princ\u00edpios dos processos de Aplica\u00e7\u00e3o de San\u00e7\u00e3o<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-517728a elementor-widget elementor-widget-text-editor\" data-id=\"517728a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">A previs\u00e3o da san\u00e7\u00e3o em lei legitima a puni\u00e7\u00e3o. No entanto, o processo de aplica\u00e7\u00e3o de san\u00e7\u00e3o a ser deflagrado deve observar os princ\u00edpios assegurados pela Constitui\u00e7\u00e3o Federal e pelo art. 2\u00b0 da <strong>Lei n\u00b0 5.427\/2009<\/strong>, em especial:<\/p><p style=\"text-align: justify;\"><strong>Legalidade<\/strong>: as san\u00e7\u00f5es administrativas devem ser as previamente estabelecidas em lei, n\u00e3o podendo o edital e o contrato instituir outras modalidades. A margem de discricionariedade do Administrador P\u00fablico se restringe \u00e0 escolha da san\u00e7\u00e3o a ser aplicada e ao prazo de sua vig\u00eancia (arts. 5\u00b0, II e 37 da Constitui\u00e7\u00e3o Federal3 ).<\/p><p style=\"text-align: justify;\"><strong>Devido processo legal<\/strong>: garantia de instaura\u00e7\u00e3o de um processo espec\u00edfico, em que todas as etapas sejam observadas, tais como, notifica\u00e7\u00e3o do contratado com o detalhamento dos fatos a ela imputados, a concess\u00e3o de prazo para apresenta\u00e7\u00e3o de defesa, produ\u00e7\u00e3o de provas, decis\u00f5es motivadas e a possibilidade de interposi\u00e7\u00e3o de recurso (art. 5\u00b0, LIV da Constitui\u00e7\u00e3o Federal4 ).<\/p><p style=\"text-align: justify;\"><strong>Proporcionalidade e razoabilidade<\/strong>: a san\u00e7\u00e3o administrativa a ser aplicada deve ser compat\u00edvel com a infra\u00e7\u00e3o praticada, na forma do art. 22 do DecretoLei n\u00ba 4.657\/19425 e do art. 2\u00ba, \u00a7 1\u00ba, VIII da Lei n\u00ba 5.427\/20096 .<\/p><p style=\"text-align: justify;\"><strong>Contradit\u00f3rio e da ampla defesa<\/strong>: garantia ao contratado de prazo para apresenta\u00e7\u00e3o de defesa, com conhecimento das faltas que lhe s\u00e3o imputadas e das respectivas san\u00e7\u00f5es administrativas, bem como a possibilidade de ter vista e obter c\u00f3pia dos autos (art. 5\u00b0, LV da Constitui\u00e7\u00e3o Federal7 e arts. 2\u00ba, \u00a7 1\u00ba, XIII e 69 da Lei n\u00ba 5.427\/20098).<\/p><p style=\"text-align: justify;\"><strong>Motiva\u00e7\u00e3o:<\/strong> os atos praticados pelo Administrador devem ser motivados, com a descri\u00e7\u00e3o da conduta faltosa do contratado, o dispositivo legal e o respectivo inciso, se for o caso, o item do edital e a cl\u00e1usula contratual infringidos, a san\u00e7\u00e3o a ser aplicada, tamb\u00e9m com men\u00e7\u00e3o ao dispositivo legal, ao item do edital e contratual que a embasam, com a demonstra\u00e7\u00e3o da sua adequa\u00e7\u00e3o (art. 20 do Decreto-Lei n\u00ba 4.657\/19429)<\/p><p style=\"text-align: justify;\">A fim de colaborar para a melhor efici\u00eancia da Administra\u00e7\u00e3o P\u00fablica a PGE-RJ elaborou um manual fixando um roteiro para a aplica\u00e7\u00e3o de san\u00e7\u00f5es, nos casos de inexecu\u00e7\u00e3o parcial ou total dos contratos administrativos, conferindo uma maior seguran\u00e7a Jur\u00eddica para o Administrador P\u00fablico e para os contratados.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-95b4b60 elementor-widget elementor-widget-text-editor\" data-id=\"95b4b60\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">A Procuradoria Geral do Estado do Rio de Janeiro disponibilizou em sua p\u00e1gina o <a href=\"https:\/\/pge.rj.gov.br\/comum\/code\/MostrarArquivo.php?C=OTQ2NA%2C%2C\" target=\"_blank\" rel=\"noopener\"><strong>MANUAL PARA APLICA\u00c7\u00c3O DE SAN\u00c7\u00d5ES NOS CASOS DE INEXECU\u00c7\u00c3O PARCIAL OU TOTAL DOS CONTRATOS ADMINISTRATIVOS<\/strong><\/a>.<\/p><p style=\"text-align: justify;\">Ser\u00e1 necess\u00e1rio, ainda, o envio de informa\u00e7\u00f5es a respeito da san\u00e7\u00e3o aplicada conforme previsto na <strong><a href=\"http:\/\/redelog.rj.gov.br\/redelog\/resolucao-cge-no-118-de-12-de-janeiro-de-2022\/\">Resolu\u00e7\u00e3o CGE n\u00ba 118, de 12 de janeiro de 2022<\/a><\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-38d117f elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"38d117f\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div Isso proporciona seguran\u00e7a tanto ao aplicador, quanto ao fornecedor, que fica ciente de que certos atos ter\u00e3o medidas imputadas, com adequa\u00e7\u00f5es devidamente descritas.<\/p><p style=\"text-align: justify;\">Foram\u00a0 enumeradas v\u00e1rias condutas reprov\u00e1veis, ensejando-se um processo administrativo sancionat\u00f3rio, que em sua apura\u00e7\u00e3o e comprova\u00e7\u00e3o, aplicar-se-\u00e1 a penalidade adequada<\/p><p style=\"text-align: justify;\">O descrito no cap\u00edtulo I, do t\u00edtulo IV, iniciando-se com o art. 155, reflexo de legisla\u00e7\u00f5es anteriores e instru\u00e7\u00f5es normativas da tem\u00e1tica, elucida em seu teor a responsabiliza\u00e7\u00e3o do licitante ou contratado pelas seguintes infra\u00e7\u00f5es:<\/p><p>\u00a0<\/p><p style=\"text-align: justify;\"><em><strong>Art. 155<\/strong>. [&#8230;] <\/em><\/p><p style=\"text-align: justify;\"><em>I &#8211; dar causa \u00e0 inexecu\u00e7\u00e3o parcial do contrato;<\/em><\/p><p style=\"text-align: justify;\"><em>II &#8211; dar causa \u00e0 inexecu\u00e7\u00e3o parcial do contrato que cause grave dano \u00e0 Administra\u00e7\u00e3o, ao funcionamento dos servi\u00e7os p\u00fablicos ou ao interesse coletivo; <\/em><\/p><p style=\"text-align: justify;\"><em>III &#8211; dar causa \u00e0 inexecu\u00e7\u00e3o total do contrato;<\/em><\/p><p style=\"text-align: justify;\"><em>IV &#8211; deixar de entregar a documenta\u00e7\u00e3o exigida para o certame; <\/em><\/p><p style=\"text-align: justify;\"><em>V &#8211; n\u00e3o manter a proposta, salvo em decorr\u00eancia de fato superveniente devidamente justificado;<\/em><\/p><p style=\"text-align: justify;\"><em>VI &#8211; n\u00e3o celebrar o contrato ou n\u00e3o entregar a documenta\u00e7\u00e3o exigida para a contrata\u00e7\u00e3o, quando convocado dentro do prazo de validade de sua proposta; <\/em><\/p><p style=\"text-align: justify;\"><em>VII &#8211; ensejar o retardamento da execu\u00e7\u00e3o ou da entrega do objeto da licita\u00e7\u00e3o sem motivo justificado;<\/em><\/p><p style=\"text-align: justify;\"><em>VIII &#8211; apresentar declara\u00e7\u00e3o ou documenta\u00e7\u00e3o falsa exigida para o certame ou prestar declara\u00e7\u00e3o falsa durante a licita\u00e7\u00e3o ou a execu\u00e7\u00e3o do contrato;<\/em><\/p><p style=\"text-align: justify;\"><em>IX &#8211; fraudar a licita\u00e7\u00e3o ou praticar ato fraudulento na execu\u00e7\u00e3o do contrato;<\/em><\/p><p style=\"text-align: justify;\"><em>X &#8211; comportar-se de modo inid\u00f4neo ou cometer fraude de qualquer natureza; <\/em><\/p><p style=\"text-align: justify;\"><em>XI &#8211; praticar atos il\u00edcitos com vistas a frustrar os objetivos da licita\u00e7\u00e3o; <\/em><\/p><p style=\"text-align: justify;\"><em>XII &#8211; praticar ato lesivo previsto no art. 5\u00ba da Lei n\u00ba 12.846, de 1\u00ba de agosto de 2013.<\/em><\/p><p style=\"text-align: justify;\">\u00a0<\/p><p style=\"text-align: justify;\">Agora vejamos as penalidades e as infra\u00e7\u00f5es que se encaixam, com uma jun\u00e7\u00e3o do art. 156, da Lei n\u00ba 14.133\/2021, dando seguran\u00e7a jur\u00eddica ao gestor e fornecedor\/infrator, com regras claras e precisas, conforme dimensionado a seguir:<\/p><p style=\"text-align: justify;\">\u00a0<\/p><p style=\"text-align: justify;\"><em><strong>Art. 156<\/strong>. Ser\u00e3o aplicadas ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nesta Lei as seguintes san\u00e7\u00f5es: <\/em><\/p><p style=\"text-align: justify;\"><em>I \u2013 advert\u00eancia: de acordo com o \u00a72\u00ba, a san\u00e7\u00e3o prevista no inciso I do caput deste artigo ser\u00e1 aplicada exclusivamente pela infra\u00e7\u00e3o administrativa prevista, quando n\u00e3o se justificar a imposi\u00e7\u00e3o de penalidade mais grave. <\/em><\/p><p style=\"text-align: justify;\"><em>II \u2013 multa: em leitura ao \u00a73\u00ba, a san\u00e7\u00e3o prevista no inciso II do caput deste artigo, calculada na forma do 5 de 9 edital ou do contrato, n\u00e3o poder\u00e1 ser inferior a 0,5% (cinco d\u00e9cimos por cento) nem superior a 30% (trinta por cento) do valor do contrato licitado ou celebrado com contrata\u00e7\u00e3o direta e ser\u00e1 aplicada ao respons\u00e1vel por qualquer das infra\u00e7\u00f5es administrativas previstas no art. 155 desta Lei. <\/em><\/p><p style=\"text-align: justify;\"><em>III &#8211; impedimento de licitar e contratar: no aprendizado do \u00a74\u00ba, a san\u00e7\u00e3o prevista no inciso III do caput deste artigo ser\u00e1 aplicada ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nos incisos II, III, IV, V, VI e VII do caput do art. 155 desta Lei, quando n\u00e3o se justificar a imposi\u00e7\u00e3o de penalidade mais grave, e impedir\u00e1 o respons\u00e1vel de licitar ou contratar no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica direta e indireta do ente federativo que tiver aplicado a san\u00e7\u00e3o, pelo prazo m\u00e1ximo de 3 (tr\u00eas) anos. <\/em><\/p><p style=\"text-align: justify;\"><em>IV &#8211; declara\u00e7\u00e3o de inidoneidade para licitar ou contratar: no ensinamento do \u00a7 5\u00ba, a san\u00e7\u00e3o prevista no inciso IV do caput deste artigo ser\u00e1 aplicada ao respons\u00e1vel pelas infra\u00e7\u00f5es administrativas previstas nos incisos VIII, IX, X, XI e XII do caput do art. 155 desta Lei, bem como pelas infra\u00e7\u00f5es administrativas previstas nos incisos II, III, IV, V, VI e VII do caput do referido artigo que justifiquem a imposi\u00e7\u00e3o de penalidade mais grave que a san\u00e7\u00e3o referida no \u00a7 4\u00ba deste artigo, e impedir\u00e1 o respons\u00e1vel de licitar ou contratar no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica direta e indireta de todos os entes federativos, pelo prazo m\u00ednimo de 3 (tr\u00eas) anos e m\u00e1ximo de 6 (seis) anos. <\/em><\/p><p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p><p style=\"text-align: justify;\">Destaca-se aqui a penalidade do inciso III, que define a abrang\u00eancia e o fim da diverg\u00eancia da extens\u00e3o punitiva. P\u00f5e-se fim a penalidade \u201c<strong>suspens\u00e3o<\/strong>\u201d, que abrangia apenas o \u00f3rg\u00e3o sancionador, mencionando-se apenas o \u201c<strong>impedimento<\/strong>\u201d que ser\u00e1 usado especificamente nas condutas estabelecidas e com a abrang\u00eancia do ente federativo que a atribuiu.<\/p><p style=\"text-align: justify;\">Outra inova\u00e7\u00e3o: as aplica\u00e7\u00f5es das san\u00e7\u00f5es de declara\u00e7\u00e3o de inidoneidade e impedimento de contratar e licitar dever\u00e3o ser precedidas de <strong>instaura\u00e7\u00e3o de processo de responsabiliza\u00e7\u00e3o<\/strong>, a ser conduzido por comiss\u00e3o composta de 2 (dois) ou mais servidores est\u00e1veis 12, que avaliar\u00e1 fatos e circunst\u00e2ncias conhecidos e intimar\u00e1 o licitante ou o contratado para, no prazo de 15 (quinze) dias \u00fateis, contado da data de intima\u00e7\u00e3o, apresentar defesa escrita e especificar as provas que pretenda produzir.<\/p><p style=\"text-align: justify;\">J\u00e1 com aplica\u00e7\u00e3o em algumas institui\u00e7\u00f5es, a <strong>reabilita\u00e7\u00e3o<\/strong>, agora de forma expressa, \u00e9 admitida perante a pr\u00f3pria autoridade que aplicou a penalidade, com fundamento no art. 163, exigindo-se, cumulativamente:<\/p><p>\u00a0<\/p><p style=\"text-align: justify;\"><em>I &#8211; repara\u00e7\u00e3o integral do dano causado \u00e0 Administra\u00e7\u00e3o P\u00fablica;<\/em><\/p><p style=\"text-align: justify;\"><em>II &#8211; pagamento da multa;<\/em><\/p><p style=\"text-align: justify;\"><em>III &#8211; transcurso do prazo m\u00ednimo de 1 (um) ano da aplica\u00e7\u00e3o da penalidade, no caso de impedimento de licitar e contratar, ou de 3 (tr\u00eas) anos da aplica\u00e7\u00e3o da penalidade, no caso de declara\u00e7\u00e3o de inidoneidade;<\/em><\/p><p style=\"text-align: justify;\"><em>IV &#8211; cumprimento das condi\u00e7\u00f5es de reabilita\u00e7\u00e3o definidas no ato punitivo;<\/em><\/p><p style=\"text-align: justify;\"><em>V &#8211; an\u00e1lise jur\u00eddica pr\u00e9via, com posicionamento conclusivo quanto ao cumprimento dos requisitos definidos neste artigo.<\/em><\/p><p style=\"text-align: justify;\">\u00a0<\/p><p style=\"text-align: justify;\">Os prazos descritos no inciso III s\u00e3o necess\u00e1rios para a obedi\u00eancia do pr\u00f3prio \u201cm\u00ednimo\u201d das san\u00e7\u00f5es, al\u00e9m do car\u00e1ter pedag\u00f3gico em si.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55c5399 elementor-widget elementor-widget-image\" data-id=\"55c5399\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"http:\/\/redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2021\/10\/sancoes1.png\" title=\"\" alt=\"\" loading=\"lazy\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11e29d8 elementor-widget elementor-widget-image\" data-id=\"11e29d8\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"http:\/\/redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2021\/10\/sancoes2.png\" title=\"\" alt=\"\" loading=\"lazy\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-42e24c0 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"42e24c0\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ac9aa1f elementor-widget elementor-widget-heading\" data-id=\"ac9aa1f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Decis\u00f5es de Tribunais<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cfc6a44 elementor-widget elementor-widget-text-editor\" data-id=\"cfc6a44\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"text-align: justify;\">\u00c9 l\u00edcita a fixa\u00e7\u00e3o de multa no valor de 20% sobre a parcela inadimplida do contrato. O limite de 10% para a cl\u00e1usula penal previsto no art. 9\u00ba do Decreto 22.626\/1933 (Lei da Usura) n\u00e3o \u00e9 aplic\u00e1vel aos contratos administrativos, e sim o estabelecido no art. 412 do C\u00f3digo Civil \u2013 aplicado supletivamente \u00e0s contrata\u00e7\u00f5es p\u00fablicas por for\u00e7a do art. 54, caput, da Lei 8.666\/1993 \u2013, segundo o qual o limite para a estipula\u00e7\u00e3o da penalidade \u00e9 o valor da obriga\u00e7\u00e3o principal. <strong>Ac\u00f3rd\u00e3o TCU 715\/2021 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">A falta de tempestividade na aplica\u00e7\u00e3o de penalidades contratuais \u00e0 contratada, em vista do atraso injustificado na entrega do objeto contratado, pode ser relevada quando n\u00e3o restar configurada a in\u00e9rcia por parte dos setores competentes da entidade contratante. <strong>Ac\u00f3rd\u00e3o 56\/2007 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Proceda \u00e0s penalidades previstas nas cl\u00e1usulas contratuais aven\u00e7adas, diante do atraso injustific\u00e1vel no ritmo de obras. <strong>Ac\u00f3rd\u00e3o 257\/2010 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Aplique, na hip\u00f3tese de inexecu\u00e7\u00e3o parcial do contrato, as san\u00e7\u00f5es cab\u00edveis \u00e0 contratada, somente admitindo retardamento da execu\u00e7\u00e3o da obra, ou de suas parcelas, quando fundamentado por motivo de ordem t\u00e9cnica, superveniente ou imprevis\u00edvel, devidamente justificado, conforme estabelece o art. 8\u00b0 da Lei n\u00ba 8.666\/1993. <strong>Ac\u00f3rd\u00e3o 1932\/2009 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Estipule, em aten\u00e7\u00e3o aos princ\u00edpios da proporcionalidade e da razoabilidade, penalidades espec\u00edficas e proporcionais \u00e0 gravidade dos eventuais descumprimentos contratuais; <strong>Ac\u00f3rd\u00e3o 1453\/2009 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Envide esfor\u00e7os para que os contratos relativos \u00e0 presta\u00e7\u00e3o de servi\u00e7os de tecnologia da informa\u00e7\u00e3o, celebrados pela entidade, estabele\u00e7am em suas cl\u00e1usulas de penalidades vincula\u00e7\u00e3o entre as penas previstas e as poss\u00edveis falhas na execu\u00e7\u00e3o dos servi\u00e7os, atentando para o princ\u00edpio da proporcionalidade. <strong>Ac\u00f3rd\u00e3o 670\/2008 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Estabele\u00e7a, nos casos de atraso injustificado na execu\u00e7\u00e3o do contrato, desconto da respectiva multa da garantia do contratado e, caso seja esta insuficiente, desconto dos pagamentos eventualmente devidos pela Administra\u00e7\u00e3o, de modo a ajustar os referidos dispositivos aos ditames do Art. 86 da Lei n\u00ba 8.666\/1993. Inclua, no edital, item espec\u00edfico alusivo \u00e0s san\u00e7\u00f5es para o caso de inadimplemento, de modo a conform\u00e1-lo \u00e0 exig\u00eancia constante do Art. 40, inciso III da Lei n\u00ba 8.666\/1993. <strong>Ac\u00f3rd\u00e3o 597\/2008 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Fa\u00e7a constar de dos editais que a aplica\u00e7\u00e3o da san\u00e7\u00e3o de suspens\u00e3o tempor\u00e1ria de participa\u00e7\u00e3o em licita\u00e7\u00e3o e impedimento de contratar com a Administra\u00e7\u00e3o, fundamentada na inexecu\u00e7\u00e3o total ou parcial do contrato, seja limitada ao prazo m\u00e1ximo de 2 anos, nos termos previstos no inciso III do art. 87 da Lei n\u00ba 8.666\/1993. <strong>Ac\u00f3rd\u00e3o 888\/2007 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Estipule no edital e no contrato a ser celebrado prazo para disponibiliza\u00e7\u00e3o dos servi\u00e7os contratados, bem assim as penalidades advindas do descumprimento desse prazo. <strong>Ac\u00f3rd\u00e3o 126\/2007 Plen\u00e1rio<\/strong><\/li><li style=\"text-align: justify;\">Preveja, tanto no edital quanto no respectivo contrato, situa\u00e7\u00f5es claras para aplica\u00e7\u00e3o das penalidades, estabelecendo grada\u00e7\u00f5es entre as san\u00e7\u00f5es de acordo com o potencial de les\u00e3o que poder\u00e1 advir de cada conduta a ser apenada, em aten\u00e7\u00e3o ao disposto no art. 55, incisos VII, VIII e IX, da Lei n\u00ba 8.666\/1993. <strong>Ac\u00f3rd\u00e3o 137\/2010 Primeira C\u00e2mara (Rela\u00e7\u00e3o) <\/strong><\/li><li style=\"text-align: justify;\">Instaure processo administrativo, nos termos da Lei n\u00ba 9.784\/1999, para decidir sobre a aplica\u00e7\u00e3o da penalidade prevista no art. 7\u00ba da Lei 10.520\/2002 \u00e0 empresa licitante que utilizou documenta\u00e7\u00e3o falsa em preg\u00e3o presencial de 2006, durante a fase de classifica\u00e7\u00e3o desse certame. <strong>Ac\u00f3rd\u00e3o
