class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>O GOVERNADOR DO ESTADO DO RIO DE JANEIRO<\/strong>, no uso de suas atribui\u00e7\u00f5es constitucionais e legais, tendo em vista o que consta do processo administrativo E-14\/23797\/2010,<\/p><p><strong>CONSIDERANDO<\/strong>:<\/p><p>&#8211; o objetivo de dotar os \u00f3rg\u00e3os e entidades do Estado do Rio de Janeiro de instrumentos de preven\u00e7\u00e3o a comportamentos il\u00edcitos em procedimentos licitat\u00f3rios;<\/p><p>&#8211; a orienta\u00e7\u00e3o da Secretaria de Direito Econ\u00f4mico, \u00f3rg\u00e3o integrante do Minist\u00e9rio da Justi\u00e7a, por meio do of\u00edcio circular n\u00ba 2508\/10, recomendando a inclus\u00e3o da referida declara\u00e7\u00e3o nas licita\u00e7\u00f5es estaduais;<\/p><p>&#8211; que a referida declara\u00e7\u00e3o \u00e9 adotada por outros pa\u00edses e sugerida pela Organiza\u00e7\u00e3o para Coopera\u00e7\u00e3o e Desenvolvimento Econ\u00f4mico &#8211; OCDE, e<\/p><p>&#8211; que a exig\u00eancia da declara\u00e7\u00e3o nas contrata\u00e7\u00f5es referentes \u00e0 Copa de 2014 e \u00e0s Olimp\u00edadas de 2016 foi uma das metas estabelecidas em junho de 2010 pela Estrat\u00e9gia Nacional de Combate a Cart\u00e9is &#8211; ENACC,<\/p><p><strong>DECRETA<\/strong>:<\/p><p><strong>Art. 1\u00ba<\/strong> &#8211; Torna-se obrigat\u00f3ria a apresenta\u00e7\u00e3o da Declara\u00e7\u00e3o de Elabora\u00e7\u00e3o Independente de Proposta em procedimentos licitat\u00f3rios no \u00e2mbito da Administra\u00e7\u00e3o P\u00fablica Estadual Direta e Indireta do Poder Executivo do Estado do Rio de Janeiro.<\/p><p><strong>Par\u00e1grafo \u00danico<\/strong> &#8211; A Declara\u00e7\u00e3o de Elabora\u00e7\u00e3o Independente de Proposta dever\u00e1 observar o modelo constante do Anexo deste Decreto.<\/p><p><strong>Art. 2\u00ba<\/strong> &#8211; Nas modalidades concorr\u00eancia, tomada de pre\u00e7os e convite, a Declara\u00e7\u00e3o de Elabora\u00e7\u00e3o Independente de Proposta dever\u00e1 ser apresentada como anexo da proposta comercial.<\/p><p><strong>Art. 3\u00ba<\/strong> &#8211; Na modalidade preg\u00e3o, seja presencial ou eletr\u00f4nico, a Declara\u00e7\u00e3o de Elabora\u00e7\u00e3o Independente de Proposta dever\u00e1 ser apresentada no momento de abertura da sess\u00e3o p\u00fablica.<\/p><p><strong>Art. 4\u00ba<\/strong> &#8211; Compete \u00e0 Procuradoria Geral do Estado do Rio de Janeiro adequar as minutas-padr\u00e3o do Estado aos termos do presente Decreto.<\/p><p><strong>Art. 5\u00ba<\/strong> &#8211; Este Decreto entrar\u00e1 em vigor no prazo de 60 (sessenta) dias ap\u00f3s a data de sua publica\u00e7\u00e3o.<\/p><p>\u00a0<\/p><p style=\"text-align: center;\">Rio de Janeiro, 24 de agosto
