previstas no Edital, sejam elas pertinentes somente a um valor ou aliadas a uma condi\u00e7\u00e3o t\u00e9cnica.<\/span><\/p><p><span style=\"font-weight: 400;\">Diferentemente da Proposta, os Lances n\u00e3o ser\u00e3o previstos em todos os certames, e podem ser considerados como descontos &#8211; ou acr\u00e9scimos nos casos de leil\u00e3o &#8211; aplicados em cima de sua Proposta, resultando na aplica\u00e7\u00e3o pr\u00e1tica dos princ\u00edpios da Economicidade e da Melhor Proposta ao atendimento das demandas p\u00fablicas.<\/span><\/p><p><span style=\"font-weight: 400;\">As Propostas, e, quando previstos, os Lances, podem ser apresentados em envelopes lacrados ou por meio eletr\u00f4nico, sendo prefer\u00edvel os procedimentos eletr\u00f4nicos devido ao princ\u00edpio do Sigilo das Propostas e dos Participantes (condi\u00e7\u00e3o invi\u00e1vel em procedimentos presenciais).<\/span><\/p><p><span style=\"font-weight: 400;\">Assim, a etapa de apresenta\u00e7\u00e3o de propostas e lances, prevista na <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei n\u00ba 14.133\/2021<\/strong><\/a>, \u00e9 um dos momentos cruciais do processo licitat\u00f3rio. \u00c9 neste momento que os licitantes, ap\u00f3s analisarem o edital e verificarem a viabilidade de participar do certame, formalizam suas propostas, buscando atender aos requisitos estabelecidos e conquistar a contrata\u00e7\u00e3o.<\/span><\/p><p><span style=\"font-weight: 400;\">Apesar de ser uma etapa presente em toda a disputa, ela pode ser realizada de formas distintas. Com a <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>NLLC<\/strong><\/a>, uma grande mudan\u00e7a ocorreu para esta diferencia\u00e7\u00e3o; se antes o valor determinava como a disputa seria realizada, agora \u00e9 a classifica\u00e7\u00e3o e as caracter\u00edsticas do objeto que determina como a disputa ir\u00e1 ocorrer.<\/span><\/p><p><span style=\"font-weight: 400;\">Assim, \u00e9 importante entender que a forma da disputa \u00e9 uma combina\u00e7\u00e3o entre 4 vari\u00e1veis: o Objeto da Licita\u00e7\u00e3o; a Modalidade de Licita\u00e7\u00e3o; o Crit\u00e9rio de Julgamento; e o Modo de href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>Lei de Licita\u00e7\u00f5es<\/strong><\/a> manteve e aprimorou o tratamento diferenciado e favorecido para microempresas (ME) e empresas de pequeno porte (EPP) nas licita\u00e7\u00f5es p\u00fablicas (<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>art. 4<\/strong><\/a>). Atrav\u00e9s do direito de prefer\u00eancia a Administra\u00e7\u00e3o P\u00fablica visa impulsionar o desenvolvimento desses neg\u00f3cios, que representam uma parcela significativa da economia brasileira (<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>art. 44<\/strong><\/a>.)<\/span><\/p><p><span style=\"font-weight: 400;\">Nesse contexto,<\/span> <span style=\"font-weight: 400;\">o direito de prefer\u00eancia \u00e9 fundamental para promover a inclus\u00e3o das ME\/EPP nas licita\u00e7\u00f5es p\u00fablicas, contribuindo para o desenvolvimento econ\u00f4mico e social do pa\u00eds.<\/span><\/p><p><span style=\"font-weight: 400;\">Importante destacar que o Direito de Prefer\u00eancia n\u00e3o esta previsto na <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\"><strong>NLLC<\/strong><\/a>, mas sim no art. 44 na<strong><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Leis\/LCP\/Lcp123.htm\"> Lei Federal 123\/06 (Lei das Micro e Pequenas Empresas)<\/a><\/strong>. Adicionalmente, esta lei tamb\u00e9m prev\u00ea que que este direito ser\u00e1 exercido no percentual de 10% em todas as modalidade com exce\u00e7\u00e3o do Preg\u00e3o, que ser\u00e1 de 5%.<\/span><\/p><p><span style=\"font-weight: 400;\">Assim, o Direito de Prefer\u00eancia \u00e9 na pr\u00e1tica uma chance adicional, ap\u00f3s o fim dos lances, que as ME\/EPP ganham para baixar seu Assim, a etapa de apresenta\u00e7\u00e3o de propostas e lances, prevista na Lei n\u00ba 14.133\/2021, \u00e9 um dos momentos cruciais do processo licitat\u00f3rio. \u00c9 neste momento que os licitantes, ap\u00f3s analisarem o edital e verificarem a viabilidade de participar do certame, formalizam suas propostas, buscando atender aos requisitos estabelecidos e conquistar a contrata\u00e7\u00e3o. Apesar de ser uma etapa presente em toda a disputa, ela pode ser realizada de formas distintas. Com a NLLC, uma grande mudan\u00e7a ocorreu para esta diferencia\u00e7\u00e3o; se antes o valor determinava como a disputa seria realizada, agora \u00e9 a classifica\u00e7\u00e3o e as caracter\u00edsticas do objeto que determina como a disputa ir\u00e1 ocorrer. Assim, \u00e9 importante entender que a forma da disputa \u00e9 uma combina\u00e7\u00e3o entre 4 vari\u00e1veis: o Objeto da Licita\u00e7\u00e3o; a Modalidade de Licita\u00e7\u00e3o; o Crit\u00e9rio de Julgamento; e o Modo de Disputa.\u00a0 Objetos da Licita\u00e7\u00e3o Os objetos das licita\u00e7\u00f5es s\u00e3o variados e podem abranger desde a constru\u00e7\u00e3o de obras p\u00fablicas at\u00e9 a aquisi\u00e7\u00e3o de materiais de escrit\u00f3rio. A escolha da modalidade de licita\u00e7\u00e3o depender\u00e1 da natureza e complexidade do objeto. Um breve resumo dos objetos previstos na revogada Lei 8.666\/93 assim como na Lei 14.133\/21 \u00e9 apresentado a seguir: Contudo, a NLLC trouxe consigo um maior detalhamento sobre os tipos de objetos, visando a adequa\u00e7\u00e3o a essa nova condi\u00e7\u00e3o de defini\u00e7\u00e3o da forma de disputa, sendo esta resumida a seguir: Modalidades de Licita\u00e7\u00e3o A Lei n\u00ba 14.133\/2021 prev\u00ea diversas modalidades de licita\u00e7\u00e3o, cada uma com suas particularidades e aplicabilidade. A modalidade de licita\u00e7\u00e3o pode ser definida como a forma de conduzir a disputa entre os licitantes para que a Administra\u00e7\u00e3o P\u00fablica obtenha a proposta mais vantajosa. A NLLC prev\u00ea cinco modalidades poss\u00edveis de serem utilizadas, e pro\u00edbe a cria\u00e7\u00e3o de novas modalidades, sendo elas: Concorr\u00eancia: \u00c9 a modalidade mais ampla, utilizada para a contrata\u00e7\u00e3o de obras, servi\u00e7os e compras de grande vulto. Preg\u00e3o: Obrigat\u00f3ria para a aquisi\u00e7\u00e3o de bens e servi\u00e7os comuns, com crit\u00e9rios de julgamento como menor pre\u00e7o ou maior desconto. Concurso: Utilizado para a sele\u00e7\u00e3o de projetos, estudos t\u00e9cnicos, planos, pesquisas e outros trabalhos t\u00e9cnicos. Leil\u00e3o: Modalidade utilizada para aliena\u00e7\u00e3o de bens m\u00f3veis ou im\u00f3veis. Di\u00e1logo competitivo: Permite um di\u00e1logo entre a administra\u00e7\u00e3o p\u00fablica e os licitantes para a defini\u00e7\u00e3o do objeto e das condi\u00e7\u00f5es da contrata\u00e7\u00e3o. A escolha da modalidade \u00e9 a principal definidora dos tr\u00e2mites e procedimentos a serem utilizados em uma disputa. A concorr\u00eancia e o preg\u00e3o utilizam o rito procedimental comum , previsto no art. 17, sendo os demais casos adequados ou especificados em suas respectivas normas. Como dito anteriormente , a NLLC mudou radicalmente como selecionamos a modalidade a ser utilizada, saindo do valor e ficando totalmente vinculada ao objeto a ser licitado, nesse sentido apresentamos abaixo uma breve matriz entre o objeto e a modalidade para facilitar a identifica\u00e7\u00e3o a ser utilizada. Contudo, a defini\u00e7\u00e3o da modalidade n\u00e3o \u00e9 suficiente para determinar a forma como ser\u00e3o julgadas as propostas e definido o vencedor da disputa, motivo pelo qual o \u201ccrit\u00e9rio de julgamento\u201d tamb\u00e9m precisa ser estabelecido, de acordo com o objeto e com a modalidade. Crit\u00e9rios de Julgamento Os crit\u00e9rios de julgamento s\u00e3o os par\u00e2metros utilizados para comparar as propostas e definir o vencedor da licita\u00e7\u00e3o. Ao longo dos anos podemos observar que \u00e9 algo presente em todas as leis que tratam de licita\u00e7\u00f5es e que os crit\u00e9rios evoluem a cada legisla\u00e7\u00e3o. Nesse contexto, temos que a Lei n\u00ba 14.133\/2021 prev\u00ea um rol maior de crit\u00e9rios que podem ser resumidos da seguinte forma: Menor pre\u00e7o: A proposta com o menor valor \u00e9 a vencedora. Maior desconto: A proposta que oferecer o maior desconto em rela\u00e7\u00e3o ao pre\u00e7o de refer\u00eancia \u00e9 a vencedora. Melhor t\u00e9cnica ou conte\u00fado art\u00edstico: A proposta que apresentar a melhor solu\u00e7\u00e3o t\u00e9cnica ou o melhor conte\u00fado art\u00edstico \u00e9 a vencedora. T\u00e9cnica e pre\u00e7o: A proposta que oferecer a melhor combina\u00e7\u00e3o entre t\u00e9cnica e pre\u00e7o \u00e9 a vencedora. Maior Lance: Proposta com o maior valor para a venda de bens p\u00fablicos. Maior retorno econ\u00f4mico: A proposta que gerar o maior retorno econ\u00f4mico (maior economia em despesas correntes) para a administra\u00e7\u00e3o p\u00fablica \u00e9 a vencedora. Assim como a modalidade, o crit\u00e9rio \u00e9 muito influenciado pelo objeto, podendo ser resumido na amplia\u00e7\u00e3o da matriz anteriormente apresentada, sendo assim uma Matriz de Objeto, Modalidade e Crit\u00e9rio conforme apresentado abaixo. Apesar de todas essas defini\u00e7\u00f5es a licita\u00e7\u00e3o muitas vezes se torna vagarosa, visto que a disputa, na NLLC, dura enquanto durarem os lances e sempre com base no menor pre\u00e7o ofertado por cada licitante. neste contexto, os licitantes buscam manter as maiores margens de lucro ofertando lances m\u00ednimos, motivo pelo qual foi introduzido na NLLC os \u201cmodos de disputa\u201d e o \u201cintervalo m\u00ednimo entre lances\u201d. Modos de Disputa A Lei n\u00ba 14.133\/2021, no art. 56 trouxe em seu texto a figura dos Modos de Disputa visando maior celeridade nos procedimentos licitat\u00f3rios. Ele atua como uma regra for\u00e7ando o licitante a apresentar lances vantajosos \u00e0 administra\u00e7\u00e3o, caso contr\u00e1rio poder\u00e1 ficar fora da disputa. Na pr\u00e1tica ele adiciona o risco da inseguran\u00e7a de ser retirado da disputa por n\u00e3o ofertar o seu melhor valor ou proposta.
