\u00e9 o documento que compilar\u00e1 os riscos identificados, oferecer\u00e1 a perspectiva dos atores envolvidos quanto \u00e0 probabilidade e impacto desses e as respectivas a\u00e7\u00f5es de mitiga\u00e7\u00e3o. Ele est\u00e1 previsto no <strong><a href=\"https:\/\/leisestaduais.com.br\/rj\/decreto-n-48816-2023-rio-de-janeiro-regulamenta-a-fase-preparatoria-das-contratacoes-de-que-trata-a-lei-no-14-133-de-1o-de-abril-de-2021-no-ambito-da-administracao-publica-estadual-direta-autarquica-e-fundacional?q=48816&amp;origin=instituicao#\">art. 14 do Decreto 48.816\/23<\/a><\/strong>.<\/span><\/p><p><b>Risco<\/b><span style=\"font-weight: 400;\"> \u00e9 a jun\u00e7\u00e3o da probabilidade e impactos de um evento que possa vir a acontecer no futuro.<\/span><\/p><p><span style=\"font-weight: 400;\">O simples fato de existir uma atividade j\u00e1 a exp\u00f5e a riscos.<\/span><\/p><p><span style=\"font-weight: 400;\">Embora existam cursos e metodologias que auxiliem na avalia\u00e7\u00e3o e gerenciamento de riscos, n\u00e3o existe metodologia cient\u00edfica por tr\u00e1s desses conceitos, tampouco uma verdade \u00fanica.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-975c762 elementor-widget elementor-widget-image\" data-id=\"975c762\" riscos<\/b><span style=\"font-weight: 400;\"> \u00e9 o documento formal que entrar\u00e1 no processo de licita\u00e7\u00e3o e que comprovar\u00e1 que o \u00f3rg\u00e3o realizou a atividade m\u00ednima de identifica\u00e7\u00e3o e elabora\u00e7\u00e3o da estrat\u00e9gia de mitiga\u00e7\u00e3o de riscos.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37416f0 elementor-widget elementor-widget-image\" data-id=\"37416f0\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" orienta\u00e7\u00f5es metodol\u00f3gicas fundamentam-se nos seguintes documentos:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.in.gov.br\/materia\/-\/asset_publisher\/Kujrw0TZC2Mb\/content\/id\/21519355\/do1-2016-05-11-instrucao-normativa-conjunta-n-1-de-10-de-maio-de-2016-21519197\"><b>Instru\u00e7\u00e3o Normativa Conjunta n\u00ba 01\/2016 do Minist\u00e9rio do Planejamento, Or\u00e7amento e Gest\u00e3o e a Controladoria-Geral da Uni\u00e3o<\/b><\/a><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Padr\u00e3o de Gest\u00e3o de Riscos, elaborado por <\/span><i><span style=\"font-weight: 400;\">The Institute of Risk Management (IRM), The Association of Insurance and Risk Managers (AIRMIC) e ALARM The National Forum for Risk Management in the Public Sector<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Essas fontes sugerem algumas <\/span><b>categoriza\u00e7\u00f5es<\/b><span style=\"font-weight: 400;\"> que podem auxiliar a Equipe de Planejamento no processo de identifica\u00e7\u00e3o dos riscos:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos por fase da contrata\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\">: pode-se tentar identificar os riscos que afetam apenas a fase preparat\u00f3ria, apenas a fase externa, apenas a gest\u00e3o do contrato ou a todas as fases.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Risco por dimens\u00e3o do projeto<\/b><span style=\"font-weight: 400;\">: pode-se tentar identificar os riscos que afetem os componentes de um projeto (uma contrata\u00e7\u00e3o \u00e9 compar\u00e1vel a um projeto) segundo o PMBOK: escopo, custos e prazos.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos por origem<\/b><span style=\"font-weight: 400;\">: se adv\u00e9m de fatores internos ao \u00f3rg\u00e3o (servidores, estrutura f\u00edsica, dificuldades processuais, etc.) ou de fatores externos (economia, fornecedores, m\u00eddia negativa ou positiva, \u00f3rg\u00e3os reguladores, etc.).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos estrat\u00e9gicos<\/b><span style=\"font-weight: 400;\">: que podem surgir do ou afetar o planejamento estrat\u00e9gico e a miss\u00e3o final\u00edstica do \u00f3rg\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos Operacionais<\/b><span style=\"font-weight: 400;\">: que podem surgir do ou afetar o cotidiano dos trabalhos realizados pelo \u00f3rg\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos Financeiros<\/b><span style=\"font-weight: 400;\">: que envolvem quest\u00f5es financeiras, como capacidade de empenho, d\u00edvidas, falta de pagamento aos funcion\u00e1rios pelo fornecedor, etc.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Riscos Tecnol\u00f3gicos<\/b><span style=\"font-weight: 400;\">: que envolvem as inova\u00e7\u00f5es tecnol\u00f3gicas ou a resist\u00eancia cultural \u00e0 mudan\u00e7a de processos oriundos dessas inova\u00e7\u00f5es.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Existem infinitos descritivos e todos eles podem ser observados em conjunto num \u00fanico risco identificado.<\/span><\/p><p><span style=\"font-weight: 400;\">As categorias s\u00f3 s\u00e3o \u00fateis para auxiliar no processo de identifica\u00e7\u00e3o e na apresenta\u00e7\u00e3o das informa\u00e7\u00f5es, ent\u00e3o n\u00e3o h\u00e1 que se preocupar com uma \u201ccorreta\u201d categoriza\u00e7\u00e3o de riscos.<\/span><\/p><p><span style=\"font-weight: 400;\">O mais importante a se considerar \u00e9 que um risco poder\u00e1 ser avaliado de formas diferentes por cada servidor.<\/span><\/p><p><span style=\"font-weight: 400;\">Por isso \u00e9 importante o trabalho em equipe nesta fase. Se poss\u00edvel, devem ser inclu\u00eddos atores com capacidade de tomada de decis\u00e3o para melhor defini\u00e7\u00e3o das a\u00e7\u00f5es de mitiga\u00e7\u00e3o dos riscos.<\/span><\/p><p><span style=\"font-weight: 400;\">Para tanto, sugere-se o roteiro abaixo:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b488ef elementor-widget elementor-widget-image\" data-id=\"5b488ef\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2024\/01\/Atualizacao-RedelogSUPCC-1.jpg\" title=\"\" alt=\"\" loading=\"lazy\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-761a006 elementor-widget elementor-widget-image\" data-id=\"761a006\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<a href=\"https:\/\/www.redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2024\/01\/WhatsApp-Image-2024-01-18-at-12.38.20-PM.jpeg\" data-elementor-open-lightbox=\"yes\" data-e-action-hash=\"#elementor-action%3Aaction%3Dlightbox%26settings%3DeyJpZCI6Mjc0NTUsInVybCI6ZmFsc2V9\">\n\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.redelog.rj.gov.br\/redelog\/wp-content\/uploads\/2024\/01\/WhatsApp-Image-2024-01-18-at-12.38.20-PM.jpeg\" title=\"\" alt=\"\" loading=\"lazy\" \/>\t\t\t\t\t\t\t\t<\/a>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c43089 elementor-widget elementor-widget-text-editor\" data-id=\"7c43089\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">As atividades 2, 3 e 4 podem ser realizadas por um \u00fanico servidor, pela Equipe de Planejamento da Contrata\u00e7\u00e3o ou (idealmente) na pr\u00f3pria reuni\u00e3o citada na atividade 1.<\/span><\/p><p><span style=\"font-weight: 400;\">Existem quatro tipos de a\u00e7\u00e3o que podem ser tomadas para a mitiga\u00e7\u00e3o de um risco, sejam <\/span><b>a\u00e7\u00f5es de preven\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\"> (realizadas antes da concretiza\u00e7\u00e3o de um risco) ou <\/span><b>a\u00e7\u00f5es de conting\u00eancia<\/b><span style=\"font-weight: 400;\"> (realizadas ap\u00f3s a concretiza\u00e7\u00e3o de um risco):<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Aceitar<\/b><span style=\"font-weight: 400;\">: que significa que n\u00e3o h\u00e1 nada que possa ser feito contra o risco identificado, mas que a equipe entende que os impactos s\u00e3o aceit\u00e1veis para o \u00f3rg\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rejeitar<\/b><span style=\"font-weight: 400;\">: que significa que n\u00e3o h\u00e1 nada que possa ser feito contra o risco identificado e a equipe entende que os impactos s\u00e3o inaceit\u00e1veis para o \u00f3rg\u00e3o. Em geral, esse tipo de risco pode inviabilizar a escolha de uma determinada solu\u00e7\u00e3o ou at\u00e9 mesmo a contrata\u00e7\u00e3o inteira.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Transferir<\/b><span style=\"font-weight: 400;\">: nessas a\u00e7\u00f5es, transfere-se o risco para outro ator, tal como uma seguradora ou o pr\u00f3prio fornecedor. Sempre haver\u00e1 aumento de custos numa transfer\u00eancia de riscos, mas ela pode ser interessante. A transfer\u00eancia do risco \u00e9 uma a\u00e7\u00e3o vista corriqueiramente em editais de licita\u00e7\u00e3o, em que o \u00f3rg\u00e3o p\u00fablico transfere riscos (\u00e0s vezes com baixa probabilidade e impacto) para o fornecedor, aumentando custos desnecessariamente. Verifique se o Termo de Refer\u00eancia da contrata\u00e7\u00e3o (ou edital) tece obriga\u00e7\u00f5es para o fornecedor na linha de: \u201cA contratada ser\u00e1 respons\u00e1vel por TODA e QUALQUER situa\u00e7\u00e3o que venha a trazer preju\u00edzos (\u2026)\u201d. Sugere-se alterar ou remover cl\u00e1usulas com essas reda\u00e7\u00f5es, de modo que os riscos sejam compartilhados entre o \u00f3rg\u00e3o p\u00fablico e o contratado\u201d.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Reduzir<\/b><span style=\"font-weight: 400;\">: o tipo mais comum de a\u00e7\u00e3o, em que o \u00f3rg\u00e3o ter\u00e1 a\u00e7\u00e3o proativa de reduzir os efeitos causadores de um risco. Exemplo: realizar a verifica\u00e7\u00e3o da rede el\u00e9trica para evitar problemas el\u00e9tricos nos computadores de trabalho.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Antes de seguir para as exemplifica\u00e7\u00f5es, \u00e9 importante distinguir os conceitos de Mapa de Riscos e Gerenciamento de Riscos.<\/span><\/p><p><span style=\"font-weight: 400;\">Como exposto no in\u00edcio, o <\/span><b>Mapa de Riscos<\/b><span style=\"font-weight: 400;\"> \u00e9 uma documenta\u00e7\u00e3o formal que comprova a realiza\u00e7\u00e3o da atividade no \u00e2mbito do processo de contrata\u00e7\u00e3o. Assim, o Mapa de Riscos \u00e9 uma fotografia dos riscos identificados naquele momento.<\/span><\/p><p><span style=\"font-weight: 400;\">Todavia, a natureza dos riscos \u00e9 din\u00e2mica e conforme o processo licitat\u00f3rio progrida, as probabilidades e impactos de cada risco sofrer\u00e3o altera\u00e7\u00f5es. O mapa de riscos \u00e9 o documento formal que entrar\u00e1 no processo de licita\u00e7\u00e3o e que comprovar\u00e1 que o \u00f3rg\u00e3o realizou a atividade m\u00ednima de identifica\u00e7\u00e3o e elabora\u00e7\u00e3o da estrat\u00e9gia de mitiga\u00e7\u00e3o de riscos. Estas orienta\u00e7\u00f5es metodol\u00f3gicas fundamentam-se nos seguintes documentos: Instru\u00e7\u00e3o Normativa Conjunta n\u00ba 01\/2016 do Minist\u00e9rio do Planejamento, Or\u00e7amento e Gest\u00e3o e a Controladoria-Geral da Uni\u00e3o Padr\u00e3o de Gest\u00e3o de Riscos, elaborado por The Institute of Risk Management (IRM), The Association of Insurance and Risk Managers (AIRMIC) e ALARM The National Forum for Risk Management in the Public Sector. Essas fontes sugerem algumas categoriza\u00e7\u00f5es que podem auxiliar a Equipe de Planejamento no processo de identifica\u00e7\u00e3o dos riscos: Riscos por fase da contrata\u00e7\u00e3o: pode-se tentar identificar os riscos que afetam apenas a fase preparat\u00f3ria, apenas a fase externa, apenas a gest\u00e3o do contrato ou a todas as fases. Risco por dimens\u00e3o do projeto: pode-se tentar identificar os riscos que afetem os componentes de um projeto (uma contrata\u00e7\u00e3o \u00e9 compar\u00e1vel a um projeto) segundo o PMBOK: escopo, custos e prazos. Riscos por origem: se adv\u00e9m de fatores internos ao \u00f3rg\u00e3o (servidores, estrutura f\u00edsica, dificuldades processuais, etc.) ou de fatores externos (economia, fornecedores, m\u00eddia negativa ou positiva, \u00f3rg\u00e3os reguladores, etc.). Riscos estrat\u00e9gicos: que podem surgir do ou afetar o planejamento estrat\u00e9gico e a miss\u00e3o final\u00edstica do \u00f3rg\u00e3o. Riscos Operacionais: que podem surgir do ou afetar o cotidiano dos trabalhos realizados pelo \u00f3rg\u00e3o. Riscos Financeiros: que envolvem quest\u00f5es financeiras, como capacidade de empenho, d\u00edvidas, falta de pagamento aos funcion\u00e1rios pelo fornecedor, etc. Riscos Tecnol\u00f3gicos: que envolvem as inova\u00e7\u00f5es tecnol\u00f3gicas ou a resist\u00eancia cultural \u00e0 mudan\u00e7a de processos oriundos dessas inova\u00e7\u00f5es. Existem infinitos descritivos e todos eles podem ser observados em conjunto num \u00fanico risco identificado. As categorias s\u00f3 s\u00e3o \u00fateis para auxiliar no processo de identifica\u00e7\u00e3o e na apresenta\u00e7\u00e3o das informa\u00e7\u00f5es, ent\u00e3o n\u00e3o h\u00e1 que se preocupar com uma \u201ccorreta\u201d categoriza\u00e7\u00e3o de riscos. O mais importante a se considerar \u00e9 que um risco poder\u00e1 ser avaliado de formas diferentes por cada servidor. Por isso \u00e9 importante o trabalho em equipe nesta fase. Se poss\u00edvel, devem ser inclu\u00eddos atores com capacidade de tomada de decis\u00e3o para melhor defini\u00e7\u00e3o das a\u00e7\u00f5es de mitiga\u00e7\u00e3o dos riscos. Para tanto, sugere-se o roteiro abaixo: As atividades 2, 3 e 4 podem ser realizadas por um \u00fanico servidor, pela Equipe de Planejamento da Contrata\u00e7\u00e3o ou (idealmente) na pr\u00f3pria reuni\u00e3o citada na atividade 1. Existem quatro tipos de a\u00e7\u00e3o que podem ser tomadas para a mitiga\u00e7\u00e3o de um risco, sejam a\u00e7\u00f5es de preven\u00e7\u00e3o (realizadas antes da concretiza\u00e7\u00e3o de um risco) ou a\u00e7\u00f5es de conting\u00eancia (realizadas ap\u00f3s a concretiza\u00e7\u00e3o de um risco): Aceitar: que significa que n\u00e3o h\u00e1 nada que possa ser feito contra o risco identificado, mas que a equipe entende que os impactos s\u00e3o aceit\u00e1veis para o \u00f3rg\u00e3o. Sempre haver\u00e1 aumento de custos numa transfer\u00eancia de riscos, mas ela pode ser interessante. A transfer\u00eancia do risco \u00e9 uma a\u00e7\u00e3o vista corriqueiramente em editais de licita\u00e7\u00e3o, em que o \u00f3rg\u00e3o p\u00fablico transfere riscos (\u00e0s vezes com baixa probabilidade e impacto) para o fornecedor, aumentando custos desnecessariamente. Verifique se o Termo de Refer\u00eancia da contrata\u00e7\u00e3o (ou edital) tece obriga\u00e7\u00f5es para o fornecedor na linha de: \u201cA contratada ser\u00e1 respons\u00e1vel por TODA e QUALQUER situa\u00e7\u00e3o que venha a trazer preju\u00edzos (\u2026)\u201d. Sugere-se alterar ou remover cl\u00e1usulas com essas reda\u00e7\u00f5es, de modo que os riscos sejam compartilhados entre o \u00f3rg\u00e3o p\u00fablico e o contratado\u201d.
