class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: justify;\">O <b>GOVERNADOR DO ESTADO DO RIO DE JANEIRO<\/b>, no uso das atribui\u00e7\u00f5es que lhe s\u00e3o conferidas na forma da legisla\u00e7\u00e3o em vigor,<\/p>\n<p style=\"text-align: justify;\"><b>CONSIDERANDO:<\/b><\/p>\n<p style=\"text-align: justify;\">&#8211; as disposi\u00e7\u00f5es da Lei Estadual no 7.989, de 14 de junho de 2018, que atribui \u00e0 Controladoria Geral do Estado as fun\u00e7\u00f5es de elaborar normas e orienta\u00e7\u00f5es para regular as atividades de gest\u00e3o de riscos relacionadas aos objetivos organizacionais e gerenciar os riscos corporativos dos \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o Direta e Indireta.<\/p>\n<p style=\"text-align: justify;\">&#8211; as disposi\u00e7\u00f5es do Decreto n\u00b0 42.092, de 27 de outubro de 2009 que institui o Sistema Log\u00edstico do Estado e confere atribui\u00e7\u00f5es de planejamento, normatiza\u00e7\u00e3o e supervis\u00e3o das atividades log\u00edsticas ao seu \u00f3rg\u00e3o central; e<\/p>\n<p style=\"text-align: justify;\">&#8211; que o Comit\u00ea de Seguros e Riscos &#8211; COSER, institu\u00eddo pelo Decreto no 25.731, de 18 de novembro de 1999, encontra-se desalinhado com a pol\u00edtica de compras adotada pela Administra\u00e7\u00e3o, e que os crit\u00e9rios que embasam a sua avalia\u00e7\u00e3o para a contrata\u00e7\u00e3o de seguros, da forma como lhe foram ent\u00e3o atribu\u00eddos, \u00e9 desprovida de uma vis\u00e3o integrada da gest\u00e3o e gerenciamento de riscos, contrariamente ao que vem se impondo modernamente como boa pr\u00e1tica de gest\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><b>DECRETA:<\/b><\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>CAP\u00cdTULO I<\/b><\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>DAS DISPOSI\u00c7\u00d5ES GERAIS<\/b><\/p>\n<p style=\"text-align: justify;\"><b>Art. 1\u00ba<\/b> &#8211; Este Decreto institui, sem aumento da despesa, a Pol\u00edtica Estadual para a Gest\u00e3o de Seguros.<\/p>\n<p style=\"text-align: justify;\"><b>Par\u00e1grafo \u00danico<\/b> &#8211; Sujeitam-se ao disposto neste Decreto os \u00f3rg\u00e3os e entidades da administra\u00e7\u00e3o direta, fundacional e aut\u00e1rquica do Poder Executivo do Estado do Rio de Janeiro.<\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>CAP\u00cdTULO II<\/b><\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>DA POL\u00cdTICA ESTADUAL DE GEST\u00c3O DE SEGUROS<\/b><\/p>\n<p style=\"text-align: justify;\">\n<\/p><p style=\"text-align: justify;\"><b>Art. 2\u00ba<\/b> &#8211; A Pol\u00edtica Estadual de Gest\u00e3o de Seguros tem por finalidades regulamentar a contrata\u00e7\u00e3o e a manuten\u00e7\u00e3o de seguros, imprimindo efici\u00eancia e efic\u00e1cia na mitiga\u00e7\u00e3o de riscos que venham a ser tratados por este instrumento.<\/p>\n<p style=\"text-align: justify;\"><b>Art. 3\u00ba<\/b> &#8211; A pol\u00edtica estadual de gest\u00e3o de seguros dispor\u00e1, dentre outros, sobre:<\/p>\n<p style=\"text-align: justify;\"><b>I<\/b> &#8211; tipos, modalidades e coberturas eleg\u00edveis \u00e0 contrata\u00e7\u00e3o pelos \u00f3rg\u00e3os e entidades;<\/p>\n<p style=\"text-align: justify;\"><b>II<\/b> &#8211; requisitos m\u00ednimos necess\u00e1rios \u00e0 contra\u00e7\u00e3o; e<\/p>\n<p style=\"text-align: justify;\"><b>III <\/b>&#8211; procedimentos relativos ao controle, comunica\u00e7\u00e3o e liquida\u00e7\u00e3o de sinistros dos seguros contratados.<\/p>\n<p style=\"text-align: justify;\"><b>Par\u00e1grafo \u00danico<\/b> &#8211; Competir\u00e1 ao \u00d3rg\u00e3o Central do Sistema Log\u00edstico, regulamentar, em ato pr\u00f3prio, a pol\u00edtica estadual de gest\u00e3o de seguros.<\/p>\n<p style=\"text-align: justify;\"><b>Art. 4\u00ba<\/b> &#8211; O \u00f3rg\u00e3o ou entidade que realizar a contrata\u00e7\u00e3o de seguros de qualquer natureza, \u00e0 exce\u00e7\u00e3o dos obrigat\u00f3rios, dever\u00e1 encaminhar uma c\u00f3pia do contrato e da ap\u00f3lice para o \u00d3rg\u00e3o Central de Log\u00edstica.<\/p>\n<p style=\"text-align: justify;\"><b>Art. 5\u00ba<\/b> &#8211; A partir da publica\u00e7\u00e3o deste Decreto, cessar\u00e3o as atividades do Comit\u00ea de Seguros e Riscos &#8211; COSER, revogando-se o Decreto no 25.731, de 18 de novembro de 1999, o Decreto n\u00b0 33.615, de 29 de julho de 2003 e as legisla\u00e7\u00f5es subsequentes.<\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>CAP\u00cdTULO III<\/b><\/p>\n<p style=\"text-align: center;\" align=\"center\"><b>DAS DISPOSI\u00c7\u00d5ES FINAIS<\/b><\/p>\n<p style=\"text-align: justify;\">\n<\/p><p style=\"text-align: justify;\"><b>Art. 6\u00ba<\/b> &#8211; Fica delegada ao \u00d3rg\u00e3o Central do Sistema Log\u00edstico, nas suas respectivas esferas de atua\u00e7\u00e3o, a compet\u00eancia para resolver os casos omissos e regulamentar o presente Decreto.<\/p>\n<p style=\"text-align: justify;\"><b>Art. 7\u00ba<\/b> &#8211; Este Decreto entrar\u00e1 em vigor na data de sua publica\u00e7\u00e3o, revogadas as disposi\u00e7\u00f5es em contr\u00e1rio.<\/p>\n<p style=\"text-align: justify;\">\n<\/p><p style=\"text-align: center;\" O GOVERNADOR DO ESTADO DO RIO DE JANEIRO, no uso das atribui\u00e7\u00f5es que lhe s\u00e3o conferidas na forma da legisla\u00e7\u00e3o em vigor, CONSIDERANDO: &#8211; as disposi\u00e7\u00f5es da Lei Estadual no 7.989, de 14 de junho de 2018, que atribui \u00e0 Controladoria Geral do Estado as fun\u00e7\u00f5es de elaborar normas e orienta\u00e7\u00f5es para regular as atividades de gest\u00e3o de riscos relacionadas aos objetivos organizacionais e gerenciar os riscos corporativos dos \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o Direta e Indireta. &#8211; as disposi\u00e7\u00f5es do Decreto n\u00b0 42.092, de 27 de outubro de 2009 que institui o Sistema Log\u00edstico do Estado e confere atribui\u00e7\u00f5es de planejamento, normatiza\u00e7\u00e3o e supervis\u00e3o das atividades log\u00edsticas ao seu \u00f3rg\u00e3o central; e &#8211; que o Comit\u00ea de Seguros e Riscos &#8211; COSER, institu\u00eddo pelo Decreto no 25.731, de 18 de novembro de 1999, encontra-se desalinhado com a pol\u00edtica de compras adotada pela Administra\u00e7\u00e3o, e que os crit\u00e9rios que embasam a sua avalia\u00e7\u00e3o para a contrata\u00e7\u00e3o de seguros, da forma como lhe foram ent\u00e3o atribu\u00eddos, \u00e9 desprovida de uma vis\u00e3o integrada da gest\u00e3o e gerenciamento de riscos, contrariamente ao que vem se impondo modernamente como boa pr\u00e1tica de gest\u00e3o. DECRETA: CAP\u00cdTULO I DAS DISPOSI\u00c7\u00d5ES GERAIS Art. 1\u00ba &#8211; Este Decreto institui, sem aumento da despesa, a Pol\u00edtica Estadual para a Gest\u00e3o de Seguros. Par\u00e1grafo \u00danico &#8211; Sujeitam-se ao disposto neste Decreto os \u00f3rg\u00e3os e entidades da administra\u00e7\u00e3o direta, fundacional e aut\u00e1rquica do Poder Executivo do Estado do Rio de Janeiro. CAP\u00cdTULO II DA POL\u00cdTICA ESTADUAL DE GEST\u00c3O DE SEGUROS Art. 2\u00ba &#8211; A Pol\u00edtica Estadual de Gest\u00e3o de Seguros tem por finalidades regulamentar a contrata\u00e7\u00e3o e a manuten\u00e7\u00e3o de seguros, imprimindo efici\u00eancia e efic\u00e1cia na mitiga\u00e7\u00e3o de riscos que venham a ser tratados por este instrumento. Art. 3\u00ba &#8211; A pol\u00edtica estadual de gest\u00e3o de seguros dispor\u00e1, dentre outros, sobre: I &#8211; tipos, modalidades e coberturas eleg\u00edveis \u00e0 contrata\u00e7\u00e3o pelos \u00f3rg\u00e3os e entidades; II &#8211; requisitos m\u00ednimos necess\u00e1rios \u00e0 contra\u00e7\u00e3o; e III &#8211; procedimentos relativos ao controle, comunica\u00e7\u00e3o e liquida\u00e7\u00e3o de sinistros dos seguros contratados. Par\u00e1grafo \u00danico &#8211; Competir\u00e1 ao \u00d3rg\u00e3o Central do Sistema Log\u00edstico, regulamentar, em ato pr\u00f3prio, a pol\u00edtica estadual de gest\u00e3o de seguros. Art. 4\u00ba &#8211; O \u00f3rg\u00e3o ou entidade que realizar a contrata\u00e7\u00e3o de seguros de qualquer natureza, \u00e0 exce\u00e7\u00e3o dos obrigat\u00f3rios, dever\u00e1 encaminhar uma c\u00f3pia do contrato e da ap\u00f3lice para o \u00d3rg\u00e3o Central de Log\u00edstica. Art. 5\u00ba &#8211; A partir da publica\u00e7\u00e3o deste Decreto, cessar\u00e3o as atividades do Comit\u00ea de Seguros e Riscos &#8211; COSER, revogando-se o Decreto no 25.731, de 18 de novembro de 1999, o Decreto n\u00b0 33.615, de 29 de julho de 2003 e as legisla\u00e7\u00f5es subsequentes. CAP\u00cdTULO III DAS DISPOSI\u00c7\u00d5ES FINAIS Art. 6\u00ba &#8211; Fica delegada ao \u00d3rg\u00e3o Central do Sistema Log\u00edstico, nas suas respectivas esferas de atua\u00e7\u00e3o, a compet\u00eancia para resolver os casos omissos e regulamentar o presente Decreto.
